ORDINANCE NO 2883-82
AN ORDINANCE AMENDING THE ZONING ATLAS OF
THE CITY OF CLEARWATER, FLORIDA, 1982, AS
AMENDED, BY ZONING CERTAIN PROPERTY RECENTLY
ANNEXED INTO THE CITY OF CLEARWATER, AS
DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH TO THE EXTENT OF SUCH
CONFLICT; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMENT; AND
PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS, on October 7, 1982, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing for the
determination and establishment of zoning classifications for certain
property annexed into the City of Clearwater in accordance with procedure
as established; and
WHEREAS, certain of the amendments to the zoning atlas for
establishing zoning for such newly annexed real property were approved by
the City Commission after its evaluation of all evidence presented at the
said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to an adopted comprehensive plan or element thereof be reviewed by
the Local Planning Agency (LPA) for conformance with plans adopted pursuant
to LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the PCPC has
adopted guidelines with reference to such required referral process; and
WHEREAS, this Ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater, Florida,
is hereby classified and zoned as hereinafter indicated, and "The Zoning
Atlas of the City of Clearwater, Florida of 198211, as amended, is amended
to indicate that fact as hereinafter set out:

The North 500 fact of the following described property:
A tract of land lying in the SE 1/4 of the SW 1/4 of Section
23, Township 29 South, Range I5 East, in Pinellas County,
State of Florida, and being more particularly described as
follows: Commence at the NE corner of the SE 1/4 of the
SW 1/4 of said Section 23 and run N 89°07'57" W, along the
centerline of Nursery Road, also being a 40 acre line, a
distance of 800.38 feet to a point; leaving said centerline and
40 acre line run S 0°21'40" E, a distance of 50.01 feet to
the South right-of-way line of Nursery Road and the P. O. B.;
thence leaving said right-of-way line, continue S 0°21140" E,
a distance of 1029.93 feet to a point; thence run S 0°44'35" W,
a distance of 192. 00 feet to a point, said point being on the
North right-of-way of Belleair Road; thence run N 89°15'25"
W, along Said North right-of-way, a distance of 295. 11 feet
to a point; leaving said North right-of-way, run N 0 ° 19 1 17"
W, a distance of 192.03 feet to a point; thence run N 89°
15125" W, a distance of 200.00 feet to a point, said point
being on the East right-of-way of Highland Avenue; thence run
N 0°19'I7" W, along said East right-of-way, a distance of
1031.00 feet to a point intersecting the South right-of-way
of Nursery Road; thence run S 89°07'59" E, along the afore-
mentioned South right-of-way, a distance of 497.98 feet
to the P. O. B.
Section 2. The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in conformance with
the City's Comprehensive Plan and individual elements thereof adopted pursuant
to the LGCPA and directs that same be forwarded to the LPA for their receipt
and appropriate action.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166. 041, Florida Statutes.
Section 6. The Planning Director is directed to include and set out
and show upon the official zoning atlas of the City of Clearwater the foregoing
amendment as hereinabove set out.
