WHEREAS. on or about the

197~, the CITY OF CLEARWATER, FLORIDA, a municipal corporation,
hereinafter referred to as "City", entered into a sewer services contract

entitled "Agreementlf with Third Colchester Properties. Tnc.,
for the following described real property located outside the municipal limits
of the City, which property is presently owned by
R. H. C. Associates
hereinafter referred to as 1l0wner", and described as follows:
That part of Lot 8, in SW 1/4 of Section 1, Township 29 South, Range 15 East, as shown by plat
of Pinellas Groves, Inc., recorded in Plat Book 3, page 15, Public Records of Pinellas County,
Florida, lying within the following described tract: Begin at the NW corner of the SW 1/4 of said
Section 1, and run S 00008'02''E along the W line of said Section 1, 50.00 feet to a point on the
S right of way line of Sunset Point Road (S. R. S588); thenceS 89006' 54" E along said right of way
line, 30.00 feet to the POB; thence continue S 89006'54"E along said right of way line 150.00 feet;
thence S 00008'02"E parallel to the W line of said Section 1, 150. 00 feet; thence N 89006' 54"W,
parallel to the S right of way line of Sunset Point Road (S. R. S588), 150.00 feet; thence N 00008'-
02"W along a line parallel to the W line of said Section 1, 150.00 feet to the POB;

WHEREAS, the sewer services agreement provided for an annual
charge for said services, which charge was equival.ent to the tax revenue
the Cit}( would receive from real property taxes were the serviced property
located within the City; and
WHEREAS, the City wishes to be relieved of its burden of collecting
such annual charges from the property located outside the municipal limits,
and the property owners wish to be released from their burden of having
such annual charges assessed against said property;
NOW, THEREFORE, in consideration of the foregoing and in
consideration of the receipt of the swn of $ **~:C2, 934. 57********>1} which sum
represents the annual sewer service charges levied on the Owner's property
to date, and the City does hereby acknowledge the execution by the Owner
of a new agreement for sewer services, and, in consideration thereof,
the City does hereby remise, release, and forever discharge the Owner
of the property from further obligation under the agreement dated
June 10, 1970
