I attach fully-executed duplicate-original of agreement
dated September 17, 1979, between the Seaboard Coast Line Railroad
Company and the City of Clearwater covering installation and main-
tenance of a l2-inch PVC sanitary sewer pipe line crossing beneath
the right-of-way and track, 4,276 feet south of Mile Post SY-874,
within the limits of Franklin Street at Clearwater, Florida.
The instrument has been drawn without fee or annual
rental.

5. It is expressly understood and agreed that Licenllee shall be prohibited. Incident to the installation and! or
maintenance of said pipe on Licensor's property, from using explosives of any type without the express written con.
sent of Licensor; In the event such consent is extended, a representative will be 88signed by Li~nsor to protect
Licensor'lI Interests and Licensee, in addition to all other costs to be borne by Licensee .. herein set forth. shall
reimburse Licensor for the entire cost and expense of furnishing said reprl'llentative.
6. In consideration for the right or lIceMe hereby granted, Licensee hereby agreee that the Licensor shojI not
at any time or in any manner be 88sessed with the cost or any part of the cost of the Installation and maintenance
of8aid pipe and appurtenances thereto on LicellBor's property.
7. The portion of said pipeline under said track and roadbed thereof shall be
encased by and at the expense of the Licensee in 24-inch steel pipe conduit
and placed at a minimum depth of 8 fee.t 4 inches below the base of rail of said
track, or not less than 36 inches below the bottom of Licensor's roadbed dit(~hes,
or not less than 8 feet 4 inches below ground surface - whichever depth may he thl'
lover - measurements being to the top of said conduit.
8(a). DUTing the installation of said pipeline the Licensee will, if It
is to perform the installation, or if the Licensee is to have a contractor 0erform
the installation, require said contractor to, at its sole cost and expense, procur.

Public Liability Insurance and Protective Public Liability Insurance, including
automobile coverage, providing for a limit of not less than $1,000,000.00 fnr all
damage arising out of bodily injuries to or death of one person, anll subject to

out of bodily injuries to or death of two or more persons in any one occuri~nce,
and regular Property Damage Liability Insurance, and Protl'ctive Property Dam;li?;e

less than $1,000,000.00 for all damage arising out of injury to, damage or destru(-
tion of property in anyone occurrence.
(b). The Licensee shall furnish certificates of insurance evidenl'ing the
abuve coverage and the form of the policy, the carrier and the amount of the
covc'rage shall be subject to the prior npproval of the Llcl.nsnr. Slll'h insl..ran,.:e
shall contain a contractual liability endorsement wldch will cover the obllg;ltll1ns
as,:umed under this agreement and such other endors('ml'nt or l'IH]orSPffi('nts ;lS, in till'
opinion of counsel for the Licensor, may be necessary or advisable to ful~v !,ru-
tel't and indemnify the Licensor. In addition, such insurance sha 11 contaIn not if i-
cation provisions whereby the insurance company agrees to give 10 days' notice tll
the Licensor of any change or cancellation of the policies. All of these endo~sl"
ments and notice provisions shall be stated on the cl'rtifiCilte of insurance which
is to be provided to the Licensor.

No. 79 - 97
A RESOLUTION AUTHORIZING THE CITY OF
CLEARWATER TO ENTER INTO AN AGREEMENT
WITH SEABOARD COAST LINE RAILROAp COMPANY
FOR INSTALLA TION OF A SEWER MAIN.
WHEREAS, the City of Clearwater has found it necessary to install
and maintain for the purpose of a sewer main, a line of 12-inch PVC pipe
at Franklin Street, Clearwater, Florida, at a point 4,276 feet southwardly
from Milepost SY-874; and
WHEREAS, the Railroad has prepared an agreement to that effect
for formal execution by its corporate officers, as well as the proper municipal
officials of the City of Clearwater; and
WHEREAS, the Railroad has requested a resolution be adopted by the
City, formally approving said agreement and authorizing the proper City
officials to execute same;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
That the Mayor, together with the other appropriate municipal officials
of the City of Clearwater, are hereby authorized and empowered to execute
a certain agreement with the Seaboard Coast Line Railroad Company, bearing
date of September 17, 1979, in ,connection with !he installation and maintenance
of a sewer main, a line of PVC pipe at Franklin Street, Clearwater, Florida,
at a point 4,276 feet Southwardly from Milepost SY -874.
