ORDINANCE NO. 3048-83
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING SECTION 1 AND SECTION 2 OF ORDINANCE NO.
2019 TO AMEND GOALS AND OBJECTIVES OF THE LAND
USE ELEMENT OF THE COMPREHENSIVE PLAN TO CLARIFY
THE CONSISTENCY BETWEEN THE LAND USE CATEGORIES
MAINTAINED ON THE CITY AND COUNTY LAND USE
PLANS: PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, a possible discrepancy has been observed in regard
to administration of the Residential/Office/Retail (ROR) category which
is used by the Pinellas County Planning Council, but not by the City; and
WHEREAS, it is necessary that strict consistency be established
between the ROR category as applied on the County-wide Land Use Plan
and the Commercial/Tourist Facilities category as applied on the Clearwater
Land Use Plan; and
WHEREAS, it is necessary to amend Goals and Objectives of the
Land Use Element to accomplish this objective;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section I of Ordinance No. 2019 be and the same
is hereby amended to read as follows:
The land use element of the comprehensive plan as
required by the "Local Government Comprehensive
Planning Act of 197511, as amended, and as set forth
in the attached exhibit, described as:
Composite Exhibit A - Document entitled
"Land Use", consisting of a table of contents
sheet and sixty-six (66) pages in addition to a
map, color coded, entitled 111995 Clearwater
Tomorrow--The Clearwater Comprehensive
Land Use Plan", including amended Page 6
providing for the following additions:
Goal: Establish a land development guidance
system which is both responsive to local needs
and is consistent across jurisdictional boundaries.
Objective: Continue to work within the Legislative
framework which established the Pinellas Count
Planning Council in the most expeditious manner. possible.

been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.

Section 4. All public hearings and public participation required
pursuant to Section 163. 3181, Florida Statutes, and Section 163. 3184,
Florida Statutes, has preceded the consideration of this ordinance.
Section S. This ordinance is hereby adopted and shall be considered
henceforth adopted for the purposes of Section 163. 3184 (7), Florida Statutes,
and shall become effective immediately upon its passage.

AMENDING CHAPTER 131, ZONING, OF TITLE XI, BUILDING
AND ZONING REGULATIONS, OF THE CODE OF ORDINANCES, `
CITY OF CLEARWATER, TO AMEND CP PARKWAY BUSINESS
DISTRICT AREA AND DIMENSION REGULATIONS TO ASSURE
CONSISTENCY WITH PINELLAS COUNTYIS RESIDENTIAL/
OFFICE/RETAIL LAND USE PLAN DESIGNATION; PROVIDING
FOR THE SEPARABILITY OF THE PROVISIONS HEREOF;
PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS ?
OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMENT; AND PRO-
VIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, on February 17, 1983, the City Commission of the City

of Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the Zoning Ordinance of the City of Clearwater in f~
accordance with procedure as established; and
WHEREAS, the City Commission has fully considered the :.
recommendations and report of the Planning and Zoning Board relative to

the certain proposed changes to the Zoning Ordinance; and
WHEREAS, certain of the proposed changes and amendments to the
Zoning Ordinance were approved by the City Commission after its evaluation v
of all evidence presented at the said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to an adopted comprehensive plan or element thereof be reviewed by
the Local Planning Agency (LPA) for conformance with plans adopted
pursuant to the LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the PCPC
has adopted guidelines with reference to such required referral process; and
WHEREAS, this Ordinance has been referred to and considered by INNN =.4 ??I
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:

Section 1. That Section 131. 136, Area and dimension regulations,
of Division 19, CP Parkway Business District, of Article III, District
Regulations, of Chapter 131, Zoning, of Title XI, Building and Zoning
Regulations, of the Code of Ordinances, City of Clearwater, is hereby
amended to add a new sub-section (3) to read as followss
Special requirements applicable to all CP districts
where the County Land Use Plan designates. an area.
under the Residential/Office'/Retail plan category
shall be as follows:
a Residential and hotel/motel facilities are
limited to fifteen (15) units. per net acre
b. A maximum of fifty per cent (5076) of the site. may
be covered in impervious surface; and
c. In the case of retail or office usage, a maximum
floor area ratio (FAR) of two-tenths (. Z) maybe
substituted for the restriction regarding impervious
surface coverage. In this event the otherwise
applicable maximum impermeable surface coverage
reouirement of seventy-five per cent (75%6) shall app
Section 2. The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in conformance with
the City's Comprehensive Plan and individual elements thereof adopted pursuant
to the LGCPA and directs that same be forwarded to the LPA for their
receipt and appropriate action.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166. 041, Florida Statutes.
