December 21, 1938
The City Commission of the City of Clearwater, Florida, mat
on the above date, in special meeting assembled, with the following
members presentt
L. A. Harsh, Mayor-Commissionor,
D. 0. Batchelor,
1. A. Barry,
Herbert Grice,
The Mayor-Co mtiissioner announced that this special meeting
was called and being held in pursuance to the follotirin_ notice:
"NOTICE
TOi MESSRS. D. 0. BATCHELOR, R. L. BAKER, Z. A. BARRY, AND
HERBERT OXYGE, City Commissioners of the City of Clearwater;
You are hereby notified that a special meeting of the City
Commission will be held at the City Hall in the City of Clear'+rater
on the 21st day of December, 1938, at 11:30 o'clock A. M., at which
time there will be introduced, condidered and disposed of an
Ordinance entitled:

Clearwater, Florida, Consisting of the Sanitary Sewerage System
as now in Existence and all Zxtensions or Replacements thereof;
Establishing and Providing Rates and Charges for the Use and
Privilege of Use of Such Utility; Providing for the Collection
and Disposition of Such Charges; Makina it Unlawful to Tap or
Use such System without Payment of all Charges and Fees Therefor;
and ProvidinL, a Penalty for any Violation Thereof," and moved its
adoption upon its first reading. Seconded by W . Harry, and upon
roll call, the following vote was palled:
Ayes: Marsh, Batchelor, Barry, Grice. Na73, None. Absent
and not voting, Baker.

time by titln only. Mr. Barry seconded the motion, and upon roll
call, the followinj' vote was polled:
Ayes: Marsh, Batchelor, Bar, y, Orice. Nays, None. Absent and
nut voting, Bmhor.
Thereupon the Mayor-Comminaioner declaroO the motion pasaod
and said ordinance was read a second time by its title.
Sr. Batchelor moved said Ordinance be adopted an road. Mr.
Barry, seconded the motion. Upon roll call, the following; vote
was polled:
Ayes: Mr, Wrsh, Batchelor, Barry, Orice. Hays nano. Abaont
and not voting, Baker.
Thereupon the Mayor-Comni.saionor declared said ordinance duly
passed upon its second reading.
?- Mr. Batchelor moved ordinance No. 439 be read its third and
final time. Mr. Barry seconded the motion. Upon roll call, the
following vote was polled:
Ayes: Marsh, Batchelor, Barry, Oriee, Naya, none. Absene and
not voting, Baker.
Thereupon the Mayor- Commiesioner declared tho nation passed
and said Ordinance was read its third and final time.
Mr. Batchelor moved said Ordinance be finally adopted as read
'dr. Barry seconded the motion. Upon roll call, the followinb vote
was polled:
Ayes: Marsh, Batchelor, Barry, Orice. Nays: none. Absent and
not voting, Baker.
Thereupon the Mayor-Commissioner declared the motion passed and
.,rdinance No. 439 dui ado tod and signed said Ordinance and approval
Moved by Mr. Batchelor, seconded by Ur. Barry, and carried,
that the City Attorney be instructed to dismiso the Banicuptcy suit.
Mr. Batchelor introduced a resolution entitled:
"A RESOLUTION ACCEPTING DF-ED TO CITY OF C nTAIN PROPgRT! ON SOUTH
Gsa'OL,% AVr11UE, Il! TFfy CITY of CLEARY.ATLM, FLOPIDA. a
and moved its adoption. Seconded by Mr. Berry. Upon roll call, the
following vote was polled:
Ages: Nlarsh, Batchelor, Barry, Grice. Nays, none. Absent and
not voting, Balcer.
Thereupon the Mayor-Commissioner declared the Resolution duly
adopted, and signed the same.
Moved by Ur. Batchelor, senonded b7 Mr, Orice, and carried, that
Delinquent tax notes recently acquired b; the hater a Gas Fund be
purchased by the Bond Interest Fund.
Moved by 5r. Batchelor, seconded by Mr, Barry, and carried, that
the following transfers be made:
Transfer 03190.54 from Bond Interest Fund to talcs care of
overdrai't in the Capital Fund, caused by payment old Ftlemm ,judgment.
