SEC. 1. This Ordinance shall apply to all sales at Public
Auction of diamonds or any other precious and semi-precious stones
or imitations thereof, watches, c-lacks, Jewelry, gold, silver or
plated years, china, glass-vrare or leather goods conducted in the

and it shall apply regardless of Wiether the goods and wares so
offered for sale are in fact the property of tliose : offering them
for sale at public auction or the property of others for whom
the auctioneers act as agents, provided however that nothing
contained in this ordinance shall apply to judicial sales or
sales by any executor or administrator nor the sale bit the holder
of personal security under a contract alloying public sale in
default of payment of debt.
SEC. 2. Any dealer whether an individual, firm. or
corporation which shall not have been continuously engaged in
business in the City of Cl?,arwater, F+'lox+irla, as a retail or
wholesale merchant dealing in the goods and wares mentioned in
Section 1 hereof for a period of at least tivo (2) ,rears next
preceding the dt;te of the sale at public auction which. such
dealer desires to hold shall comply with the following provisions
and requirements, to-wit:
SEC. 3. He shall obtain a license to conduct suck: auction
sale which license shall be issued to him by the City Tax Collector
upon payment of the sum of Tiro hundred and Fifty (ip250.00)Dollars
per day for the period of such auction sale.
SEC. 4. No auction sale shall be conducted between the hours
of six (6) o'clock PM and eight (S) o'clock A. W, nor on Sundays.
SEC. 5. Upon securing such license nnd before commencing
such auction sale covered thereby the licensee shall make and file
with the City Clerk a bond in the sum of Five Thousand ("'P5 000 a 00)
Dollars payment of which is secured by some good and solvent
"surety company doing business in this state,. said bond to be pay-
able to the Governor of Florida and conditioned upon the carry-'
ing 'on of said sale in accordance with the terms of this ordin:- ce,
and fteje from any fraud or deception. Upon the violation of any of
the terms of this ordinance in the carrying on of said auction
sale or in case of any fraud or deception, any person, firm or
corporation injured by such violation or such fraud or deception
may sue and recover upon such bond in the name of the Governor
of this State for the use of such person, fiirt or corporation
and for the remount of the injury and loss nu:rtained by reason of
such violation of this ordinance or such fraud or deception to the
ariiount of such bond.
SEO. 6. It shall be unlawful for any auctioneer to Ms a-ice any
'false representations or statements as to the ownership of, or
character, quality or price of the property offered, for sale *itJh
intent to induce any person or persons to purchase the same.

SEC. 7. Any dealer whethor an individual, firm or corporation €
which shall have boon continuously ongaged in business in the '
City of Clearwater, FloPi.da, as a retui.l or wholesale merchant
dealing in the goods and wares mentioned in Soc. 1 hereof for a
period of at least tyro (2) yoars noxt preceding the date of the
sale at public auction which ouch dealer dooiroo to hold shall
before engaging in such auction rule comply with L•he following "
provisions and roquirements, to-wiL:
SEC. 8. He shall obtain a license to conduct the auction
r'•?': ; '' sale which license shall be is3ued to him by the City Tax
Collector upon payment of the sum of Two Hundred and l• ifty
(yp250.00) Dollars. Such license shall be good for a period of
thirty (30) days exclusive of Sundays and holidays.
SEC. 9. Such dealer shall also comply with the provisions
contained in sections 4,# 5, 8, and 8 of this ordinace.
SEC. 10. Any porscn, firm or corporation and 'their agents
conducting such sale who shall violate any of the provisions of
' this ordinance shall be liable to a fine not exceeding One Hundred ($100.00) Dollars and each and every violation thereof
shall constitute a separate and distinct offense and punishable -' .L
as much.

` C. 11. This ordinance shall talcs effect and become a lavr
immediately upon its passage by the City Comxitission, and upon its
passage all ordi.ntmces or parts of ordinances in conflict with
the . provisions of this ordinance be, and the name are hereby
repealed:
