ARTICLE I
Section 1. (a) For the purpose of this ordinance and
the conatruetion of the,same, a taxicab is hereby declared and
defined to be any motor driven vehicle for th& transportation for
hire of passengers and which is operated wholly or principally
within the corporate limits of the City of Clearwater, Florida,
except sight-seeing dare and buses and care rented without driver.

include an individual, a firm# a co-partnership, a corporation,

(a) By the words *streets" or *public streets" as used
in this ordinance is =sent any of the public streets, boulevards,
avenues, drives or alleys of and in the City of Clearwater.
(d) The word "lioense" shall mean the written authority
granted by the City Commission of the City of Clearwater under
this ordinance to engage in the taxicab business in the City of '.
Clearwater, as amid business is defined by the provisions of this j
ordinance.
(e) The words "ahauft'eures permit" as used in this ordir,?
Hance shall mean written authority given by the Chief of Police

OPERATION OF TAXICABS
Section 1. The operation of taxicabs within and upon the
publio streets of the City of Clearwater shall be subject to the
conditions, regulations and restrictions hernia not forth, and it '
ahall be unlawful to operate or cause to be operated in the acid j

have been first issued by the City Commission of the City of Clear-

? Section 1. It shall be unlawful for the owner, operator,
driver or chauffeur of any taxicab to drive or operate the acme or to
permit the name to be driven or operated upon the public streets of
the City of Clearwater unless such owner, operator, driver or chauf-

City of Clearwater a liability insurance policy issued by a good and

surety bond for each taxicab shall be as follows;

Section 1. R't'VOC..TION 031 LICENSE, Whenever any poraon,
firm or corporation angagod in the taxicab business, or any opera-
tor or driver of a taxicab within the Oity of Clearwater is round to
be violating the provisions of this ordinance, or the traffic ord-
inanaa of the City of Clearwater, or tiny of the laws of the State of
Florida, the City Commission may, upon complaint or upon its own
motion, issue an order to amid person, firm or corporation, or opera-
tor to appepr mt a fixed time and place for investigation, mad if
the City Commission shall be satisfied aftor such hearing of the
violation as charged, the City Commission may, in its discretion,
suspend for a fixed period, or revoke entirely the license issued.
Section 2. Any person, firm or corporation violating any of
the provisions of this ordinance shall be punished, upon conviction
thereof, by fine not exceeding Ono Hundred Dollara ($100.00), or by
imprisonmant in the City Jail for a period not to exceed sixty (60)
days, or by both such fine and imprisonment in the discretion of the
Municipal Judge.
..aTICLE =6
Section 1. All ordinances and parts of ordinances of the
City of Clearwater in conflict herewith are hereby repealed. If any
part of this ordinance shall be bold and declared invalid or unconstit-
utional, said part shall in no visa render any other part of this
ordinanae invalid.
:RTICLE XIII.
Section 1. This ordinance is hereby declared to be an
emergency, ordinance, and it shall take effect immedimtely upon its
pasaage and adoption by the City Commission of the City of Clear-
water.

Section 7. It shall be the duty of the Chief of Police to
notify the City Com:aission of any and all violations of any ordinance
of the City of Clearwater by tiny taxicab operator or chauffeur.
ARTICLE VIII.
Section 1. Every person, firm or corporation owning, oper^tin
or controlling any motor vehicle opornted as a taxicab within the
limits of the City of Clearwater shall file i'rtth the City Manager a
schedule of the rates or fares to be charged for transportation of
passengers in such'thxicabs+ and all ch-rgos shall be strictly in
accordance with such schedule. Such person, firm or corporation may
file an amended schedule of fares at any time, and such amended schedul
shall show the date thereafter on which it i., to become effective.
Section 2. If demanded by the passenger, the driver in
charge of a taxicab shall deliver to the person paying for hiring of
the name, at the time of ouch payment, a receipt therefor in legible
writing, containing the name of the owner, the City license number, or
the drivarfa City license ntnabor, if license be required, showing up-
on said receipt all items for which a charge is made, the total amount
paid, and the drto of payment.
Seery driver of any such public automobile, taxicab, or
motor vehicle shall he" the right to demand payment of the legal
fare in advance, and may refuse employment unless so prepaid.
:IRTICLE IY
Section 1. LICENSE V%X REQUMED To OPUL-TE BUSTNFM. It
shall be unlawful for any person, firm or corporation to carry on,
engage in or oonduat the business of operating s taxicab or taxicabs
for the transportation of persons within the limits of the City of
Clearwater, ?lorida, without first having obtained a license for said
business from the licensing officer of the City of Clearwater.

Seotioa 1. No taxicab operator shall solicit business or
pick up passengers within any area designated as the stand of a
competitor.
Section 2. No taxicab operator shall solicit business or
pick up passengers within any aron designated as an established bus

reasonable cause to believe that the purpose of such dirooting, t9k-
ing, or transporting is for the purpose of prostitution, lewdness, or
assignation.
ATICLL VI.
Section 1. It shall be unlawful for any driver, operator or
chauffeur of any taxicab to carry in such taxicab any person or per-
sona axe apt faro-paying pnasengers or employees of the person, firm,
or•oorporation by which the taxicab is owned or operated.
Sootion 2. It shall be unlawful for any driver or operator
of a taxicab to drive or operate a taxicab for more than twelve hours
within any twenty-four hour period.
Section 3. It shall be unlawful for any taxicab to be driven
upon the streets of the City of Cloarwntar unless the name of the
person, firm, corporation, nasooiation, or co-partnerahip either
owning or operating said taxicab, or the trade name under which snid
taxicab is opor^ted shnil be conspicuously paintod on snid taxicab
its letters not leas than two inches in height.
Section 4. Every taxicab operated upon the public streets
of the City of Clearwater shall be onuipped with a good and eufficicat
governor for the purpose of regulating the speed of said taxicab, and
the said governor shell be no fixed and rcgulatod tint said taxicab
cannot be driven at a spoed in excess of 35 miles per hour.
Section B. Such taxicab shall have posted in a conspicuous
place therein s schedule of rotes for the transportation of persons
within the corporate limits of the City of Clearwater, and no chgrgea
ahall'ba made except as provided by the rates so posted.
Section 6. Every taxicab shall be inspcotod to determine its
mechanical condition between January first and fifteenth, and between
July first and fifteenth, of ouch yomr. The City Manager may also

Section 2. No policy of insurance or surety bond no herein-
above provided shall be cancelled until the expiration of five days
after notice of intended cancellation thereof has boon given in writ-
ing to the City Clork of the City of Clearwater by registered mail or
pors3nal delivery of said notice, and a provision therefor shall be
embodied in the anid policy or surety bond.
ARTICIX V.
Section 1. =117P=18 P-MIT. It shall be unlawful for
any person to opornto or drive a taxicab in or upon the stroota of
the City of Clcarwntor unloss rnd until such person shall have first
obtained from the Chief of Police of the City of Clearwater a ohauf-
feur's permit, as hereinafter set forth.
Section 2, Any person eighteen years of age or over may
make application to the Chief of Police of the City of Clearwater
for a cheuffour's permit. It shall be the duty of the chief of
Police to make an investigation to determine the moral character
and fitness of the applicant and the knowledge of the applicant of the
provisions of this ordinance and the traffio ordinance of the City of
Clearwater; and it shall be the duty of the said Chief of Polioe, if
the said applic ant be a person of good moral character and fitness
and possesses sufficient knowledge of the provisions of this ordinance
and of the traffic ordinance of the City of Clearwater, when the
applicant complies with Section 6 of nrtiola V to laauo such person
a written permit, which said permit shall be signed by the Chief of
Police of the City of Clearwater and shall bear the name, address,
Box, color, age, signature, photograph and finger prints or the
applicant. The Chief of Police shell procure the finger prints and

a photograph of the applicant and shall keep the same on permanent
file in his office which prints end photograph shall be voluntarily
furnished by the applicant at the timo'of filing his application.
The applicant shall be allowed one weep from and after the issuance
of the permit within which to furnish the finger prints and photo-
graph; it they are not furniahed within this period, the permit shall
be revoked.

chauffeur's permit to wilfully alter, deface, obliterate or destroy
the same or to cause the aamof,to be dofaeod, obliterated or 4astroyad.
Section 4. Every driver or operator of any taxicab operated
in the City of Cloarwnter shell have his onuffour'a permit displnyod in
said taxionb in n conspicuous place so as to be easily observed by any
person occupying said taxtoob. This sootion uhall apply only while tho
driver is operating the taxicab.
Section S. The City Commission of the City of Cloarwater
retains the right to suspend or revoke any chauffeur's permit issued
by the Chief of Police if upon investigation the City Commission
shall find that the holder of said chauffeur's permit has violated
eny of the provisions of this ordinance, or has boon convicted of a
1 folony, or has been convicted of driving a taxicab or other motor
vehicle while under the influence of intoxicating liquor, or if said
person is suffering from a contagious or communicable disosso, or
defect or impairment of vision or honring, or other physical impair-
ment, or if the said person is not a person of good moral character
and fitness, or if said parson has been twice convicted of.reokloss
driving within any poriod of twelve months. Before such chauffeur's
permit shall be suspended or revoked. however, notice of intention
thereof shell be served upon said parson either by rogistarad rail
or personal service, and sold person shall be given an opportunity
II to be heard, and said hearing shall be conducted by and before.tha
1 City Commission.
Section d. Any applicant for chauffeur's permit shall sub-
mit hinsolf or harself to a physical.exnmination by some licensed
physician of Pinellas County to determine whether or not.the said
applicant is suffering from a contagious or communicable disease and
{ whether ar not said applicant has any defect or impairment of viairn
or hearing or other physical impairment which would reader him or her
incapable of safely driving a motor vehicle.
Section 7. The holder oar a chauffeur's permit shall, at least
once a year after the issuance of such permit, submit to the exemina-
f tion proscribed by the preceding section; the physician's certificate
E issued pursuant to such an examination shall be filed with the Chief
of Polioo. Upon the failure of the holder of a chauffeur's permit to
submit to an examination as herein prescribed, or it upon such oxam-
I? ination he or she shall be found physically unfit to operate a motor
