ORDINANCE NO. 3010-83 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING SUB-SECTION 177.000, THEATER, OF SECTION 71.13, SCHEDULE OF FEES, OF CHAPTER 71,..LICENSES, OF TITLE VII, BUSINESSES AND BUSINESS REGULATIONS, OF THE CODE OF ORDINANCES, CITY OF CLEARWA TER, TO CLARIFY THE INTENT OF THE CATEGORY BY PROVIDING A DEFINITION OF ITS SCOPE; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT- OF SUCH CONFLICT; DECLARING THAT A PUBLIC EMERGENCY EXISTS AFFECTING THE HEALTH AND WELFARE OF THE CITIZENS OF THE CITY OF CLEARWATER; PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the present sub-section of the license code relating to theaters needs clarification with respect to the intent of the classification; and WHEREAS, some confusion has arisen in the past in utilizing the code as written; and WHEREAS, an emergency exists within the City of Clearwater in that it is immediately necessary to clarify the intent with respect to such license category thereby providing all parties with a clear understanding of when such category may be granted, thereby preserving the welfare of the citizens of the City of Clearwater; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEAR WATER, FLORIDA: Section 1. That sub-section 177.000, Theater, of Section 71. 13, Schedule of Fees, of Chapter 71, Licenses, of Title VII, Businesses and Business Regulations, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: Sec. 71. 13. Schedule of fees. 177.000 THEATER: is a building specially adapted to dramatic, operatic plays, concerts, musicals or movies containing a slo ed floor with tiers or rows of seats or an outdoor location containing rows of speakers for attachment to automobiles parked next to each speaker. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 3. This ordinance is adopted as an emergency ordinance pursuant to Section 166. 041, Florida Statutes, and the Clearwater City Charter. Section 4. It is hereby found, determined and declared that this ordinance is necessary and urgently needed for the preservation of the welfare of the citizens and inhabitants of the City of Clearwater, Florida, in that passage of this ordinance is needed in order to clarify the meaning and intent of the code thereby providing certainty in the application of the code by the license department which must function on a day-to-day basis utilizing the code by reason of such fact an emergency is hereby declared; and that this ordinance shall be in full force and effect immediately upon its passage'. This ordinance shall automatically expire ninety (90) days from the date of its passage unless the ordinance is submitted during such time for consideration as a non-emergency ordinance.
