" An Ordinance Granting to the Tampa & Gulf Coast Railroad, a E ` i `a corporation organized under the laws of the State of '.1 Florida, its successors and assigns, as far as the town of Clearwater, Plorida, is by law authorized to dog.tho Perpetual•right and privilege of constructing,maintaining and operating railroad tracks over, on and along certain streets in the town of Clearwater, Florida, s Be it ordained by the Town Council of the Town of Clearwater, Florida. Section 1. The Town of Clearwater, Florida, does hereby give and grant, as far as it is by law authorized so to do., to the Tampa & Gulf Coast Railroad Company, a corporation created, organized and oxi-ating under the laws of the State of Florida, its successors and assigns, the perpetual right and privilege to construct, maintain and operate on, through and over the following streets in the space extending thereon ten feet on either side of the center line of Fourth street and eighteen feet on either side of the center line of East street, to wits Beginning at the east boundary of the said town On Fourth street, and running west to its terminus, thence on East street and running south to the south boundary of said town: not exceeding one on Fourth street and three on East street lines of track,-with such turnouts or sidetracks as may be necessary or convenient for the passage of trains or industrial usage; provided, however, that no part of said streets shall be used for freight i terminals. The said railway to be constructed under the I provisions of this Ordinario© shall be laid down or brought up to the grade of the streeta at the time of construction, and whenever said grades of said streets are changed said E , ` grantees shall make thoir tracks conform to tho newly as- tablishod grade, unle^z otherwise agreed between the grantees and the said tovin; and the said grantees shall be required r i to keep and maintain that part of the street between their tracks, and that port occupied by said tracks and.for u- distance of two feet outside of each rail thereof in as good condition as the said town shall maintain the rest of the street, and upon.all unpaved or unimproved streets occupied by their track the, said grantees shall provide and maintain suitable and sufficient crossings at the intersections for the full width of said streets and sidewalks and shall also keep and. maintain proper drains. Section 4. The said grantees shall have the right of way over their rail way in preferrence of all other vehicles or persons -? except the apparatus of the fire department and ambulances of the said town in the performance of public duty or service, ?'.. and it shall be the duty of all persons or vehicles except as rforesaid to clear the track upon the sounding of the- gong or other signal of an approaching brain; Provided said grantees ,r f r ! shall not koop the street crossing or any of them blocked with their trains or cars for a period of more than ten minutes.. Section 5.
