Section 1. There is hereby created a Board of Examiners of general eontraetor3 #}

and subcontractors, consisting of five ( 5) =embers who have been residents of the

Section 2. The members of the Board shall be appointed for four (4) years,

Three (3) members shall constitute a quorum.
Section 9. Each member shall hold over after the expiration of his term until

Section 12. He shall receive all moneys derived,from the operation hereof,
excepting however, the collection of occupational license fees as provided for
in Section 29,and deposit same with the City Clerk.
Section 13. The books and registers of this Board shall be prima facie
evidence of all matters recorded therein.
Section 14. The Searetary-Treasurer shall prepare a roster of all licensed
contractors after the March and September meetings, and after any special
meeting and file same with the City Clerk. A copy shall be kept in the
Building Department, accessible to the public at all times. It shall be the
duty of the Secretary-Treasurer to promptly notify, these officers in the event
of a revocation or the re-issuing of a license.
Section 15. Every person, firm, co-partnership, corporation, association
or other organization, of any combination of any thereof, who is engaged in the
business of accepting orders or contracts on cost plus, fixed fee, stated sum,
percentage, or any combination thereof, or other compensation other than wages,
doing work on or in any building or structure requiring the use of stone, brick,
mortar, cement, wood, structural steel or iron, sheet iron, metallic piping,
tin, lead or any other building material; orto excavate for foundation or any other
purpose; or to construct docks, drive piling, construct bridge, construct
seawalls, and bulkheads of anst and all descriptions; or who is engaged in the
business of building, remodeling, repairing, whether it be by day labor, contract,
cost plus, fixed fee, stated sum percentage, or any combination thereof, or
other compensation other than wages, shall be deemed to be a contractor within
the meaning thereof.
Section 16. The Board shall have the power, in addition to all other
powers provided for herein, to revoke the license of any oontraotor licensed
hereunder who shall be guilty of any one or more of the following acts or
os:missions, to-wit:
(a) Fraud or deceit in obtaining license.
(b) He61i$enee, ineompatemay or misconduct in the practice of eontrecting
within the moaning of this Code.
(o) Abandoment of any contract without legal excuse.
(d) Diversion of property or funds received under express agreement, for
prosecution or completion of a specific contract hereunder, or for a specified
purpose in the prosecution or completion of any contract, obligation or purpose,
with intent to defraud or deceive creditors or the owners.
(a) Fraudulent departure from, or disregard of plane or specification in
any material. respect, without consent of the owner or his duly authorized
representative; for the doing of any willful, fraudulent act by the license an a
Contractor, in consequence of which another is substantially injured.
(f) '.Ulful and deliberate disregard and violation of the Building Code of
the City of Clearwater, and/or of the State Hotel Commission.
Section 17. Any person directly interested, the Building, Plumbing or
Electrical Inspectors of the City of Clearwater, the Architect of Engineer who
is responsible for the plans under which the contractor is working, may prefer
charges against a licensee hereunder.
(a) Such charges must be made in writing and sworn to by the Complainant and
submitted to the Board. It shall then be the duty of the Board, at the earliest
possible date and not later than thirty (30) days thereafter, to investigate the
charges and render their decision without delay.
(b) A copy of these charges, together with the time and place of hearing,
shall be legally served on the accused at least five (5) days before the date fixed
for the hearing. At the hearing the accused shell have the riot to appear
personally and by consel and cross-examine witnesses against him, her or them,
and to produce witnesses and evidence in his, her or their defense.
(a) If after tke hearing, the Board's decision be that the licensee has
been guilty of the charges preferred against him, her or them, the Board shall
suspend or cancel. the contractor's license.
(d) The Board may re-issue a license to any contractor whose license has
been revoked, provided three (3) or more members of the Board vote in favor of suoh
re-iesuance, for reasons the Board may deem sufficient.
(e) rrompt notice shall be given the City Manager and the City Clerk or the
City of Clearwater, in the case of revocation or re-issuinE or the license.
Section 18. Any person "ho may feel aggrieved by reason of any decision,
action;, order or judgement of the Board of'xaminers may appeal to the City
Commission of the City of Clearwater, Florida, as such appeals stall be in writing
and must be taken within tan (10) days after the making or entry of the decision,
action, order or judgement complained of and filed with the City Auditor and Clerk.
Such appeals shall set forth the grounds of the appeal and must be signed by such
aggreeved person or his duly authorized a6ent.

3eotibn 19. The provisions hereof shall not apply:
(a) To an authorized representative or representatives of the
United Stator of America, or the State of Florida, or the County of Pinellas,
or municipality doing work or construction in their official capacity.
(b) Insofar as to examination only for license to erect, remodol and
repair buildings, as defined by the Building Code of the City of Clearwater,
to any person, firm, oo-partnership, corporation, association or other
organization or any combination thereat, having a license to enCaga in the
business and/or practice of contraetfng within the meaning hereof, in the
City of Clearwater, provided such license is renewed as set forth in Section 21.
(a) Owners or their duly authorized agents or lessees building structures
or making repairs thereon, in compliance with Sections 12, Ordinance tic. 351.
Section 20. Every one desiring to be licensed as a General Contractor,
or Sub-Contractor in the City of Clearwater ehell make application to the
Board or Examiners by filling in the printed forme which may be obtained
from the Building Inapeator's office, and depositing with such application
the Bum of Five Dollars ($5.00), for an examination fee.
Section 21. Any person taking the examination for a firm, co-partnership,
corporation, association, or other organization, or any combination of any
thereof, must be an active member of or a legally authorized agent thereof and
he or she connot qualify to take the examination for himself, herself or for.
any firm, corporation, eo»nartnership, association or other orGarizatior_ or
any combination thernaf, xhile this license remains unex.pired or uneancelled.
Section 22. If the person pasoing the examination shell at any time
sever his or her connection for any reason, with the Contractor to whom license
was issued on his or her examination, it shal.1 be the duty ot` both him or her
and the Contractor to whom license was issued to E,ive written notice
immediately to the Board of Examiners and at the same time surrender the
license for cancellation.
Section 23. The Contractor to whom license was issued may, at the time of
surrenderin6 license, delegate some other active member or le6elly authorized
agent to qualify for uxamination for them without the payment of any additional
examination fee or occupational license fee for the remainder of the fisct~l year.
Section 24. After complying with the provisions rBtardin?_ applicants set
forth in Section 200 the applicant shall be entitled to exanifytion to determine
his or her qualification.
Section 25. If the result of the examination is satisfactory, the Board shall
!sane a certificate to the City w'ane6er of the City of Clearwater who shall then
issue a license to the applicant upon the payment of such occupational license
See as is hereinafter stipulated in Section 29.
Section 26. Any person failing to pass the examination may be re-azamined
at the next regular meeting of the Board, or at such special meeting nulled for
the-purpose of giving examinations, without additional exwnination fee.
Section 27. Every person, firm, ed-partnership, corporation, association
or other organization or any combination of any thereof, en&aLad in or who shall
engage in the business and or crpacity of oontraator, shell procure and maintain,
at all times, while so engnged, City licenses therefor no is provided heroin.
Section 28. The issuance of a license under this Title shall be evidence
that the person, firm, corporation, co-partnership, aseooirstion or other
organization, or any combination of any thereof, are entitled to all the rights
and privilecaB of a contractor in division for which the license is issued,
and while the license remains revoked or unexpired.
Section 29. Upon the presentation of a certificate from the Board of
Examinern, the City, Manager of the City of C1earFvater shall furnish the
Contractor with a City license upon the payment of the occupational license
fee fnr the class or classes in which said Contractor is classified; the
fixed fee of license shall be as follows, to-wit:
General Contractor ....................$25.00
Sub-Contractor ........................$15.00
and no person, partnership, firm or corporation shall enCoa,e in the business of
oontracting.without first procuring from the City blane6er of the City of
Clearwater a certificate evidencing the payment of the occupational fees
prescribed in this Section.
Section 30. A. copy to replace any license certificate lost, destroyed or
mutilated, may be issued by the Board.
Section 31. Licenses,may be transfered, subject to the examination
provisions of Sub-seotion 21, of this Section when there is a bona fide sale
and transfer of the property used and employed in the business as stock in
trade, provided such transfer shall be made within ten (10) days after said
sale has taken place.

Section 32. Change of name under which a license has boon issued must
have the approval of the Board of Examiners.
Section 33. The filing of a petition in voluntary bankruptcy by any-
Contractor holding license under the terms of this Code shall automatically
revoke such license pending a decision of the Board an provided in Seotion 16
hereof.
Section 34. All: licenses issued under the provisions hereo. shall expire
on the 30th day of September of each year following-their isauanoe. Any
license may renew hie or her license certificate within thirty .(30) days,from•'
the'date of expiration without examination by paying the psracribed amount due
for occupational license tax as pereeribed in Section 29 hereof.
Section 35. Any person or persons, and the members of any firm, co-
partnership, corporation, aasioistion or other organization, or any
combination thereof, presenting or attempting to file or use the license of
another or who shall give false or forged evidence or any kind to the Board,
or to any member thereof, in obtaining or maintaining a license, or who shall
falsely impersonate another or who shall use an expired or revoked license,
shall upon conviction be punished by a fine not exceeding Three Hundred
Dollars (t300.00) or by imprisionment for a period not exceeding sixty (60)
days, or by both-such fine and imprisonment, in the discretion of the
Court, for each offense.
Section 36. All ordinances and parts of ordinances in conflict herewith
be and the same are hereby repealed.
Section 37. This ordinance is hereby designated to be an emargency
measure, and shall take effect immediately upon its passage and adoptint; by
the City Commission of the City of Clearwater, Florida.
