3052-83 - ?n 1 a F i ? lil rt +a ri ?J" ORDNANCE NO 3052-83 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING SECTION 133, 07, PERMIT FEE'S, OF CHAPTER 133, BUILDING CODE, OF TITLE XI, BUILDING AND ZONING REGULATIONS, OF THE CODE OF ORDINANCES, CITY OF CLEARWATER, BY PROVIDING A NEW PERMIT AND FEE FOR THE INSTALLATION OF A SOLAR WATER HEATING SYSTEM OF $10.00; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to the LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to each required referral process; and WHEREAS, this Ordinance has been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That subsection (a) of Section 133. 07, Permit fees, of Chapter 133, Building Code, of Title XI, Building and Zoning Regulations, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended and supplemented by the addition of a new subparagraph (7) to read as follows: V41W Tq- ?? (a) For all buildings, structures or alterations which required a building permit, the applicant shall at the time of filing an application pay a fee as required in the following schedule; (1) Where the valuation does not exceed twenty-five dollars ($25. 00), no fee shall be required unless an inspection is required, in which case there shall be a five dollar ($5.00) fee. (2) For the valuation of more than twenty-five dollars ($25. 00), to and including one hundred thousand dollars ($100, 000, 00), or fraction thereof, the fee shall be five dollar ($5. 00) base fee plus one-fourth of one per cent of the estimated cost. (3) For a permit for each additional one thousand dollars ($1, 000.00) valuation above one hundred thousand dollars ($100, 000.00), the permit shall be one-eighth of one per cent. (5) For the moving of any building or structure, the permit fee shall be twenty-five dollars ($25.00). (6) For mobile homes being located in either a mobile home park or mobile home subdivision, the building permit fee shall be five dollars ($5. 00). For a_permit for the installation of a solar water heating systemt_ the permit fee shall be ten dollars - 10.00. ' - - - „. , Section 2. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166. 041, Florida Statutes. Section 6. The provisions of this ordinance shall take effect immediately upon its passage.
