The facilities shall be constructed and maintained in accordance with all applicable laws, ordinances and lawful regulations and with the requirements of Railroad and in conformity with Railroad Form 2597 and drawing or drawin~s showing plan and eleva- tion in full detaIl, attached hereto as a part hereof, as well 808 the minimum requirements as set forth In the latest edition of the National Bureau of Standards' Hand-Book Outlining Safety Rules for the Installation and Maintenance of Electric Supply and Com- munications Lines. In the event of a conflict between the requirements hereof, they shall have precedence in the order mentioned. ~~~ne\~ns!1:tfl!\~~ tf:figR~a~_ P~d~~co"E'iith such instructions as an authorized representative of the Railroad shall consider necessary or advisable to safe~ard the Railroad's I?roperty or its operations and, except in case of emergency, after at least five days' notice in writing to the DiVISion Engineer of RaIlroad. 4. Should the privileges granted Licensee require any change or alteration in the location or manner of construction of wires, supports or appurtenances under the control of Railroad, or of any telephone or telegraph company maintaining telephone or tele- graph wires upon the property of Railroad, the cost of such change or alteration shall be paid by Licensee. 5. Licensee shall, as often as Railroad deems necessary, upon written demand from Railroad promptly repair, relocate or re- construct said facilities to conform to the above mentioned specifications or to meet new conditions brought about by construction upon, alteration, relocation or other uses of Railroad's tracks and property. b5~OJ7-CO(q) .-JC c,t'l-9 . Licensee shall, in addition to any other requirements of this agreement, construct, reconstruct, alter, relocate or rearrange its facilities as often as may be demanded by Railroad to prevent"deterioration of or interference with the signal or communication systems, facilities, appliances or apparatus of Railroad or any teh;phone or telegraph company that may now have or hereafter be granted the privilege of placing and maintaining wires, poles, supports, conduits or other facilities or appurtenances on property of Railroad, and to permit the safe, efficient and convenient use of property or equipment of.Railroad or any such telephone or telegraph company. 7. Railroad may at any time do any work which it may require of Licensee hereunder with or without demand, and, upon bills rendered, Licensee will pay Railroad the entire cost of such work. 8. Licensee assumes liability for. and will indemnify Railroad and lessors or lessees of Railroad against loss of or damage to property of Railroad: its lessors or lessees, Licensee or others, injuries to or death of persons, including officers, agents, servants and employees of RaIlroad, its lessors or lessees, or Licensee, caused by the sagging, clustering or breaking of wires, the falling or giving way of poles or other supports or howsoever resulting by reason of or in connection with the construction, presence, maintenance, use or removal of any of the facilities of Licensee, or which may arise in any manner from the sole or concurring act, default or negli- gence of Licensee, its officers, servants, agents or employees, in the exercise of the privileges herein granted. 9. Railroad does not warrant title to or the quiet enjoyment of any property whatsoever, and shall not be under obligation to acquire additional right of way for Licensee. This license is made expressly subject to the prior rights of others in or to the property of Railroad affected by the facilities. 10. This agreement shall terminate upon abandonment of or removal of Licensee's facilities from property of Railroad, or either party may terminate the same by ~ days' notice in writing to the other. Upon termination in any manner, Licensee shall, at its expensel remove its facilities f. rom property of Railroad. In the event of L.icensee's failure to remove its facilities promptly, as herein requirea, Railroadmay remove the same and Licensee will reimburse Railroad for the cost thereof upon receipt of Railroad's bills. , 11. This a~reement shall not be assigned or transferred without the written consent of Railroad; provided, however, that, ex- cept as thus limIted and subject to the rights of termination as hereinabove provided, all the terms and conditions hereof shall inure to the benefit of and be binding upon the respective legal representatives, heirs, successors and assigns of the parties hereto. I I '~." .,. SEAOOARD AIR LINE RAILROAD COMPANY SPECIFICATIONS FOR UNDERGROUND COMMUNICATION AND roWER CABLES CROSSING UNDER TRACKS AND RIGHT OF WAY 1. PURPOSE OF SPECIFICATION (a) The purpose of this specification is to govern the location and installation of underground electrical cables, crossing the tracks and right of way of the Railroad so that these cable crossings will not interfere with present or future operations and construction of the Railroad. (b) The Railroad's signal and communication underground cable will be placed in the subgrade or shoulder of the roadbed at a maximum average depth of thirty (30) inches below the ground line of the subgrade or shoulder and at a horizontal distance of from twelve (12) to eighteen (18) inches outside the ballast line~ This cable is installed with a cable plowing work train and cable crossings not installed to conform to these specifications will be liable to damage. 2. GENERAL WCA'l'I,QN OF Ut{DERGROUND_CHOSSING (a) The cable or duct system of proposed underground crossings shall be laid as straight and direct as possible between the points where the underground line enters and leaves the property of the Railroad. (b) Manholes, pull boxes and terminals in the underground crossing should be located off the Railroad's right of way where practicable to do so. 3. CONSTRUCTION OF UNDERGROUND CROSSING (a) The top of all duct and cable system structures of underground cable crossings shall be located at a depth of not less than forty-two (42) inches below the ground line of the shoulder or sub grade of the roadbed, except as specified in Paragraph (0) below. (b) Underground crossings of communication cable and power supply cables with maximum voltage of 750 volts may be installed by' pushing a galvanized iron pipe under the track at depth as specified above, and to serve as a conduit, provided such pipe extends at least eight (8) feet beyond the outside rail on each end of the crossing and the cable is buried at least three (3) feet below the ground line at all other points on the Railroad's property. (c) Underground crossings of power supply cable operating at a potential above 750 volts shall be installed at a depth of not less than ;four (4) feet below the ground line of the subgrade 01' shoulder of the roadbed where the cable crosses u.hderthetrl!l.ck~ ...this .deptfi-to ....beuriia:J.:iitained . a.t. At all other points on the Railroad's property the cable shall be located at least three (3) feet below the ground line.
