Section 118.Oi Oef�nt�ions,
i'he folTowing wards and phras�s, when used in this Chaptier

{a? S ecial Assessment �faintenance means that daily, weekly,
monC y or o er per o ic care, preservirtg ar keep'ing in
praper candit�an of trees, plants and plan�ers, henches�
signs� special surfacing, pedestrian lightir�g and v�her
sidewalk improv�ments, such care, preserving ar keepi�g
being accomplisned �hraugh a specia� assessme�t program.
ib) Assessable Front Fofltage �eans the length of the reai property
a u t ng e pu c r g t-of-way ar�d that wi 1� recei ve the
benefit af the special assessmen� ma�ntenance.
(c) Maintenance Cos� means the sum a� a11 expen5es chargeable
o e ma n enance of trees, plants and planters, benches�
sigr�s� special s�rfacing, pedes�rian light�ng and other side-
walk improvements, �ncluding Za�ar, materials, suppl�es, con-
�ractual costs, d9rect overhead and suc� other ger�eral and
overhead costs as may be assig��d by city staff on a basis
cansistent and equitable with charges made to other projects
and activities of a simi�ar nature.

Section 118.02 Scope - Maintenance Subject to Ordinance.
The prov�sions of this Chaater shali apply to special assess-
�neni maintenance a5 defined dn Se�tion 118.01 ta? oF the Code of
Ord�nances� City af Clearwater. Such ma�ntenance shall be undertaken
whene��r the City Commissian determines in accordance ,ri�h the pra-
cedure se� out herein that such activity sho�Sd be accomplished and
the casts collected as an assessment.

best interests af the City that maintenance be provided for

facing� pedestrian l�gi�ting and o�her sir��walk improvements;
2. Such maintenance as �n�merated in Sect9an 118.03 (b) 1.
� abave is requested by at �east fifty per centum i5R�'�} of the
� property owners i� a geographic area and agreQd ta by the
City Comr�issinn; ar .
3. Such maintenanc� as enumerated in Section 118.03 (b) 1.
above is a condition af a communi�y impraveme�t projec� '
involvir�g the participa�ion af the City of C�earwater,
inFarmation abouti the �raject and the special assessmen�
maintenance has been provided to the property owners who
wouid be subje��t ta the special assessmer�t far maintenance,
written agreement to specia1 assessmer�t maintenance has been
rec�ived by the City from at �easL• fifty per centum (50�) of
the property awners in the g�ographic area and special
assessmer�t maintenance has been agreed to by the City

1. 1'he Parks ar�d R�creatio� Di rector determi nes that tltere i s
probabie need for sp�cial asse5sment mainte�ance in a geo-
gra�hic area;
2. At least fifty per centum (5Q�} of tlie �raperty owners in a
geograph�c area reques�'�he Parks and Recreation flirector tu
provide specfial assessment maintenanc� for tnat g�ven
geographic area; or '
3. Special asse�sment maintenance is a candition of a cammunity
improvement pro�ect involving ti�e par�icipa�inn o� the City
of �learwater, infar�tation about the pra�ect and the special
assessmer�t maintenance has been provided to �he praperty
awn�rs wha would be subject to the special ass�ssmen� far
maintenanc�� and wri�ten agreement to special assessment
maint�nance has been r�ceived by the City fram a� least fifty
per cer�tum (5a�} of ��e property owners in t�e geographic
area.
(b) Preliminary f�ublic Hearing; �Jo�ice. Upon idenLification af need
�ar"�s"pec a a�sessmen ma n enance, the Parlcs and Fecreati�n
Director shai7 designate time and place far a preliminary pub7ic

public hearing to be conducted�in a manner that provides an
oppor�und�y for the variaus viewpaints amang Lh05� present ta bE
expressed ar�d note�. The prel�minary publlc hemrtng and noCice
for the purpose oF special assessment m�in�enance is waived for
specl�l assessmen� mainteRance which is a part of and a condition
of a community improvemen� project involving the City af
�learwater on whic� informat�an about the pro�ect and the specia1
asses�ment �aintenance has been provided ta the property owners
wF�o wauld be sub,�ect to tt�e speclal assessment far �tair�tenar�ce
ar�d far which written agreements �'or the special assessment �nain-
tenance have been received by the City from at least fifty per
centum �50�? of �he property,owr�ers ir� the geographic area.
(cj Resalutior� for S ecial Assessment Maintenance, Inclt�ding '
ssessmen o. e ar.s an ecrea on rec ar s a 1 farward
an agen a em and a corresportd�ng reso7utfon for consideration

assessment maintenance, backgraund ir�fot•�atian, and a summary o�
the preliminary pub�ic h+2aring, if s�c� is required, inc�ud��g .

s�pecial assessment maintenance amat�g thase propsrty awners pre-
ser+t at the preliminary public hearing. The resolution shall
dec�are the need far special assessment maintenance� the sgeci�ic
maintenance that is to be provided, the date maintenanc� wi11
begin, the specific geographic area io he maintained; �hali
d�clare and authorize the total cost that shall be�paid by spe�
ciai assessmen�, the per-front-foo� calculat�on basis QF the
special assessment, the mar�ner in which the special assessment
sha11 b� paid, the date tl�e special assessment s�al1 be paid, a
statement �hat if the assessment is not paid �hat.a lien wil� be
filed and additiona� charges made as required by the details of
Section iJ.8.08 and the assessmen� role as defined in Section
118.05 {c1. The agenda item and the resalu��o� shall be voted
upon by the City Com�ission.

periodic assessments and shall initiate callections praced�res

�he Parks and Recre3�ion Director shall initiate maintenance as

name and addres� of the property n�rner(s) of r�cor�, tne
corresponding �ndividual fron� footage and the correspanding
individua1 annual ar otl�er period dollar assessment. Such
�ssessment ra11 shall be a part af the special assessment ma�n-
tenance resolution as defined in S�ction 118.0�# ic} for �he first
assessment period and as d�fined i� Section 1.18.07 for fo�lowing
assessment periads after the first.

Upon Gomp'�etian of the prelimi�ary public heari�g as reguired and

per 5�c�ion 118,04 {a�, the Parks and Recrea��an Directar shaZl �or-
ward ta the City Cnmmissian an agenda item as definPd in Section
118.04 (c) and a resolution including assessment roll a, defined irt
Section 118.04 {c). A public hexrir�g at a fixed time and at a'Fixed
p�ace s}�all be designated, at which hearing �he ownErs flf pr�perty to
be assess�d, and any other persans fnter�sted therein, may appear
before �he Cfity Commission with respect to the need for suc� s�ecial
assessment maintena�ce and may appear before �he City Commission with
respect to the cost of such maintenance and the amount to be assessed
against each prnperCy. i'he City Clerk shall pravide written notice of
such h�earing to each of the property owners whose property is subjec�
�a bQing assessed. Such notice shal� be pravided by mail at least �en
i10} days in advance of such hearing. In addi�tion, notice of the time
and piace nf such hearing shall be g�ven by twa {2) p�biications five
i5) days apart in a newspaper of general circu�ation fn the munici-
pa19�y; tt�e last publicatiori shail appear at least five i5} days priar
to the }tearing date. Soth the indiv�idual notice of �he p�blic hearing

After the specia� assessment far maintenance is levied for the
first year ar oth�r designated initial perin�� assessment for suc-
ceSSivQ periods sha31 be initiated by the Parks and Recreation
Dir�ctor. For each of thQSe assessment periads beyand the.firs�
assessmer�!t period� the Parks and Recreatiun Director sh�il �orward a
resolu�ion for acCton by the City Commissian, such resaluCian to
reference the original agenda item and resalu�inn that estab�ished Che
specific sp,eclal assessment mdint�r�ar�ce project, the sp�cific main-
�enance that is to be provided, Lhe period nf time the maint�nance is
to b� pr.ovided� the specific geogrdphic area x� be mainta#ned, the
tatal cost that�shall be pald by special assessment. the per-fron�-
foot calculation basis of the spec�ai assessment, the ma�nner 1n which
the sp�cia�1 assessment shal� b� paid, the date the specfial assessment
shall be paid, a statement that if the assessr�ent is not paid that a
lien will be fiiled and addiCionai charges made as reg�ired by the
details af Sect�on i18.a8 and the assessment ro11 as defined �n
Section 1I8.05 (c). A public hearing at a fixed time and at a fixed
place sha31 be designated and notice of s�ch publlc heari�g shall be
puhllshed ance in a newspaper af genera� circulation in the munici-
pali�y at ieast sQVen (7� days prior to the heari�g date.
The City Commission shail consider all objec�ions relating to the
assessments and shali equalize or adjus� s�ch assessments w�ere '
jus��ce and right so dictate.
1"he assessm�nt roll sha11 6e adopted by favorable vate of �he
Ci�y Cammission on the resoiu�io�, The publlc hearing for special
assessment mair�tenance may accur on the same date as the public
hearing for the aperating budget and the public hearing for the
cap�tat improvements budget. as defined �tn Section 41.04, Section
41.05 and Section 41.a5, or at such other tir�e as the City Comn�ssion
may determine.
Sec�iot� 118.08 Payment of Rssessmen�; Certificates of Indebtedness.
ia) A statement of the canfirmed assessment and the penalities for
non-payment o� the assessment as listed below in this Sec�ion
shal'! be prcvided to each property owner listed on the canf�rmed
assessmen� roll by the City Clerk. i'he praperty owr�er shali have
thirty {30) days within which to pay the assessment.
S�here assessments are no� paid wfithin the time pravided, a
cer'�ificate of indebtedness sha13 be issued for each assessed lot
ar parcel which certificate shall cantain a descrip�ion of t�e
lat or parcel, the amount of the revised assessment which sha11
ta�al the amaunt af the in�tiai assessment plus a seventy-five
dallar (�75) administrative charge, a descr�p•tion of tne main-
tenance and shal� ident�fy the resalutian n�mber and date under
which the assessment was made. Such certtficate shall be re-
carded in the Public Records of �he PirteT�as Ca�r�ty C�erk's
Office and shall constitute a lieri coequal with Che lien af ali
state, county� district and other municipal taxes, superior in
digni�y to a11 a�her Z9ens, �iCles and c�aims. until paid, and
sha17 bear interest at a ratQ not to exceed �en per cer�tu� (10�)
per annum from the date at tl�e end of the ariginal thirty (30)
days provided �� pay the assessment. The City shall be entitled
to recover a1] costs and a reasonable attorney's fee if it is
necessary ta enforce pa.Yment of such certificate and accrued
interes�. 5uch foreclosure proceeding shail be instituted and
prosecuted urder Chapter 173, Florida Stat�t�es.

in any direct ar collater�l procecding ins�ituted more thar� six �5)
months after the iss�sanc� of such certificate af indebtness by the
City.

�a) Initiation of Termination of S ecial Assessment �laintenance.

1. T�e Parks and Recreation Direc�or cietermir�es that there is na
1anger need for special assessment matntenanc� in a gea�
graphic area; or
2. At least fifty per cer��um (50�) of the praperty owners in a
. geographic area request the Parks and Recreation Oirec�or to
'termi nate tlte speci al assessr�ent mai nter�a�ce i n the
geographdc area. '
(b) Prelimir�ary Pub�ic Nearin ; Na�ice. Llpon id���ificatian of an
n eres n erm nat ng spec a assessment maintenar�ce in a geo-
graphic area, at ei�her initiative of the parks and Rpereation
Director ar of the Praperty owners as tn SecL•�or� 118.10 (a)
' above, the Parks and Recreation Dir�ctar shal� de�ignate time and
�lace for a preiiminary pubiic h�aring. Notice oF the prelim-
inary public hearing sha11 he mailed or otherwise given �o each
property owner of record in tliQ geographic area by the Parks and
Recreation Director� individualiy, and shall be advertised in a
newspaper af generai circulation in the municipality, both
individuaZ �otice and advertised no�ice being mai�ed or given at
� Zeast ten (10) days before the �ate of the �reliminary public
hearing. Bo�i� the individual natice and �he advertis�d natice
sha11•provi�e in�ormation that specia� assessment �aint�nance may
be ter�nina�ed and shall describe the geographic area in cammonly
understood terms� tlte type of elemen�s arid fixturPS that ar�
m��ntained, �he nature of �he mai�tenance, the est�mated total
cost af the special assessment maintenance, the approx�mate cost
per front �oot, the hour and date of �he he�ring, the ¢lace of
the hearing, and infarmation that the meeting is open to the
�ublic. 7he Parks and Recreation Dlrector sha11 cause the pre-
lim�nary public hearing ta be con�ucted in a manner that provides
an appor�unity �or �he varivus viewpoints amang thase present to
be expressed and nated. .
(c) City Commission Action. If at the discretion of the Parks ar�d
ecrea on rec or ere appears to be significant commun�ty
support or other reasan for t�rm�natir�g special assessment main-
tenance in a geagraphic area� t�e Parics and Recreation Director
sha11 farward an agenda item and, if appropriate, a corresponding
resalu�ion to the City Gommission. The agenda item may contain a
specific reco�tmendation fro� the Parks and Recrea�ion Director
regarding terminating t�e special assessment maintenance in a
geographic area ar may �ring the issue to the City Ca�mission
ti�rithau� re�ommendation and shall provide background informatian,
ir�formation on haw maintenance will be prov3de� without special
assessment mair�tenance, and a summary of the prelimirtary public
hearing including typical comments and a caunt of tne support for
artd against the termination uf the special assessment maintenance
amang those pruperty owners present at the preliminary public
heari ng. If the Par�,s and Recreat� on U� r�ctor de�er�ni n2s that i�.
is appropriate, a resalution sha11 also be prepared declaring the
