RDINANCE OF TFiE CITY 17 CLEARIVATE FLO 'IT A, TO BE C1_1 ENTI'T'LED "AN ORDINANCE CREATING THE OFFICE OF THE BUILDING t • 1 INSPECTOR OF THE CITY OF CLEARWATER AND ADOPTING A BUILDING CODE: BE IT ORDAINED by they City Commission of the City of Clearwater, Florida. Section 1. That there is hereby created the office to be known as the office of Building Inspector of the City of Clearwater, Florida, Said building inspector shall perform all' of the duties herein set forth and shall receive such compen- sation as the City Commission shall determine. Section 2. DUTIES Q' INSPECTOR OF BUILDINGS. The inspector of buildings shall be,charged with the survey and regul- inspection of buildings and the enforcement of these ations and with such other duties in respect thereto, as the City Commission or the City Manager may assign to him, and while holding office, the Inspector of buildings shall not enga&e or be interested in business as an architect, engineer, or builder in the City of Clearwater, or in the sale of building materials. He shall a1 gn and issue all permits, certificates and notices' ' render the regulations; keep on file all applications, places of. buildings for public assemblies and notices received; keep the records of 911 viblations of the regulations and all matters r relating thereto, and report them, when neccessary, to the City Manager; keep blank permits, certificates, notices, applications and complaints; make annual reports of the operations of -.his office and such other reports as may be required. He shall require the intent of the regulations to be ob- served in all matters affecting structure not specifically set forth herein and other such reconstructions as he may deem • ,. :''? necessary for safety; and person or persons evading such order will be liable to penalties provided in section 63 of the regul- J ations; he shall see that work is done in accordance with the • law and regulations, that materials are up to standards required, work done in a substantial manner; shall examine any building bo made for permit to rafter;, enlarge or when application shall . build upon it and snake a record of its condition. SCAFFOLDING. When tank is located under- neath a building its test well shall extend^above source of supply. The amount of tank storage permitted shall not exceed 500 gallons. Tanks shall be riveted, welded or brazed or otherwise made tight in a workmanlike manner, to prevent leakage, and if to be used with a pressure discharge system shall sustain a hydrostatic test at least double the pressure to which the tank may be subjected. Top of tanks to be securely fastened to tpp ring with joints similar to those between rings, and shall be covered wth asphaltum or other rust preventing substance. Pipe connections shall be made of flanges or reinforced metals, secured by riveting, welding or bolts to tank and made tight. All underground storage systems, containing inflammable gases shall have one inch vent pipe running from top of of tank to a point outside the building, acceptable to the ., ,. ?. M 419 Liquids Drawn. Liquido shall be drawn from tanks by pumps so constructed as to prevent looking or waste splashing, or by other system approved by the Inspector of Buildings or fire Marshall, with controlling apparatus and piping so arranged as to allow control of amount of discharge and prevent leakage or discharge inside of the building, by any disarrangement of the system. When inside of a building the 'pump or draw off device shall be located on the grade floor, near arm entrance or other well ventilated place, but not between line and curb. " F Smoking not allowed in any public garage and signs shall be prominently displayed in three or more places, "NO SMOKING" in letters 4" high. Gasoline or other volatile or inflammable liquids shall not be allowed to run upon the floor or fall or pass into t drainage system of the premises. Self closing metal cane ' must be used for all wastes, oily waste or wasted oils. No ;- oily waste shall be allowed to remain exposed to the danger of spontaneous combustion. All garages shall be kept clean: two =,•.j' or more approved fire extinguisbors and four or more pails of sand must be kept convenient for quick use in case of fire. s. No artificial light, except electric light, shall be permitted in any public garage, and electric work shall be inspected by the Electrical Inspector. Calcium Carbide. By the term picture machine, as used in the following section, is meant any machine or device operated by or with the aid of electricity,. calcium light or other illuminant and adapted or used to project upon a screen or other surface picturial representations in which inflammable films are used. (a) From and after the passage of this ordinance no picture machine shall be installed, maintained, oporated or licensed, except in conformity with the provisions of this ordinance. (b) Every picture machine installed or operated shall be enclosed within a booth, to be not less than 6'x8' in size and 71 highs. (c) The frame of this booth shall be composed of angle secure iron not less than 1Y" by properly braced to/rigtdity, and and securely united or bolted at the joints. Every such booth shall be sheathed and roofed with sheet iron of not less than No. 20 U,S, Metal guage, or with hard asbestos board securely riveted or bolted to the angle iron frame; or 2t' of Portland Cement plaster and metal laths may be used. Floor to be of same material as sides and roof securely fastened to iron frame and covered with non-conducting material. (d), The entrance door into the booth shell be no larger than 2x6 feet of the same construction as the booth and so arranged as to close automatically by metal rope and weight attachment, or by a spring of sufficient strength and tension to keep the door securely closed. (e) All furniture and shelving within booth shall be aF iron cr noncombustible material, (f) A ventilator of area not less than that of a 12" circle flanged to carry standard conductor pipe for ex- hausting the hot air generated in operating machine, shall vent to outside of building. Section 48. STAIRrJAYS AND ELEVATCR SHAFTS. In all buildings hereafter erected or altered and usad above the first flo6r for business purposes or for public _.assemblies, if of over three stories high, the stair shafts shall be seperated and continuously enclosed with non-combustible partition. All such partitions erected in future buildings shall be protected by fire doors with wrought iron or steel hardware and securely attached to wall or partitions; or incombustible fbames anchored thereto. If glass panels be used in such doors they sbaall be of wire glass. Interior shaft windows not permitted. Doors opening into stair shafts shall open to direction of exit traveled; shall be self closing and not less than 3 feet wide. Enclosing walls for all elevator shafts shall extend at least 3' above the roof and at east 3/4 of such shaft area shall be covered with skylight as in Section 43. Whon the ceiling of any basement is 61 above the grade line, such basement shall be construed as a story. When a stairway, elevator or dumbwaiter shaft extends through the roof and is covered by a skylight, the skylight shall be constructed of non-combustible fraine and sash, and where glazed with thin glass, it shall be covered by galvanized steel wire screen with a mesh not more than 1" and not smaller than No. 12 gauge. All dumb waiters in buildings other than private residencds are to be lined throuth- out their height to 1 foot above roof with incombustible material and doors to be self closing. ,y Section 50. LIGHT AND VENT SHAFTS. In all build- ings hereafter erected or altered, except frame buildings all walls or partitions forming interior light or vent•'shafte I' shall.be built in accordance with the requirments for stairs and elevator shafts in new buildings as specified. Wall Above Roof. The walls of all light and vent shafts here,after erected shall extend not less than 3 Peet 1 11 S. . i' above the roof and if masonry, walls sha7i be covered with a doping. Section 51. EXITS REQUIRED. There shall be provided in every building erected inside the fire limits, for each floor area above the first floor at. least two means of egress no portion of said floor area shall be more than 100 feet from place of egress;- said means of egress shall be remote from each other, and one of them shall be an enclosed stair- way as herebefore specified. Elevators shall not be considered as a means of egress e Section 52. STORAGE OF FUEL. No yard for the storage of coal, lumber or woos, or of any combustible material, shall be established without the consent of owners of 3/4 of the real estate within 50 feet of the boundaries of the place where it is proposed to establish the same. Provided, however, that consent shall not be necessary to establishment of such a place { within 50 feet of a building or property used for a similar character of business already established and which is in `, Sr active operation; if such establishment ceases to be operated for the purposes for which permit has been obtained, the permit shall be void and a new permit will be required as in i iii: ; • . Section 53. 'FIRE PROCPING. All structural metal in b}xuildings of the first clams, and all structural metal supporting masonry where the structural integrity of that portion of the building depends on the preservation of the metal, in buildings of any class, shall be protected from fire. Columns shall be compl,otOy covered with 4" of brickwork laid up solid with flush joints, or r f ??f,= ;,'y,?,_`... ?•,r •.?s., .fit °.'.'?? approved mixture of Portland Cement, concrdte, or with 4" of 4 of/hard burned terracotta ldid up in an approved manner. No pipes of any description will be permitted to be inclosed in fire proofing of.columnst Steel beams and girders shall be protected from fire by a covering of concrete, terra-cotta or other fire proofing material at least 2" under the bottom flange and the same thickness upon the sides. All fire proofing to be laid up in Portland cement mortar. All structural me Cal exposed to the outside air in buildings of the first class and all structural metal exposed to outside air supporting masonry in buildings of any class where the structural integrity of that portion of the building depends upon-the preservation of the metal, shall be completely covered with an approved damp proofing material so as to adequately protect the metal from corrosion. I Thioagulation shall apply to all buildings not else- where provided for in these regulations. Section 54. MONOLITHIC WALLS AND PIERS. Monolithic concrete walls constructed in place without steel reinforcement shall be the full thickness, as set forth in preceeding thickness XCxLxcaccacar8 of walls.. If sufficient steel reinforcement is supplied, a reinforced concrete wall may be of less thickness than in thickness of walls, provided the design as submitted furnishes strength equal to that of the brick wall; and provided further, that within the fire limits no such wall shall be less than 8" thick. The minimum thiokness of walls other than party walls, where the entire loads of walla and floors are carried upon metal or ' reinforded concrete beams and columns properly anchored and tied together, shall be 1,311; sur,h walls must be well tied into beams or columns or both. Section 56. OCCUPATION CF PUBLIC SPACE. VITH BUIDDING MATERIAL. Persons engaged in the erection, reconstruction,,or f building may occupy the public. repairs of any/space, Uth building material for such reasonable period as the Inspector of Buildings shall decide, to be specified on permits issued by him. The maximum area permitted to be occupied shall not extend beyond one-third of the width of the roadway; in all cases the space allowed for building materials is.restricted r .'•'; laterally to the width of the front or fronts of the building under construction or repair, or of the premises upon which .r it is erected or to be erected. When considered necessary by the Inspector of Buildings, the space alloted for material may,extend laterally in the roadway 201 on each Bide of the ?r lot on which the building is being erected, when consent has been obtained from adjoining occupants.' Building materials or earth from excavations may be temporarily deposited in alleys 151 or more in width; to encroach not more than one-third the• width of alley, not to obstruct traffic and subject to immediate removal when so ordered by • Building Inspector. Removal Of Earth And Rubbish. Earth taken from excavations and rubbish taken from buildings must not be stored either upon sidewalks, roadways or alloys, but must bo"removed from day to day. Where dry rubbish, apt to produce dust, is handled, it must be kept wet or covered to prevent its being blown by the wind. ( .•?/jCYf.lff?7??????M??vfr ??irsj Section 57. HEATING FURNACES AND APPLIkICES. Any wood work, wooden lath and plaster partition or ceiling *ithin 4 feet cof the sides or back or fee from.. the front of an? hea ing oiler, furnace, bakery, bake oven, coffee roaster, fire heating.candy kettle, laundry stove, or similar appliance, shall be covered with metal to a height of at least 4 feet above the floor, extending the full length of the bailer or other appliance and to at least 5 feet in front. Metal shields shall be loosely attached., preserving an air space behind them; no furnace boiler, range .o other heating appliance shall be placed against a wall furred with wood. Open Flame Heating Devices. All gas, gasoline, oil or charcoal burhing stoves or heating devices shall be placed on iron stands, 6" above combustible supportsp unless the burners are at least•5" above the base with metal guard plates 411 below the burners. Section'" 58. BUILDING.'LINE. The " City Planning Board" shall establish a building line in the City of Clearwater. Section 58. SIGNS. No fixture to be used as a sign or advertisement of any sort, shall be placed, built or hung upon or from the outer wall or any projection of any building withou a permit from the Inspector of Buildings. Where lights of any description are to be used on a sign, or where it is proposed to illuminate same by artificial means, a permit must be obtained from Building Inspector, All signs projecting beyond the building line or face of building, shall be rigid and not less than 12.1 above alleys. f t" ?• ?• ?F,. All such appeals shall be made in wtiting within ten days after the refusal or revocation of a permit or within the time mentioned in any not:.ce,, or order, or within five days of the decision of the Inspector of Buildings as to his inter- pretation or application of any building regulation and not after the period mentioned, such appeals must be in writing and must be accompanied by the receipt of the City Clerk for $20.00 deposited by the applicant to pay the compensation of $10.00 each to the architect, engineer or builder, serving in eaclAaso. If the person so aggrieved is justified in his contention by the said Board of Survey, said Fee of $20.00 shall be refunded. Such written appeal must be deposited with the City Clerk, Who shall if demanded give a receipt stating time of receiving such appeal and forward some to the City Manager within, tvrenty- four hours. No oral complaints or appeal will be considered. The Inspector of Buildings shall comply with the decision of the majority of this board of survey, but nothing in this section can be construed in contravention of the provisions in in Section 8, for the condemnation of dangerous buildings or parts thereof. The interested parties, dissatisfied with the Board of Survey may further appeal to the City Commission. Section be DANGEROUS BUILDINGS. When such structure shall have been declared unsafe, and shall have been made safe or taken down by the Inspector of Buildings, the cost and expense of such work shall bo absessed upon the lot or ground whereon such structure stands or stood, and unless the said assessment is paid within ninety days frou: service of notice an the owner,.agent or other person having interest In said structure, the same shall bear interest at the rate of S% fro0ate of such .assessment until paid and shall be collected as general, taxes; but said assessment shall be without prejudice to the right which the owner may have to recover from any lessee or other person liable for repairs. It shall not be lawful for any person or persons to build or erect or cause to be erected to a greater height than one foot,the walls of any building in the City of Clearwater, upon any building lot recorded in th6 office of the Engineer of the said City of Clearwater without having first exhibited to the Inspector of Buildings a certificate from the Engineer to the effect that said walls, as marked or set out and begun, upon the footings thereof, do not encroach without legal authority upon public spaces of any sort, and that walls so mapped as party walls, coincide with lot limes previously established by the said Engineer. Where the excavation for a building is contemplated, the architect, owner, or builder shall notify the Inspector of Buildings to that effect before proceeding with construction. Similar notice must be given when the first floor joists are in place. Where no tests of the stLs- taining power of soil is made, different soils (excluding mud) at the bottom of footing shall be deemed to safely sustain loads to the superficial foot, namely: soft clay one ton to square foot; ordinary clay and sand together in layers wet two tons for square foot. Loam, clay, sand or fine sand firm and dry three tons per square foot. Very firm coarse sand, stiff gravel or hard clay, four tons per square foot or asn otherwise determined by the Inspector of Buildings. When ,a test is required to ascertain the bearing capacity of soil, the Inspector of Buildings shall be notified, that ..;he may be present in person or by representation. Record of test shall be filed with.Building Inspector. When a doubt arises as to the safe sustaining power of the earth upon which a building is to be erected the Inspector of Buildings may order borings to be made or direct the sustaining power of soil to be tested by and at the expense of the owner of the proposed building. All brick work shall be of sound, well shaped bricks laid plumb and level, bedded in mortar, of the composition and quality prescribed in these regulations for the different classes of buildings; with well filled Joints, well flushed up at every course with said mortar. No edging courses will be allowed except in face brick, and all brick work shall be laid level to avoid blocking up under Joists and bea=. When necessary to block up, it must be done with slate, brick or other hard and incombustible material. No mortar joints shall be less than " or more than 3/4" in thickness (except in face or press brick). ` Section 28. CHIMNEYS. Walls about flues and chimneys shall have every joint thoroughly and solidly filled with mortar, and the last or top courses of all chimneys and flues above roof shall be laid in cement mortar; shall be built of brick, stone or similar fire proof material to a height of at least 21 above highest point of intersection with roof; and in no case shall a chimney rest upon a floor without a footing of masonry or iron supports at both ends; all chimneys and flues, l where they pass through floors and partitions must have stuck flush joints on inside and must be plastered on inside ? and outside and between ceiling Joints and rafters. Arches built in curved wall and corner towers or squinches, shall have iron rods and curved plates to prevent outward thrust. Arches shall be turned over wooden lintels, without regard to widths. Over openings iaa which the width of the steel, lintels is less than the thickness of the wall to be supported timber lintels shall be used on the inside which shall rest at each end not less than 4" on any wall and arches turned over them. Wall openings of more thah 10 feet in width shall be sup- ported by iron beams or girders. Cuti-stone or hard brick arches. may be turned over any opening over 10 feet and less than 30 feet in width, provided they have skef(backs of cut stone or cast iron properly secured against spreading, by abutments of sufficient weight and strength or by two wrought iron tension rods of sufficient strength. Section 31. STONE FRONTS. All lintels of stone fronts, turned over corner openings, shall be(of iron, or steel of the full width of the wall to be supported and shall, be made safe, as above detailed. Corner Openings. The walls of buildings over corner opening shall be sustained on brick) cut stone, or monolithic concrete columns, cantilever steel beams, or iron supports; and if of iron, said supports shall be protected by fire proof covering. Section 32. MORTAR. Mortar below level of water shall be no poorer than 1 part cement and two parts sand. Mortar for first class buildings shall, for the lower half of their height, be no poorer than t part cement, and 3 parts sand; and for 'the -upper half 1 part cement, 2 parts lime paste, 4 parts sand. All floor timbors and end of beams, rafters and joints entering brick walls r shall have a boaring of a least 3b" thereon, and shall be out on a splay of 311 in their depth, or the joists may be hung in iron stirrups; said stirrups to be approved by Inspector of Buildings. Door and Window Openings in Party Wall. No door or window openings shall be placed in party walls until the written consent of the adjoining o?vner has been filed in the office of the Inspector of Buildings, and porwit issued by Inspector of Buildings; said openings to be protected as re- quired by the underwriters of Insurance. Ssction 37. ROOFS. Every building or addition thereto.,. hereafter erected within the city limits, shall be roofed with non combustible material. Every roof of combustible material which shall become impaired one fourth of its original value if within the fire--limits or one half if without the fire limits shall be replaced by the owner with noncombustible material. Scuttles. Each roof on a building of 2 stories or over shall have a scuttle not less than 2x3 feet, with a step- ladder or flight of steps leading thereto, to be securely hinged, hooked or latched to roof. Mansard Roofs. No mansard or other roof shall be constructed more than ohs story in height, and such mansard roof shall be battered not less than 2t' for each foot in height of the mansard portion. Section 38. CORNICES. Cornices, roof mouldings, finials, crestings, ornamentations and dormer window fronts on all buildings hereafter ereebed within the fire limits shall be made of non combustible materials. All cornices shall be well secured to the walls, and in all cases the walls shall be carried up to the planking of the roof, and when the cornice projects above'the roof, the wall shall be carried up to tho top of the cornice. A17. oornioes on buildings within the fire S 2 , P S s ?L limits, when roplaced, shall be of non combustible material; this regulation does not apply to front doors or windows or porohes. Section 34. STRENGTH OF FLOORS. All floors shall be designed and constructed so as to have strength sufficient to sustain the weight to which the proposed use of the building will subject them, and floors now existent shall not be loaded in excess of the safe loads given in these regulations, allowing an increased factor of safety for decrease of strength from decay, dry rot or other causes. Every application for a', permit shall state for what purpose the building is designated tea be used, and the permit itself shall state such use, and it shall be unlawful to use the building for a purpose not mentioned in the application and permit unless by consent of the Inspector of Bldgs, for other use or purposes. Floors shall be capable of sustaining, per square foot of surface, imposed loads as follows: Floors for dwellings 50 lbs.; Hotels, apartment houses, tenements and boarding schools other buildings used as dwellings, 50 lbs, in the private rooms or apartments and 75 lbso in halls, offices, dining rooms, cafes or rooms for public use. Light office floors, 75 lba, except halls, lobbies and bther parts for common use of tenants, where it shall be 110 lbs. Floors of public buildings and stores for light merchandise, 110 lbs.School!rooms floor, 75 lbs., store floor for heavy merchandising warehouses and mercantile- build-Inge of like character, at least 150 lbs. for floors not in- cluded in this classification and floors subject to vibration from machinery or of drill-rooms, riding schools, etc., or. those supporting moving loads, the imposed loads shall be determined by a computing Engineer, Section 40. ROOF AND FLOCK T31IBERS.
