ORDINANCE NO. 2899-82

AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A CERTAIN PORTION OF RIGHT-OF-WAY IN
BELL EAIR• SUBDIVISION, PINELLAS COUNTY, FLORIDA;
PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, it has been requested by the City of Clearwater, owner
of certain right-of-way in Belleair Subdivision, in the City of Clearwater,
Florida, that the City of Clearwater, Florida, vacate a certain portion
of right-of-way; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said right-of-way is not necessary nor
required for municipal use and it is deemed to be to the hest interest and
advantage of the City and the general public that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA;
Section 1. That the following:

That portion of Hamlet Avenue right-of-way lying
Northwest of the Westerly right-of-way line of the
Seaboard Coast Line Railroad and South of vacated
"B" Street, in Belleair Subdivision, according to
the map or plat thereof as recorded in Plat Book 1,
page 105 of the Public Records of Hillsborough County,
Florida, of which Pinellas County was formerly a part,

be and the same is hereby vacated, closed and releases , and the City of
Clearwater hereby quit claims and releases all, of its right, title and .
interest thereto to the persons, firms or corporations entitled thereto '
by law, excepting that the City of Clearwater hereby retains a drainage and
utility easement over said described real property for the installation and
maintenance of any and all public utilities thereon.
Section 2. That the City Clerk is hereby directed to record this
ordinance in the Public Records of Pinellas County, Florida.
Section 3., Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.

advantage of the City and the general public that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CI-F-kR`VATER, FLORIDA:
Section 1. That the following:
That portion of Hamlet Avenue right-of-way lying
1^ ?_ Northwest of the Westerly right-of-way lime of the
Seaboard Coast Line Railroad and South of vacated
,i ?•,,• "B" Street, in Belleair Subdivision, according to
the map or plat thereof as recorded in Plat Book 1,
page 105 of the Public Records of Hillsborough County,
Florida, of which Pinellas County was formerly a part,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and
interest thereto to the persons, firms or corporations entitled thereto
by law, excepting that the City of Clearwater hereby retains a drainage and
utility easement over said described real property for the insta!lation and
maintenance of any and all public utilities thereon.
