fonnance by Licensee of his undertakings herein contained, grants Licensee, subject to the terms and conditions hereinafter lIet
out, the right and Ucense to lay, maintain and operatelUlderlhe '-f1WJ,;.S and. property of Railroad the following described line or
lines of pipe, hereinafter referrea 10 as "Une of pipll":
A line of 4.500..inch (O.D.) steel carrier pipe within an 8.625-inch (O.D.)
steel casing pipe, for the conveyance of natural gas, in or near Clearwater,
pine11as County, Florida, crossing under the property and tracks of the Rail-
road 3,200 feet, more or less, southwardly from its Mile Post 875, in accordance
with Licensee's application and copy of its unnumbered and undated drawing
attached hereto as a part hereof.
2. Railroad grants Licensee a subsurlaee license only laereunder subject to any rights heretofore granted to others. Rail-
road reserves the riglat at any lime to make such use of Its property as it may desire or to grant the use thereof to others, and
should any such use make it necessary to disturb said line of pipe, Licensee will, at his cost, upon nolice in writing 80 to do,
relocate Qr provide for the protection of the said line of pipe.
3. The installation of the said Une of p'ipe, its qualil)', its location and itll depth on and under the property of Railroad
shall be subject 10 the approval of the ChierEngineer of Railroad who may accept or retect the same and tiis Judgment shall be
linalin respect to all mailers and things in connection therewith. Where said Une of p pe paslles under any track or tracks it
shall be located at a depth of not less than .5 feet 6 inches from the top of the tie to the top
of the casing pipe.
All work. done by the Licensee within the limits of the right of way of Railroad shall be performed in accordance with such
instructions as the Chief Enflineer of Railroad, or his autlaorized representative, shall consider necessary or advisable to safe-
guard the Railroad's property or itll operatious, after at least live days' nolice in wriling to the Division Engineer of Railroad.
4. Licensee will, at his sole expense, provide for the Iwolectlon of and make any and all repairs to the tracks and other
property of Railroad necessitated by the installation, ,naintenance, operation, use or removal 01 said line of ~Ipe, and will re-
Imliurse Railroad for any expense which it may incur a8,a re8uh thereof, includinl any expense which Railroad may incur in the
supervision of any such work whioh may be performed by the Lieenltee,
5, The passage of engines or trains shall not be hindered or delay.,d, nor shall the drainage ofllallroad's property be

12. Unless sooner terminated as and in the manner herein provided, this
agreement shall continue in effect so long as Railroad shall continue to
operate the Railroad now of Tampa & Gulf Coast Railroad Company at Clearwater,
Florida, and shall terminate upon cessation of such operation by Railroad.
