3013-83 0 .rs' ORDINANCE NO. 3013`83 Article II, Removal of Chapter 98, Tree Protection, of Title VIII, Public Health and Safety, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: Sec. 98. 21. Application and submission. (a) Any person desiring a permit to remove a tree or mangrove as required by this chapter shall make written application to the pabli-o-w•o-rk-s-parks and recreation director or his designee on application forms to be provided by the ptiblic»wo-rc- parks and recreation department, envirore eartal4-aanagemeot•ci!y forester's office. Such application, when completed and signed by the party to be held responsible for the proposed tree removals, shall be returned to the pah1i?-wo-xk-e parks and recreation director or his designee, together with a filing fee as established by the city commission for each tree proposed for removal. In addition to completing the application forms, the peblio-was-parks and recreation director or his designee may require the applicant to submit any or all of the following additional documentation: (1)A site plan showing the location of all trees and mangroves, the tree or trees proposed to be removed, existing and proposed structures, walks, driveways, parking areas and other improvements. That Section 98. 23, Relocation or replacement, of Article F 1 Y II, Removal, of Chapter 98, Tree Protection, of Title VIII, Public Health and Safety, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: Sec. 98.23. Relocation or replacement. (a) Specifications. (1) Characteristics. The replacement tree(s) shall have at least equal shade potential, screening properties, and/or other characteristics comparable to that of the tree(s) requested to be removed. (2) Size. Replacement tree(s) are to be made according to a standard of one inch DBH total replacement of each one inch DBH removed, unless otherwise agreed upon by both the city enforcement officials and applicant, or as provided in subsection (b). Any number of trees may be utilized to meet the inch-for-inch requirement, provided acceptable spacings and design are maintained. (3) Species. The species of the replacement tree(s) may be required to be the same as those being requested for removal from the natural environment, or may be required to be of a species native to the West Central Florida area. Exotic, "naturalized" tree(s), or palms may be used to meet replacement requirements only through the consent of the city enforcement officials. The city enforcement officials may waive the species, size, or minimum standards specifications if the applicant can demonstrate that the current market conditions are such that replacement tree(s) meeting these specifications are not readily available. For all single- family and duplex lots, a minimum number of replacement trees will be required based on the following square footage areas. Any removal of tree(s) will require that up to this rninimum number be replaced. In no instance shall the tree or trees required to be replaced exceed the number of trees existing on the property at the time of granting the tree removal permit. On residential multi- family development projects, a minimum of one tree must be replaced for each tree permitted removal in excess of fifty (50) per cent of those protected trees which exist naturally on the site, (3) Nonresidential tracts. On commercial, commercial tourist facility, industrial, semi-public, professional, or related nonresidential zoned property to be developed, a minimum of one tree must be replaced for each tree permitted removal in excess of twenty-five (25) per cent of those protected trees which exist naturally on the site. (4) Mixed-use zoned properties. Properties zoned for mixed land usages shall require replacements according to the intended use per a site plan approved by the city commission, or the replacements requirement paragraph requiring the largest number of replacement trees. (5) Location and design. Trees planted in compliance with the requirements of section 131, 221 regarding the landscaping of vehicle parking areas associated with new development projects may also be credited towards meeting the tree replacement requirements of this section. ,; (d) Establishment. (1)Any and all trees replaced or relocated per this section must be in a health, living condition within one year of the date of planting. Replacements that have not become established, have declined to an unhealthy condition to such a degree that survival is not probable, or have expired must be replaced with a healthy specimen per the requirements in subsection (a). Such replacements must continue until a tree is established at the approved location. (2) Compliance. Replacement trees not in compliance with the establishment provisions of subsection (d) (1) are to be referred to the municipal code enforcement board (s ee sections 22. 60 through 22. 70). Failure to comply with all other provisions of this section will result in a withholding of a certificate of occupancy by the building director for structures located on the subject property until compliance is achieved. Section 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid.
