BE IT ORDAIM BY THE CITY CCNISSION OF THE CITY OF CLEARWATER, FLORIDAS
SECTION I. This Ordinance shall be known and cited as "The Zoning Ordinance" of
the City of Clearwater, Florida.
SECTION IT-A. DEFINITIONSs
For the purpose of this Ordinance, certain terms and words are hereby
defined as follows:
Words used in the present tease include the future; words in the singular
number include the plural, and words in the plural number include the singular;
the word "building" includes the word "structure"; the word "other" shall not be
limaited to things of similar character; the word "lot" includes the word "plot";
the words. "use" and "occupy" include the words "designed or intended to be
occupied"; and word "ahall" is mandatory and not directory.
Access= Buildings A subordinate building or portion of main building,
the use of which is incidental to that of the main building.
Accesea Uses: Uses customarily incident to the principal use of a
building or plot as permitted or restricted by the principal use.
L*Z: A way designated to public use other than a street or place.
Apartment Houser A building which is used or intended to be used as a
home or residence for more than two families living in separate apartments*
Boarding Houses A building, other than a hotel, where lodging and meals
for one or more persons arc provided, prepared and served for compensation.
Buildin : A structure having a goof supported by columns or wallo,
Commercial Advertising Simon: Any structure, display board, billboard,
poster board, bulletin board, screen, surface or wall, with characters, l+ettere
or illustrations placed thereto, thereon or thereunder, by any method or means
wihatsoever, where the matter displayed would be used for any purpose other than
that of advertising to the public the legal or exact firm name or the name of the
business carried on therein or thereat, or for advertising any service or product
or products actually and actively being offered for sale therein or thereon, and
shall not include street or directional signs, owner identification signs and point
of purchase signs as defined herein or real estate signs as defined heroin.

Front of Lot: The front of any lot shall be the side of said lot designated
as the front, by the plat of the subdivision in which said lot lies, or in'the
absence of positive designation by said plat, the front of any lot shall be the
narrowest side which faces a street, unless by customary use and occupation in the
area in which paid lot is located, a side other than the narrowest aide facing a
street is clearly indicated to be the front of said lot.
Garage &artment: An accessory building with storage capacity for not
more than four self-propelled vehicles and "trailers" attachable thereto, the
second floor or other portion of the building being designed as a residence for
not more than one family.
Garage, Private: A building used for the storage of self-propelled
vehicles and"trailer-" attachable thereto, in which building no business service
or industry connected directly or indirectly with motor vehicles is carried on.
Garage, Pub3ic: Any premises.except thoas described as a private garage,
used for the storage or care of self'-propelled vehicles and "trailers" attachable
thereto, or 'where any such vehicles are equipped for operation, repaired or kept
for remuneration, hire or sale,
Garage, Storage: Any premises except thoae described as a private or
public garage used exclusively for the storage of self-propelled vehicles and
"trailers'? attachable thereto,

Hotel: A building ordinarily occupied as the temporary abode of ;individuals
who are lodged with or without meals, and in which there are more than ten sleeping
rooms, usually occupied singly, and no provision is made for cooling in any indivi-
dual rooms or apartment.
Lodging House: A building other than a hotel, motel, apartment house, or
duplex where lodging without meals for one or more persona is provided for compensation,
Lot: A parcel of land occupied or to be occupied by a building and its
accessory buildings, together with such open spaces as are required under this
Ordinance, and having its principal frontage upon a street or officially approved
place.
Motel: A building ordinarily occupied as the temporary abode of individuals
or families who are lodged with or without meals and in whioh there are more than
two separate sleeping roans or apartments, which building is not more than two
stories in height, and which building may or may not make provisions for cooking
in any individual groom or apartment.
Non-conforming Use: A building or land occupied by a use that does not
conform with the regulations of the use district in which it is situated.
Owner Identification Sift: Any structure, dervice, display board, screen
surface or wall with characters, letters or illustrations placed thereto, thereon
or thereunder, by any method or means whatsoever, where the matter displayed is
used only to indicate to the public the legal or exact firm name or the character
of the business carried on therein.
Place: An open unoccupied space not leas than thirty (30) feet wide, per-
manently reserved for purposes of access to abutting property.
Point of Purchase Sign: Any structure, device, display board, screen,
surfaco or wall, with characters, letters or illustrations placed thereto, thereon,
or thereunder, by any method or means, whatsoever, where the matter displayed is
used for advertising a product actually or actively offered for sale thereon or

thereunder, by any method or means whatsoever, where the matter displayed thereon
shall be used solely for the purpose of offering for sale, for lease, or for rest
the exact property on which sign is placed.

it, then the space between such floor and the ceiling text above it.
Storyl-half r A Story under a gable, hip or gambrel roof, the wall plates
of which on at least two opposite exterior walla are not more than two (2) feet
above the floor of such story.
Street: A permanent right-of-way or thoroughfare not less than thirty
(30) feet wide,
Street or Directional_Signt Any sign having the purpose of giving
instructions as to the location of a place, event or meeting within said City
or the direction thereof from the sign locations
. Structure: Anything constructed or erected, the use of which ordinarily
requires permanent location on the ground or attached to something having a
permanent location on the ground.
Yard: An open space on the same lot with a building, unoccupied and
unobstructed from the ground upward, except as otherwise providibd in this Ordinance.
Yard,_ The minimum horizontal distance between the street line
and the front line of the building or say projection thereof excluding steps and
uneunclosed porches.
Yard, Rear: A yard, unoccupied except by an accessory building as herein-
after permitted, extending across the full width of the lot between the rear line
of the building and the rear lot line,
YSide: A yard, between the building and the aide line of the lot
and extending from the street line to the rear yard.
SECTION IL-B. DEFINITIONS, CONTINUEW
Notice: i+hiere notice is required by this Ordinance to be given, it may
be given actually or by deposit of written notice in the mail to the last known
address of the person required to be notified, or by advertising in any daily
newspaper regularly published in the City of Clearwater for two (2) consecutive
publication days.
Perron: Shall include corporate and other legal entitios, thoir officers,
reprer.entatives and agents*
SECTION III, USE DISTRICTS.
For the Ima-pose of classifying, regulating, and restricting the location
of trades, industries, and other uses, and the location of buildings erected or
structurally altered for specified ueus, the City of Clearwater is hereby divided
into districts, of which there shall be eight, known ast

WHICH SAID DISTRICTS, together with their boundaries, are shown in full
upon a certain map marked, "The Zoning Map of the City of Clearwater, Florirda,
of 1952," signed by the City Auditor and Clerk and the City Manager and counter-
signed by the Mayor-Cax?missionnr of said City, and consisting of an index sheet
and bearing the date of December 5, 1932, saidiuap aforesaid accompanies and is
hereby adopted as the official Zoning Map of the City of Clearwater, Florida,
and by reference thereto is hereby made a part of this Ordinance.
No premise or building shall be used or occupied, neither shall my
building be erected, altered, or extended for use or occupancy for any other use
' or purpose than that permitted in the district in which such building or promise
is located.
SECTION IV. USE RMILATIONS "R•1" RESIDENCE DISTRICTr
In the "&-1" Residence Districts no premises or building shall be used
or occupied and no building shall be hereafter erected or structurally altered,
unless otherwise provided in this Ordinance, except for one or more of the
following uses:
(1) One family dwellings
(2) Accessory buildings, including one private garage
when located not less than sixty (60) feet from the front
' lot line, nor less than twenty?fivo (25) Sect from any
other street line, or a private garage constructed as a
part of the main building.
3ECTIOH V. USE RMULATIGNS, "2;.,2" DUPLEK RESIDENCE DISTRICT%
In the 111y2" Duplex Residence Districts no premises or building shall, be
used or occupied.and no building shall be hereafter erected or structurally altered
unless otherwise provided in this Ordinance, except for one or more of the follow
ing usest

(1) Any use permitted in an "R-l" Residence District.
(2) Two family dwellings, commonly called a "duplex".
SECTION V--A. USE REGULATIONS, "R.+" MULTIPLE DWELLING DISTMCT:
In the "B,--4" Multiple Duelling' Districts no premises or building shall be
used or occupied and no building ohall be hereafter erected or structurally altered,
unless otherwise provided in this Ordinance,, except for one or more of the follow-
ing urea:
,P (1) Any use penittsd in an "R•wl" Residenco District.
(2) Two family dwellings, commonly called a "duplex".
is ' . -5 (3) Churches, schools, (elementary and high), hospitals, except
' hospitals or homes caring for mentally deranged persons or nervous

is a service custo:aarily carried on as a business, libraries,
museums, institutions, of an educational or philanthropic nature.
(k) Multiple dwellings, apartment houses, boarding houses, lodging

(5) Parks, playgrounds, and areas used for community purposes.

lodging house or boarding house, and provided further that no

(9) Accessory buildings and uses necessary to and customarily

incidental to any of the uses permitted in R-4 and R-M zones when
located on the same lot and not involving the conduct of a
business other than customarily carried on in connection with
uses permitted in R.,4 and R-H zones, including private and
storage garage when located not less than 40 feet from the front
lot line nor less than 2+0 feet from any other street line or 5
feet from any and all lot lines, or a private garage constructed
as a part of the main building; provided, however, that n=-
commercial (not operated as a business within itself for profit)
public parking lots or spaces on vacant lots or portions thereof
for parking passenger motor vehicles ahall be permitted in R-4
and &-H zones; provided, further, that lots in all use districts
shall be capable of use for parking lots only according to this
sub--aoction, when said lot or lots are directly abutting and
owned by the same owner as a lot or lots located in Rn4, R-K,
B, H# UZ and P.use districts.
SECTION V-B. USE REGULATIONS R.'td MULTIPLE I7dUlING0 HOTEL, APARTMENT HOUSE,
AND LIMITED BUSINESS DISTRICT.
No premises or buildings shall be used or occupied and no buildings shall
be hereafter erected or structurally altered,, unless otherwise provided in this
Ordinance, except for one or more of the following uses:
1. Any use permitted in Rrl District.
2. Any use permitted in R..2 and R-4 District.
3. Combination hotel and business buildings; combination
apartment and business buildings subject to the following
Limitations: In any hotel, or apartment building containing
16 or more hotel unite (gueat rooms) business usages shall
be permitted within said building under the main roof thereof
to the extent of four business spaces for the first 16 such
units and one additional•buaineas space for each additional
8 units above the number of 16; provided further that no
street or exterior advertising or display signs for said
business spaces in excess of two (2) square feet in area shall
be permitted.
l;.. The provisions of SECTION V-A (9) of this Ordinance are
hereby included in this section by reference.
SECTION VI. USE REGULATIONS, "B" BUSINESS DISTRICT:
In the "B" Business Distract all premises and buildings except as other-
wias provided i.n.this Ordinance, may be used for any use permitted in either
"R-l" Residence District, "R-211 Duplex Residence District, 'OR-4+" Multiple Dwelling
District, "R-H" Multiple Dwelling and Limited Business District, or for any other
use not specifically prohibitod by Federal or State Laws or by Ordinances of the
City of Clearwater, Florida, except the following, to-wit:
(1) A33, types of occupancies from which are emitted smokes,
fumes, gases or odors detrimental to the comfort, enjoyment
and health of surrounding persons or occupants.
(2) Nsw or used automobile parts sales from vacant lots.
(3) Creosote treatment or manufacture.
(4) Distillation of bones, coal or mood.
(5} Fertilizer Manufacture.
(6) Fish housess wholesale, also fish smoking, curing or
processing plants.
(7) Gasoline filling or service stations, except. where special
permit has been procured from City Coaamissione

(B) Lumber yard and mill work.
(9) Automobile trailer camps, except whore special permit
has been procured from the City Commission, following a
recamendation by the Zoning Board.
(10) Carnivals, tent shows, exhibits and other temporary amuse-
ment projects, except where special permit has been procured frwa
the City Commission.
SECTION VII. USE RMULATIONS, "M" MANUFACTURING DISTRICTt
In the "H" Manufacturing District all premises and buildings, except as
otherwiae provided in this Ordinance, may be usod for any use permitted in "Rrl"
Residence Di.etriot, "R-2" Duplex Residence District, "R-411 Multiple Dwelling
District, "R-H" Multiple Dwelling and Limited Business District, "B" Business
Di+atriot, or for factories., lumber yards, fortiliaer plants, and other industries
that ma,}r lawfully be carried on within the City Limits of Clearwater, provided
they do not omit smokes,, fumes, gases or odors detrimental to the health of
surrounding persons or occupants, and are not specifically prohibited by any
other City Ordinance.
SECTION MITI. USE REGULATIONS, "UZ" UNZONED DISTRICTSt
In the "UZ" Districts all premises and buildings may be used for any
use permitted in."R.,1" Residence District, "R+,2" Duplex Residence District,
"Ro4+" Multiple Dwelling District, "R?HP' Multiple Dwelling District and Limited
Business District, "B" Business District, and for any and all other lawful uses'
which may be approved.by the City Commission of the City of Clearwater, Florida.
SECTION IX. USE REGULATIONS "P" PUBLIC DI;TRICTt
In the "P" Public District all promises and buildings shall be used wD-
clusively for the follouing•purposes, to-uits
(1) Public streets, places, alloys,, public highways. public
parks, public buildings, public recreation grounds, public avia-
tion fields, golf courses, baseball ffelde, other athletic fields..
bathing beaches, amueement rks, recreational centeri, railways
(other than street railways), places of scenic beauty calculated
to attract visitors and tourists.
SECTION X, NONCONFORMING USE:
The lawful use of land existing at the time of the passage of this
Ordinance, although such use does not conform to the provisions hereof, may be
continued, but if such nonconforming use is discontinued for a period of six (6)
months, then any further use of said premises shall be in conformity with the
provisions of this Ordinance.
The lawiNd use of a building elating at the time of the passage of this
Ordinance, or one for the construction of which a building permit has been issued
not more than sixty (60) days prior to such passage, may be continued, although
such use does not conform with the provisions hereof, and such use may be am*.
tended throughout the building provided no structural alterations except those
required by law or ordinance are made therein. If no structural alterations are
made, a nonconforming use of a building may be changed to another nonconl;orming
use of the same or more restricted classification.
Any nonconforming building, damaged by fire, the elements or other Act
of God, to the extent of more than shy-five (65) per cent of its value shall
not be repaired or rebuilt, except in conformity with this Ordinanco. Should the
damage be less than sixty-five (65) per oartt of its value then repairs may be
made, provided they be made within six (6) months after such damage, and in
accordance with all other ordinances of the City of Clearwater.
SECTION XI. LOCATION, HEIGHT AND AM RDCUUTIONS:
(1) No building or other use shall extend beyond the building lines
shown on the legend of "The Zoning Map of the City of Clearwater, Florida, of
1952," and no part of any building or other use in R.•1 and R-2 use districts shall
extend or be constructed or be allowed closer than three (3) feet from any and all
lot lines, and no foundation lines wall or column of any building shall extend, be
constructed or be allowed closer than five (5) feet from any and all lot lines.

square feet shall hereafter be used for building; in an R.1 area, neither tshall

SECTION U1, GENMIAL PROVISIONSs
(1) No building or structure of any kind whatsoever shall be erected
within one thougand (IsOOO) feet of any exterior boundary line of the Municipal
Aviation Field to a height in axoaats of fifty (50) feet.
(2) In all residential districts, no garage, team or outbuilding shall
be erected or used for residential purposes or for any other purpose except
construction of the main building.
(3) That hereafter Snipe Signs emeept when, used as Real Estate Signe
as defined herein., Sidewalk or Sandwich signs shall not be permitted within
the City of Clearwater except when said signs are located upon private property
at the point of purchase.
(4) No person shall paint, paste, print or nail any banner, signs paper
sign or any advertisement or notice of any kind whatsoever or cause the same to
be done, on any curbstone, flagstone, pavement or on any other portion or part
of atdewalk or street or upon any tree, lamp-post, telephone or telegraph poles
hydrant or bridge within the limits of any street or public right-of-my within
the City of Clearwater; provided, however.. that this section shall not apply to
regular notices required by lax to be so pouted..
(5) That all signs located in comp•Lianco id.th this Ordinance shall first
be constructed or erected in compliance with the Official Building Code of the
City of Clearwater.
(b) No flashing or activated aigns shall. be permitted in R¦1., R -2p R-4.,

MOTION M-A. SIGNSt
(1) CQMMM ADVERTISING SIGNS:
(A) That hereafter no commercial advertising sign shall be per-
mitted in any residential district vrhich includes nRrl'} Residence
District., rrR-211 Duplex Residence District,# "R-4n Multiple Dwelling
Dietriots and non Xultiple Dwelling and Limited Businene Districts
as defined in the City Zoning Ordinance,
(B) That no caumercial advertising sign shall hereafter be con-
structed in a nB" Business District as defined in the City Zoning
Ordinance, until a special permit therefor has been obtained from
the City Comtnission of said City. Before grating the application
for such a permit the City Commission shall consider the recammenda-
tionss either favorable or unfavorable., of the City Zoning Boards
and the effect such a sign will have on the public health, morals
and safety in the particular location requested.

proof materials of such strength as to resist a pressure of
thirty (30) pounds per square inche
6. The advertising area of all commercial advertising sigma
shall, not be more than three hundred (300) square feat in area.
(2) PERMITS FOR STMT AND DIRECTI:CNAL SIGNS, OWNM IDENTIFICATION SIGNS,
AND POINT OF PURCHASE SIGNS.
That the City Building Inspactor,is hereby authorized to iaeue
permits for the erection of Street and Directional Signs, Owner Identification
Signs, and Point of Purchase Signs under and according to the following conditions;
Real Estate Signs may be erected without permit, according to the following speeifi-
cationse
(A) Street and Directional Signs shall not exceed four (4) square
feet in area; Real Estate Signs shall not exceeed six (6) square
feet in areaj.and no sign of any nature or kind whatsoever
shall exceed six (6) square feet in area when located in an
R"-1 or R-2 use district; all of the foregoing signs shaLl be
of a reasonable size and design with due regard to their pur-
pose, proposed location and the traffic and safety conditions
existing thereat; any of the foregoing signs having an area in
excess of the areas hereinbefore set out shall be olassified
as Commercial Advertising Signs and shall be subject to regu-
lation as such.
(B) A written application for each such permit shall, be filed with
the City Building Inspector indicating the size, type and de-
sign of the desired sign and its proposed location with parti-
cular regard to street and right-of-way lines.
(C) The City Building Inspector, with the approval of the City
Manager, may issue pornits for signs to be located upon public
property, where the applications therefor comply with the pro-
visions of this Ordinance.
(D) The City Building Inspector shall. charge and collect for the
use of the City, a reasonable permit fee for all signs, except
real, estate signs, baid fees to be in the amount which may bee
from time to time, established by the City Commission of the
City of Clearwater, Florida, by resolution.
(3) LOCATION OF SIGNS WITHIN OR UPON PUBLIC PROPERTY AND RIGHTSPOP-WAY
PROHIBITED: EXCEPTIONS:
(A) That except as provided berain, no sign shall bs located in
or upon uq "r, Public District, as defined in the City
Zoning ordinance,, or in any street or railroad right*of-wyr,
(B) That this Section shall not prevent any operating railroad
from placing traffic signs which are neeesaLu7 and proper in
the operation of said railroad.

(C) That this Ordinance shall not prohibit the erection of
reasonable amd necessary street and directional signs
by the City of Clearwater and State and Federal authorities.
(D) That this Ordinance shall not prohibit the location of sbrest
and directional signs when a permit therefor has been secured
as hereinafter provided,
SIGNS AT LOCATIONS WHERE BUILDING IS IN PRESS:
This Ordinance shall not prevent the erection of one sign on
property where building is actually in progress under a current
building permit. This sign may be large enough to include the
names of persons performing labor or supplying materials to the
premises, and such sign must be removed before the Certificate of
Occupancy shall be issued*
(5) RkMOYAL OF ILLEGAL AND DETFMIORATED STGNS:
Should any sign exist in the area where such signs are pro-
hibited by the provisions of this Ordinance after the effective
date hereof, or should any sign deteriorate so that it Ao longer
complies with this Ordinance, the City Building Inspector is
hereby authorised and directed to remove such sign from said
prohibited area.
SHCTION II?S. CERTIFICATE OF OCCUPANCYt
No vacant land shall be occupied or used, except for agricultural
uses, and no buildings hereafter erected or structurally altered shall be
occupied or used until, a certificate of occupancy shall have been issued by the
Building Inspector.
Certificate of OcaMRSM for a Buil : Certificate of Occupancy
for a new building or the alteration of an ead.sting building shall be applied
for coincident -with the application for a building permit and said certificate
shall be issued within three days after the request for same shall have been
made in writing to the Building Inspector after the erection or alteration of
such building or part thereof, shall have been completed in conformity with the
proTi.sions of these regulationse Pending the issuance of a regular certificate,
a temporary certificate of occupancy may be issued for a period not exceeding
six months during the completion of alterations or during partial occupancy of a
building pending its completion. Such temporary certificate shall not be con-
strued as in any way altering the respective rights, duties or obligations of
the owners or of the City relating to the use or occupancy of the premises or
any other matter covemd by this Ordinance, and such temporary certificate
shall, not be issued except under such restrictions and provisions as will ads-
q:tel~yr insure the safety of the occupants*
Certificate of Oaoupancy for Land: Certificate of occupancy for
the use of vacant Lund or the change in the character of the use of land as
herein provided, shall be applied for before any such land shall be occupied
or used and a certificate of occupancy shall be issued, within threw (3) days
after the applioation has been made provided such use is in conformity with the
provisions of these regulations,
Certificate of Occupancy shall state that the building or proposed
use of a building or land, complies wdth all the building and health laws and
ordinances and with the provisions of these regulations, A record of all
certificates shall be lcept on file in the office of the Building Inspector and
copies shall be famished, on request, to any persons having a proprietary or
tenancy interest in the building affected.
No permit for excavation for any building shall be issued before
application hao been made for certificate of occupancy.

All applications for building permits shall be accompanied by a
drawing or plat, in duplicate, showing the lot plan, the location of the building
on the lot, accurate dimensions of building and lot and such outer information as
may be necennary to provide for the enforcement of these regulations. A careful
irecord of the original copy of such applications and plats shall be kept in the
office of the Building Inspector and the duplicate copy shall be kept at the
building at all times during conotruction.
XV. ZONING AND PLANNING BOARD=
1. The Zoning, and Planning Board provided for in Chapter 15671
(No. 71) Acts of Florida, 1931, and any and all future acts, shall perform the
functions and exercise the authority specifically given them therein,
2. The Zoning and Planning Board shall at its first meeting after
its appointment select from its membership a Chairman who shall preside at all
meetings attionded by him; a Vice-Chairman who shall preside in the absence of
the Chaixman, and a Secretary who shall take the minutes and keep the records
of all meetings of the Board and of all actions of the Board.
39 The Board shall have full right and power to adopt rules and
regulations for its governance, fix its regular and special meeting times in
accordance with such rules. A majority of the membership of the Board attending
any regular meeting or special meeting shall constitute a quorum.
SECTION XVI. A.WIINZSTRATION:
It shall be the duty of the City Building inspector to administer
and enforce the provisions of this Ordinance, the same to be done in conjunction,
with the building code of the City of Clearwater. In case of a conflict be-
tween any of the provisions of this Ordinance and those of the building code,
in a given instance, the more restrictive of the two shall govern.
Persons, firms, or corporations desiring to appeal anY ruling of the
Building Inspector shall so notify the City Manager of the City of Clearwater
in writing within twenty (20) days after such ruling has been made.
SECTION XVII. BOARD OF ADJUSTKENT AND APPEAL:
The City Commission of the City of Clearwater shall, from and after
the passage of this Ordinance, be and it is hereby declared a Board of Adjust.
meat and Appeal so that where there are practical difficulties or unnecenaary
hardships in the way of carrying out the strict letter of the provisions of
this Ordinance, the Board of Adjustment and Appeal, steell have power In specific
cases, after due notice, and investigation, to determine and vary any such
provisions in harmony with the general purpose and intent of the Zoning
Ordinanco so that the public health, safety and general welfare may be secure
and substantial justice done.
Such Board shall hear appeals from the action of the BuIldi,ng
Inspector and determine the rights of the applicant. Appeal to the Board of
Adjustment and Appeal may be taken by any person, firm or corporation
aggrieved, provided notice thereof, together idth grounds thereof, are filed
in triplicate, in writing with the City Manager of the City of Clearwater
within twenty (20) days after such action of the Building Inspector. The City
Manager shall forthwith transmit one copy thereof to the City Building Inspector
and one copy to the said Board.
The said Board shall after due notice and within thirty (30) days
after the filing of said complaint, hold a public hearing thereon and promptly
render its decision.
SECTION 1XVIII. INTWHETATION, PURPOSE n M CONMOTt
In interpreting and applying the provisions of this Ordinance, they
shall be held to the minimum requirements for the promotion of health, safety,
morals, and general welfare of the community.

SECTION XX. VALIDITY: r1
Should any section, paragraph, sentenee, phrases, clause or other part or
provision of this ordinance be declared by the Court to be invalid, the same shall
,not affect the validity of the Ordinance as a whole, or any part thereof, other ?
than the parr declared to be invalid.
SECTION MCI. PENALTY:
Any person, or persons, firm or corporation or association of persons,
who shall violate or fail to comply with any of the terns or provisions of this '
ordinance shall, upon conviction in the t'iunicipal Court, be tined not exceeding
the sun of Two Hundred ($200.00) Dollars, or imprisoned in the City Jail for not
exceeding sixty (60) days, or by both such fine and imprisonment in the discretion
of the Municipal Judge. Each day that a violation is permitted to exist shall
constitute a deparate offense.
SECTION X7CII. EFFECTIVE DATE: ,.'• ,•
This Ordinance shall take effect from and after its passage and its
approval by a majority of the qualified electors of the City of Clearwater who are
freeholders within said City voting at a regular or special Municipal Election
called and hold in such manner as the City Commission may determine for the purpose 'V'
of determining whether or not such Zoning Ordinance shall, go into effect.
