WHEREAS, on March 17, 1983, the City Commission of the City of

Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the Zoning Ordinance of the City of Clearwater in
accordance with procedure as established; and
WHEREAS, the City Commission has fully considered the
recommendations and report of the Planning and Zoning Board relative to
the certain proposed changes to the Zoning Ordinance; and
WHEREAS, certain of the proposed changes and amendments to the
Zoning Ordinance were approved by the City Commission after its evaluation
of all evidence presented at the said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to ari adopted comprehensive plan or element thereof be reviewed by
the Local Planning Agency (LPA) for conformance with plans adopted
pursuant to the LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency :or Pinellas County and the FCFC
has adopted guidelines with reference to such required referral process; and
WHEREAS, this Ordinance has been referred to and considered by
the PCPC under said process;
NOW. THEREFORE, BE IT ORDALNED BY THE CITY

Section 1. The City Commission of the City of Clearwater;
Florida, finds it necessary to exercise the police power granted
by Article V111, Section 2 (b), Florida Constitution, as
implemented by Section 156.021, Florida Statutes, for the
following reasons:
(a) The City Commission recognizes that beaches grow and
recede according to the dictates of nature, and it is the desire
of the Commission to provide a setback that insures that building
or development will not take place on potentially unstable areas
so as to create a potential of danger to persons and property.
(b) The City Commission determines that the coastal area
such as fronts on the Gulf of Mexico is a place of critical
concern and the beaches which make up such coastal area must be
preserved from building encroachment in order that they can
properly function to protect against flood and storm dangers and
retain the aesthetically pleasing beach character for residents
and tourists, both of whom use the beach areas in large numbers.
(c) The City Commission further determines it is necessary,
in order to avoid irreparable alteration of the co3stal beach by
influencing the acretion and avulsion process through building
and related development activity, to establish a building setback
from such coasta3 beach area which is certain in character and
based on sound planning and engineering principles.
(d) The City Commission desires to preserve and protect the
tourist base of the Clearwater economy and to that end it
requires that setbacks be created such as will insure the
preservation of the natural beach asset that serves the tourist
economy, thereby protecting the general welfare. The Gulf
beaches of Clearwater are an economic resource vital to the
resort business which is a major component of the economic
vitality of the City of Clearwater.
(e) The City Commission determines that the beaches
fronting on the Gulf of Mexico are a major attraction to
residents and visitors of Clearwater and preservation of visual
access to such beaches and preventing the casting of shadows on
such beach areas from buildings built too close to the Coastal
Construction Control Line will promote aesthetic values vital to
the City of Clearwater,

(f) In order to afford maximum flexibility to property
owners with respect to any development rights that may exist in
the restricted coastal area, the City Commission hereby
determines that it is necessary to create a transfer of
development rights mechanism such as will allow for consideration
of the transfer of such rights to that most buildable portion of
any site; said measure designed to work in concert with the
setback provisions.
(g) The City Commission further recognizes the potential
need and utility to extend such transfer of development rights
process to property under one ownership that is separated by
a public right-of-way or Land Use Plan and/or Zoning District
boundary, and for that purpose establishes such transfer of
development rights process for said situations.
Section 2. Section 131.200, Waterfront Property Setback,
of Division 27, Supplementary Regulations, of Article III,
District Regulatio.ns, of Chapter 131, Zoning, of Title XI,
5u.ilding and Zoning Regulations, of the Code of Ordinances, City
of Clearwater, be and the same is hereby amended by amending
section 131.200 (b) (3) c. 1. and by adding a new subparagraph
"g" to read as follows:
