ORDINANCE NO 167 OF THE CITY OF CLEARWATER, FLORIDA.
AN CRDINANCE ENTITLED " AN aiDINANCE TO AMEND SECTIONS 70 AND
71 OP THE CODE OF THE CITY OF CLEAR7ATER, AS ADOPTED THE 7TH DAY
OF JANUARY, A. D. 19120 AND TO PROVIDE FOR THE PAVING AND IMPROVING
OF STREETS AND PUBLIC THOROUGHFARES UPON PETITION BY THE PROPERTY
OWNERS, AND TO PROVIDE FOR THE ASSESSMENT OF THE COST OF THE SAME
AGAINST THE ABUTTING PROPERTY".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER,
FLORIDA:
Section 1 That Section 70 of the Code of the City of
Clearwater, Florida , as approved January 9th, A. D 1912, be and
the some is hereby amended to read as follows, to-wit:
Section 70. When any paving or street improvement shall be
made in the City of Clearwater , in accordance with the provisions of
Section 69 of the Code, the City Council shall assess one-third of
the total cost of grading, filling or excavating, paving or other-
wise improving such street or part of street against the property ab-
utting on either side thereof, which amount so assessed shall be a
lien on said property and may be enforced in the manner now provided
by law.
Section 2., That Section 71 of the Code of the City of
E Clearwater, ss adopbed on the 9th day of January, A. D. 1912 , be
,. and the some is hereby amended to read as follows, to-wit:
Section 71. If the cost of paving or otherwise imp-
roving any street, as provided in Sections 69 and 70 of the Code,
apportioned and assessed to abutting propertyp be not paid by the
owners within thirty days after the completion of such paving or
' improving of such street, the City Council shall issue interest-

bearing improvement certificates against such real estate liable

at the end of any intorest-paying period. The City shall have
poser to hold and collect , sell or transfer , hyothecate or put
up as collateral ip any or all improvements, certificate: when issued,
as the City Council may direct, to borrow money for the purpose of
paying for such improvements. All improvements certificates rhall
F, constitute and be made a lien upon the real. estate apainat which the
certificates are issued, until such certificates shall be redemmed

and fully satisfied, together with the interest accruing for the
. current year.

Section 3. That if at any t-ime the owners of more than half
of the property abutting on any street or part of street shall
petition the City Council to have such street or part of street
to be improved by gradinpl, filling, curbing, gutering " .
as shall be designated in such petition/ draining, or paving,
the City Council shall. give notice, as provided by ordinance- and ,
at the time designated in such notice, it shall appear that
if
,
the owners of more than half of the property abutting on such street
or part of street, as designated in the petition, desire such im-
provement to be made, the City Council dhall 4ave power and authority
to order such improvement made, and the entire coat of such im-
provement shall be assessed against the abutting property, and
improvement certificates shall be issued against such abutting prop-
arty in the same manner and collected in the same way as provided
for in the preceding sections of this Ordinance.
