WHEREAS; the City has responsibility for operation and maintenance of the
street system.
WHEREAS; the City is authorized to contract with the private sector for
performance of its duties.
WHEREAS; the City Commission has encouraged the implementation of an "Adopt-
A-Street" program for the participation of local organizations in specific
street litter removal projects.

NOW THEREFORE; the parties agree as follows:
I.
THE GROUP SHALL:
A. Adopt a section of right-of-way adjacent to the City street for litter
removal at least six times a year.
B. Perform litter removal in strict accordance with the City of Clearwater
"Litter Removal Procedures", City of Clearwater "Litter Removal Program"
and "Federal Manual on Uniform Traffic Control Devices" (MUTCD) .
C. Shall conduct themselves in a safe manner and pre-task briefings prior to
litter removal, in accordance with the City of Clearwater "Litter Removal
Program" and "Litter Removal Procedures".
D. Remove litter during daylight hours only.
E. Remove litter during good weather conditions only.
F. Contact the City of Clearwater Solid Waste Office at 562-4930 to arrange appropriate
litter removal schedule that will not conflict with City maintenance schedules.
G. Ensure that all participants wear safety vests at all times during the litter
removal activity.
H. Not pick up litter at construction or maintenance sites, on bridges or overpasses, or
on medians.

I. Only allow such persons to participate as are determined by the Group to be responsible
enough to safely participate in the litter removal activities. Participating youths
must be at least 12 years of age and the Group shall provide at least two adult
supervisors for every 5 youths aged 12-15 that are participating in the litter removal
activity.
J. Not bring persons to observe the activity if the person is under the age of 16 and is
not an official participant.
K. Not wear clothing which would hinder the sight of participants.
L. Pay all appropriate fees prior to program start-up.
II.
THE CITY SHALL:
A. Provide for a fee of $25.00 each Adopt-A-Street signs at the beginning and end of the
Adopted highway section.
B. Provide six (6) safety vests for use by each Group and one (1) trash tong.
C. Remove large stored trash plastic bags from adopted highway section.
D. Remove certain litter under unusual circumstances (i.e., large, heavy or
hazardous items).
The Group covenants and agrees that it will indemnify and hold harmless the City
and any maintaining agencies and all their officers, agents and employees from
any claim, loss, damage, cost charge or expense arising out of any act, action,
neglect or omission by the Group during the performance of the agreement, whether
direct or indirect, and whether to any person or property to which the City or
said parties may be subject, except that neither Group nor any of its members
shall be liable under this provision for damage arising out of injury or damage
to persons or property directly caused or resulting from the sole negligence of
the City and its member agencies, any maintaining agencies, and all their
officers, employees or agents.

III.
The agreement shall remain in effect for a two-year period. The City or Group may terminate
this agreement for any reason upon 30 days written notice.
IV.
This agreement is nontransferable and not assignable in whole or in part without written
consent of the City.
V.
This agreement is for litter removal activities only. Any beautification activities must be
pursued by another method.
VI.
The Public Services Director of the City of Clearwater shall screen and select the
Streets to be adopted. The director shall also decide all questions, difficulties,
and disputes of any nature whatsoever that may arise under or by reason of this
agreement, the prosecution of fulfillment of the services hereunder and the
character, quality, amount and value thereof and the director's decisions upon all
claims, questions and disputes shall be final and conclusive upon the parties
hereto.

LITTER REMOVAL PROCEDURES
1. Interested sponsoring organizations, groups, or individuals should contact
the City of Clearwater Public Services Department Office for copies of the
guidelines, procedures, and contract agreement.
2. The following areas may be adopted by a sponsoring organization, group, or
individual: City Streets, Right-of-Ways and Parkways Medians are not to be
included in this program due to safety factors.
3. In an effort to make the Adopt-A-Street program available to all citizens, a
maximum of 5 streets/areas will be issued to anyone organization, group,
individual or affiliate. An application fee of $10.00 dollars to offset the
cost of administering this program will be applied. Streets to be adopted
are to be arterial or collector streets. Those groups adopting a street
shall live or have an organizational office or facility in close proximity to
the adopted street. Sign installation cost shall be $25.00 dollars per sign.
4. The Public Services Director or designee will screen and select the section of
City streets, right-of-ways, and/or parkways to be adopted. Groups adopting a
section of City streets may clean only on the areas outside the paved right-
of-ways and shoulders - approximately 12-15 feet from the edge of the outside
driving lane, shoulder, or ramp the grassy areas. No parking will be
allowed on the City street shoulders. In the event of two groups wanting to
adopt the same street it will be on a first come first serve basis.
5. Three (3) copies of the completed contract agreement
by the group coordinator and notarized, shall be

6. One complete fully executed contract agreement package will be forwarded to

7. Upon receipt of the complete executed agreement, application and sign cost
fees, the Public Services Department Office will issue orders to install the
permanent Adopt-A-Street signs for the organization, group, or individual at
the appropriate cost to the group.
8. Safety concerns for the organization, group, or individual is of utmost
importance to the City of Clearwater. Public Services Department' s
representatives shall provide trash bags, six orange safety vests, and trash
tongs to the group coordinator for a first time only participation.
9. The City of Clearwater Public Services Office will coordinate efforts with the
group. The group may redeem any recyclables collected and keep the proceeds
for the group. The group will be responsible for supplying their own plastic
trash bags after the initial bags have been provided. The trash bags shall be
left under the Adopt-A-Street signs for collection. The Solid Waste
Department (562 -4930) will schedule trash bag collection from participants
calling in to have trash removed from the streets as soon as practical after
completion of the clean-up efforts.
10. Litter clean-up report forms, included in the agreement package (make copies
for future use), shall be completed by the group after each litter clean-up
event and returned to the Public Services Department. The Public Services
Department will maintain files for all Adopt-A-Street activities. Failure to
comply may result in being dropped from the program without reimbursement of
fees.
11.An authoritative representative of the group shall sign the Adopt-A-Street
Litter Removal Agreement.
12. This program is a requirement of the NPDES (National Pollutant Discharge
Elimination System) Compliance Item 13.

SAFETY RECOMMENDATIONS
ADOPT -A-STREET
LITTER REMOVAL PROGRAM
The following City of Clearwater Safety Recommendations are provided for groups
participating in the Adopt-A-Street litter control program:
1. Prior to any clean up operations, the group leader will notify the Public
Services Department.
2. No horseplay of any type will be tolerated.
3. No intoxicating liquid, beverage or illegal drugs will be allowed.
4. Persons participating should wear gloves; a good quality shoes (no open toe
shoes or shower clogs) and light or bright colored protective clothing. No
clothing will be allowed that hinders the sight of the participant. Safety
vests shall be worn at all times.
5. An adequate supply of drinking water should be readily available.
6. A good pair of sunglasses, cap, and sun block should be considered.
7. Carpool to the adopted street section to keep the number of cars on the
roadside to a minimum. Park off the roadway as far away from the pavement
edge as possible. Keep vehicles on the same side of the street as
participants.
8. Participants should work facing oncoming traffic whenever possible and work
one side of the street at a time. Do not enter the roadway or shoulder areas
at any time.
9. Avoid suspected toxic/hazardous substances, poison ivy, poison oak, noxious
weeds, areas where herbicides were recently applied, places where snakes, fire
ants or other insects may be located.
IN CASE OF EMERGENCY:
1. Every crew should possess an adequate first aid kit.
2. Know the route from the work site to the nearest emergency center or
hospital in case of serious injury.
3. Have transportation immediately available.
4. Every crew should possess a cell phone for emergency notification.
