An ordinance providing for the errection rid operation of
Railroad gates or guards in the Town of Clearwater, Florida and
penalty for running and operating trains, cars or locomotives
across streets in the Town of Clearwater where gates or guards
! have been errected.

Section 1. That the Mayor of the Town of Clearwater, shall
whenever in his opinion it is necessary to the safety of life, limb

or property, have the full right and authority to order and direct - '
any railroad company running through, along or across any of the
Streets of the Town of Clearwater, to build, erect, maintain and ,
operate gates or guards at such street crossings and other places

as he shall designate in the ToWn of Clearwater, Florida.
f Section 2 That the Mayor of the Town of Clearwater
a Florideti whenever in his opinion it is necessary to order and direct
the building, erection and operation of the aforesaid railroad gates,:
or guards, it shall. only be necessary for him to issue his aforesaid
j order in writing, direct to any agent of the aforesaid railroad
companies requesting and ordering the building, erection and opera-
i tion by said company of the aforesaid gates and guards, designate ;
the place or places that the same shall be placed; which notice
r : - shall be served upon the agent of the said railroad company by the t
Marshall of the Town of Clearwater. That the said railroad company
shall within thirty days after the service of the aforesaid notice '

Section 3. That all gates or guards erected under this 1.

are lowered or closed during the approache or passage of trains,
cars or locomotives.,
i Section 4. That upon the approach of any train car or loco- j,
E motive to any street crossing where gates or guards are erected , said
gates or guards shall be closed when acid train, car or locomotive

hes.approached within fifty feet of the crossing, and shall be kept
! closed until said train, car or locomotive has passed sold crossing
and said gates or guards shall be opened immedisteltyafter the pass-
age of sold train, car or, locomotive.
Section 5 . That all of said gates or guards shall be provided

lights which shall be displayed when the gates or guards are lowered
or'closed in the middle of the street across which said gates or guards,

Section B. That any person or persons who shall run or operatA
or cause to run or operate any train y car or locomotive upon,
through or across any street in the said Town of Clearwater without
first having provided for the maintenance and operation of the afore-
said gates or guards as provided herein, or who shall fail or neglect

Mayor above provided, shall doe deemed guilty of its violation, and ? .•;' .
upon conviction thereof, shall be fined not less than ten dollars nor
more than two hundred dollars or imprisonment in the Town Jail for r.

tion of the Mayor.
Section 7. That all ordinance or parts of ordinances in con- i ,
flict with this ordinance are hereby repealed.
