SUBJECT: Certification of Final Site Plan for Ultimar Phase II (A Residential Condominium Project) located
at 1520 Gulf Boulevard (PSP 89-12)

The Development Review Committee at it's meeting of September 27,1990 approved the above described Final
Site Plan subject to the following conditions:
1) Siamese connection location shall be shown on the site plan, as required by the Fire
Marshal, prior to certification.
2) Subject to the first three conditions (as modified for blanket easements and final building
permit time change) on the handout by Utilities as follows:
a. A Pinellas County Utilities Permit and Public Health Unit Permit, Ingress/Egress and a ten
foot (10 ft.) Utilities Easement over proposed water mains, up to and including meters, backflow
prevention devices and hydrants are required prior to the issuance of a fmal building permit.
b. Backflow prevention devices must be installed by the City with applicable fees being paid by
the owner.
c. Prior to Site Plan Certification, the Dumpster Requirement Data Form must be completed and
returned to the City Sanitation Division.
3) The language regarding the reverter clause in the two pedestrian easements shall be revised as
required by Public Works, Parks & Recreation and the City Attorney.
4) If interior landscaping is required in accordance with the court settlement, it shall be shown on
the site plan, as currently required by City Code, prior to certification.
5) A copy of the Beach renourishment plan and Army Corps of Engineer permit shall be submitted
to Environmental Management.
6) Open space recreational fees shall be paid for Phase 2 prior to certification.
7) Subject to Planning and Development conditions as modified (with condition #2 specifying, except
for the retention ponds and driveway entrance) in Phase 3, as follows:
a. In accordance with the Court Settlement for this parcel, the site plan shall be revised as
follows:
a) The multi-level building envelope shall have maximum dimensions of 140 ft. X 240 ft. X 210
ft. in height (for building in Phase 2)
b) There shall be a maximum of 360 residential dwelling units total for all phases of
development on the site (with an additional 40 dwelling units permitted if transferred
from Parcel IV, south side of Sand Key Sheraton; if the 40 units have been transferred, a copy
of the document shall be submitted to the City prior to the fmal phase of the development).
b. In approving the site plan for the first two phases of this development, the Development
Review Committee is not approving the third phase, except for the retention ponds and
driveway entrance, as it is being presented in a conceptual form at this time.
c. The project shall be completed by the year 2006 as per the court settlement.
8. "No Tree Verification" form shall be submitted to Environmental Management.
As conditions #1,4,6,7,and 8 have been met, please certify the attached plans/plats subject to conditions #2,3,
and 5 listed above and distribute.
