ORDINANCE OF THE CITY OF. CLEARINATER, FLORIDA, TO BE ENTITLED AN
" ORDINANCE AUTHORIZ I110 THE TAM PA AND GULF COAST RAILROAD TO LAY TILE
SIDETRACKS ACROSS FRANKLIN, PIERCE AND PARK STREETS:
BE IT ORDAIMD BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA:
WHEREAS the Tampa and Gulf Coast Railroad Company , a Corporat-
ion, has a franchiso over certain of the streets, avenues, and alleys
' of the City of Clearwater and is now actually operating a railroad 1
Into and through' the City of Clearwater under said franchise, and is
daily operating its locomotives, train and cars over its railroad and:
has applied to the City Council of the City of Clearwater for leave to
° cross Franklin, Pierce and Park Streets in said City- with a sidetrack '
from its main line to the Dillard Packing House, and
WHEREAS the City Council Aeems it advisable and to the beat r
!{{ interest of said City that permission be granted to the said Tamps and
Gulf Coast Railroad Company to cress said streets. with its side track,
', ! { said railroad to pay all cost of replacing the pavement u on said
streets and all cost of installing the necessary' crossing of said
streets and the perpetual upkeep of said crossings.
! THEREFORE BE IT ORDAINED by the City Council of the City of

.' Clearwater, Florida , that the right and privilege of crossing said s .

streets with a line of side track be, and the same is hereby grunted } 4t '
the said Tampa and Gulf Coast Railroad upon the consideration of the
said Tampa and Gulf Coast Railroad, its successors and assigns,
agreeing and firmly binding itself by accepting this Ordinance to

replace the pavement or sidewalks on any or all of said streets at the : °
points where ailed track crosses said streets or sidewalks in as good
condition! ibcrlt is at the present time, and shall comply with all the.condi 4

tions of this Ordinances Said railroad shall at all times in the
future keep < said crossings and sidewalks in as good condition as the
other portion of said streets and sidewalks shall be kept and main-
tained and shall a all cost of installing, maintaining and

eroases said streets and sidewalks, and the the portion od 'said streets ;
actually covered by said track , and for an additional distance of
two feet on each aide thereof, and provided further that only one
track shall be laid across slid streets and sidewalks; provided
further that if the said City shall at any time repave said streets
! or sidewalks and pave the streets or such walks, which are not now'
paved , the said railroad, its successors and assigns, shall pay
for the pavement venoms and upon said tracks, and an additional
space of two feet on each side thereof, immedistelSr upon completion
of said pavement; provided further that the City Council or the " .
legislative body of said City shall have the right to prescribe by ;i.
ordinance or resolution , such rules and regulations for the oper-
ation of the trains acres said streets and upon said sidetracks,

Coast Railroad Company , its successors and assigns, shall fail to
comply with the provisions of this Ordinance, the same may be re-voked
by the City of Clearwater at any• tdAe. Provided also that no cars
or locomotives or equipment shall be allowed to stand upon any of
said streets. '
