WHEREAS, it has been requested by Premier Properties, Inc., owner of certain real property in Section A, Unit No. 5 of Chautauqua Subdivision, in the City of Clearwater, Florida, that the City of Clearwater, Florida, vacate a certain portion of right-o£-way; and WHEREAS, after proper public notice and public hearing thereon, the City Commission finds that said right-of-way is not necessary nor required for municipal use and it is deemed to be to the best interest and advantage of the City and the general public that the same be vacated; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That the following: That portion of Sixth Avenue South, lying between the East right-of-way line of U. S. Highway 19 North and the West right-of-way line of First Street East, lying within Section A, Unit No. 5 of Chautauqua Subdivision as recorded in Plat Book 18, page 61 of the Public Records of Pinellas County, Florida, LESS any portion previously vacated by Pinellas County, be and the same is hereby vacated, closed and released, and the City of Clearwater hereby quit claims and releases all of its right, title and interest thereto to the persons, firms or corporations entitled thereto by law, excepting that the City of Clearwater hereby retains an utility easement over a portion of said described real property for the installation and maintenance of any and all public utilities thereon, which portion is described as follows: Commence at the SW corner of Section 32, Township 28 South, Range 16 East; thence run N 00°00158" E, along the West line of said Section 32, 1004.01 feet, to a point on the ,westerly extension of the South right-of-way line of Sixth Avenue South; thence run S 89'4711211 E, along said right-of- way line and its westerly extension, 431. 02 feet to the P. Florida Power Corporation has an East/West overhead electric transmission line supported by lattice steel towers which spans across the southerly tier of lots in Block 16 of said Section. A, Unit No. 5 of Chautauqua, immediately North of the platted right-o£-way of Sixth Avenue South. Using the centerline of this electric transmission line as a reference, the 20' by 40' easement is situated so that the 20' width will run from a location b9 feet South of said centerline to a location 109 feet South of said centerline, and the 40' length will be measured from the East right-of-way boundary of U. S. Highway No. 19 to a location 40 feet East of said East boundary. Section 2. That the City Clerk is hereby directed to record this ordinance in the Public Records of Pinellas County, Florida. z Section 3. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 4.
