AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ANNEXING A PORTION OF LOT 14, CLEARWATER INDUSTRIAL
PARK, PINELLAS COUNTY, FLORIDA, TOGETHER WITH
ABUTTING RIGHT-OF-WAY, INTO THE CORPORATE LIMITS
OF THE CITY OF CLEARWATER, FLORIDA, AND REDEFINING
THE BOUNDARY LINES OF THE CITY TO INCLUDE SAID
ADDITION ACCORDING TO THE PROVISIONS OF THE CHARTER
OF THE CITY OF CLEARWATER, FLORIDA, AND THE LAWS
OF FLORIDA; AFTER PROPER PUBLIC NOTICE AND PUBLIC
HEARING THEREON, ESTABLISHING THE FIRE DISTRICT
CLASSIFICATION FOR SAID PROPERTY; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING
FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from Sunus Corporation Retirement Plan & Trust
requesting the.City to annex a certain parcel of real estate described here-
inafter, owned by it, into the corporate limits of the City of Clearwater,
Florida; and
WHEREAS, the City Commission, after due consideration of said
request for annexation, at a regular meeting held on January 20, 1983, voted
unanimously to accept said request and authorized the proper officials to set
up a public hearing thereon for the determination and establishing of fire
district classification and to prepare an ordinance to annex said parcel of
real estate into the corporate limits of the City of Clearwater in accordance
with the provisions of Chapter 171, Florida Statutes; and
WHEREAS, on March 3, 1983, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing for the
determination and establishment of fire district classification for said real
property; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to an adopted comprehensive plan or element thereof be reviewed
by the Local Planning Agency (LPA) for conformance with plans adopted
pursuant to the LGCPA; and

Section 1. After its evaluation of all evidence presented at a proper

Florida Statutes, hereby annexes into the corporate limits of the City of
Clearwater, Florida, and redefines the boundary lines of said City so as

to include the following described real property in Pinellas County, Florida,
and establishes fire district classification therefor:
A portion of Lot 14, Clearwater Industrial Park as
recorded in Plat Book 44, page 46, Public Records
of Pinellas County, Florida, more particularly described
as follows:
From the SE corner of Lot 14, Clearwater Industrial
Park as recorded in Plat Book 44, page 46, Public
Records of Pinellas County, Florida, as a point of
reference, said point also being on the westerly right-
of-way line of Belcher Road; thence N 00°04'51" W,
583. 68 feet to the P. O. B. ; thence leaving said line
N 69°Z5'561' W, 265.00 feet; thence N 00°04+51" W,
300. 00 feet to a point on the South line of Logan Street
(A 60' right-of=way); thence S 69°25'56'1 E, along said
line 265.00 feet to a point of intersection with afore-
mentioned West right-of-way line of Belcher Road;
thence S 00°04151" E, along said line 300.00 feet to
the P. O. B. ; together with abutting right-of-way of
Belcher Road.
The above described property is hereby designated
Fire District No. 1.
Section 2. The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in conformance with
the City's Comprehensive Plan and individual elements thereof adopted
pursuant to the LCCPA and directs that same be forwarded to the LPA for
their receipt and appropriate action.

Section 3. The City Commission hereby formally and according to
law, accepts the dedication of all casements, streets, parks, plazas, places,
rights-of-way and other dedications to the public which have heretofore been
made by plat, deed or user within the areas so annexed.
Section 4. The City Engineer, the City Clerk and the Planning
Director are directed to include and set out and show upon the official maps
and records of the City of Clearwater the foregoing property and the fire
district classification therefor.
Section 5. This ordinance and notice of the proposed enactment of
same has been properly advertised in a newspaper of general circulation in
accordance with Section 166.041, Florida Statutes, and Section 171.044,
Florida Statutes.
Section 6. This ordinance shall become effective immediately upon
its passage and enrollment in the City of Clearwater Ordinance Book and
a copy thereof being filed in the office of the Clerk'of the Circuit Court of
Pinellas County, Florida. In accordance with Section 171. 091, and Section
171. 044, Florida Statutes, a certified copy shall be filed with the Department
of State of the State of Florida.
