Station 1. That all provisions of Ordnance No. 50P - of the City
of Clearwater which levy or attmept to levy a taxon the gala or fuel all be and

BE IT ORDA32M BY THE CITY COIMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. 1here is hereby levied by the City of Clearwater on each
and every sale in said city of fuel oil a tax of one per cent per gallon, which
anx shall in every case be paid by the purchaser for the use of said oity, to the
seller of said fuel oil at the time of paying the charge therefor.
Section 2. It shall be the duty of every seller of fuel oil to colr
loot from the purchased for the use of the city the tqx hereby levied, at the tim
of collecting the selling rpioe charged for each transaction, and to report and
pay over, on or before the 15th day of each calendar month, until the Treasurer of
said city, all such taxes levied and collected during the preceding calendar
month. It shell be unlawful for any seller to eolloct the price of such fuel
oil without, at the same time, collecting'the tax hereby levied in respect to sue
such sele'or sales, unless such seller shall elect to assume and pay such tax
without collecting the same from purchaser. Any seller failing to collect such
tax at the time of collecting the price of any sale, where the seller has not
elected to assume and pay such tax, shall be liable to e:?id city for the amount o
of such tax in like manner as if the same had been actually paid to the seller, a
and the City Manager of said city shall cause to be brought all suits and actions
and to take all proceedings in the name of the city as may be necessary'- for the

recovery of such tax; provided, however, that the seller stall not be linble for
the payment of such tax upon uncollected bills:
Section 3. Each and ovary Boller of fuel oil shall, beep records of
all sales in the City of Clearwater, and such record shall be open to inspection
by the duly authorized agents of the City, of Clearwater.
Section 4. The United States of America, State oft•Florida,.and
political subdivisions and agencies thereof are hereby exempted from payment of
the tax levied by this ordinance.
Section S. The term "fuel oil" shell include all petroleum products
delivered in bulk for heating purposes, Except gasoline and kerosene.
Section B. For the pu;posa of this ordinance, a sale shall be consid
Bred as being made in the city of Clearwater in every instance wherg fuel oil is
delivered to a purchaser residing within the limits of the City of .learwaterI re
gardleas of whether the residence or business office or headquarters of the selle
ers be located within the limits of the City of Clearwater or elsewhere.
Section 7. Any person, firm or corporation violating any provision
of this ordinance smil, upon conviction in the Municipal Court of the City of
Clearwater, be punished by a fine not exceeding 3250.00 or by imprisinment not
exceeding thirty days, or by both such fine and imprisonment.
Section S. In the event any section, paragraph, sentence, clause
or portion of this ordinance shall, for any reason, be held unconstitutional,
invalid, or ineffective, the same shall not repeal, nullify of in any wide
affect any other section, paragraph, sentence of portion of this ordinance. The
City Commission of said City hereby declares that it would have enacted each
separate section, paragraph, sentence, ' Clause and portion of the ordinance,
irrespective of any other section, paragraph, sentence, clause or portion thereof
Section 9. All ordina noes and parts of ordinances in conflict here-
with shall be, and the scone are hereby repealed.
Section 10. Upon its p`tssage, this ordinance shall become effective
and applicable to bills rendered on and after July 1st, 1945, and up to and in-
cluding bills rendered on Tune 30th, 1948. This ordinance shall have no further
force and effect after 12:00 o'clock P. 'd. Tune 30, 1948.
This ordinance passed and adopted by the City Commission of the
City of Clearwater, Florida.

The City Commission met in regular session the evening of duly 2nd at 8 ofolook

P. U with the following members present:
George R. seavy, Herbert Cries, Dan 5toutamire, Sumner Lowe.
Absent: Jesse G. Smith
The meeting was called to order and the 'minutes of the previous meeting were
rend and approved.
Attorney Wightman representing Vanse Harden requested the Commission to ravine
the present liquour ordinances so as to permit the establishing of a liquor store in
the colored quarters. The Commission dedlined to take any notion pending a full at-
tendance or the Commission, and an investigation by the city Attorney. A. H. Collins
was present and made objection to the establishing of such a store.
Ur. Tarvin, on behalf of the Clearwater Yacht Club, offered ;2000.00 for the Fiah
Plant Building, the same to be torn dawn and removed with the understanding that the
City lease the land involved to the Yacht Club. No final action was. taken pending
an understanding concerning the providing of a permanent home for the Sea-Scouts.
Attorney Richards now reed ordinance #507 for the second time. It was moved
by Mr. Grioe, seconded by Mr. Lowe and carried that Ordinance #507 be passed on
its second reading. This ordinance was read the third time and on motion of Mr.
Grioe, seconded by Mr. Lowe, the same was adopted. This ordinance is sot out
below and is an amendment to Zoning Ordinance No. 455.
It was moved by Hr. Lowe, seconded by Mr. Grioe, and carried that a resolu-
tion vacating part of Tuscawilln Street be adopted. Below is set out such a
resolution.
Ordinance No. 510 regulating hours in which alcoholio liquors may be legally
sold was read and upon motion of Mr. Lowe, seconded by Mr. Orion, was carried.
This ordinance was now rend for the second and third times and after each reading
upon motion of Ear. Grioe, seconded by wr. Lowe, the same was carried. Below is
set out such an ordinance.
It was moved by Mr. Lowe, seconded by Mr. Grioe, and carried that a resolution
involving the City's participation in the Lanham Act Funds be adopted.
There being no further business to coma before the Board the meeting was ad-
journed. -
