AN ORDINANCE AMENDING THE ZONING A'T'LAS OF THE
CITY OF CLEARWATER, FLORIDA, 1983, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR PROPER NOTICE OF PRO-
POSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on February 17, 1983, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing on certain
proposed changes to the zoning atlas of the City of Clearwater in accordance
with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its evaluation of
all evidence presented at the said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to an adopted comprehensive plan or element thereof be reviewed
by the Local Planning Agency (LPA) for conformance with plans adopted
pursuant to the LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the PCPC
has adopted guidelines with reference to each required referral process; and
WHEREAS, this Ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning
Atlas of the City of Clearwater, Florida of 198311, as amended, is amended
to indicate that fact as hereinafter set out:

Zoned RPD-15 - Residential Planned Development District
A tract of land lying in the SE 1/4 of Section 17, Township
28 South, Range 16 East, Pinellas County, Florida, and being
more particulary described as follows:
Commence at the NE corner of the SE 1/4 of said Section 17,
thence N 89.50142" W along the East-West centerline of said
Section 17, also being the centerline of Curlew Road, for
1136.96 feet; thence S 00.31150't E, for 55.00 feet, to a point
on the southerly right-of-way line of Curlew Road, being the
P. O. B. ; thence S 00°31'50" E, for 831. 19 feet, to a point on
the North line of the Plat of Countryside Tract 60, as recorded
in Plat Book 80, pages 78 through 81, of the Public Records of
Pinellas County, Florida; thence .S 89 °28' 10't W along said North
line, for 415. 00 feet, to a point on the East line of, Countryside
Boulevard, a 100-foot right-of-way, as shown on the Plat of
Countryside Tract 57, as recorded in Plat Book 79, pages 10
and 11, of the Public Records of Pinellas County, Florida;
thence N 00°31150" W along said right-of-way line, for 810.85
feet, to a point of curvature of a curve concave to the Southeast;
thence continue along said right-of-way line and the arc of said
curve, having a radius of 25.00 feet and a central angle of
90°4110811, for 39.57 feet; thence N 00°09'1811 E, for 5.00 feet,
to a point on the southerly right-of-way line of Curlew Road;
thence along said southerly right-of-way line the following
three (3) courses: (1) thence S 89°50'42" E, for 254.30 feet;
(2) thence S 00°09'18" W, for 5.00 feet; (3) thence S 89.5014211
E, for 135.43 feet, to the P. O. B.
Section 2. The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in conformance
with the City's Comprehensive Plan and individual elements thereof adopted
pursuant to the LGCPA and directs that same be forwarded to the LPA for
their receipt and appropriate action.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same.shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section if 6. 041, Florida Statutes.
