AN ORDINANCE; OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING DIVISION I5, PLANNED DEVELOPMENT DISTRICTS,
OF ARTICLE III, DIS'T'RICT REGULATIONS, OF CHAPTER
131, ZONING, OF TITLE XI, BUILDING AND ZONING
REGULATIONS OF THE CODE OF ORDINANCES, CITY OF
CLEARWATER, TO ADD A CATEGORY OF OFFICE PLANNED
DEVELOPMENT AND TO ADD THE USES OF CONGREGATE
LIVING FACILITIES, NURSING HOMES AND LIKE FACILITIES
AS COMPLEMENTARY LAND USES WITHIN THE RESIDENTIAL
PLANNED DEVELOPMENT DISTRICT; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING
FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDI-
NANCES IN CONFLICT HEREWITH; PROVIDING FOR PROPER
NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR
THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, on October 7, 1982, the City Commission of the
City of Clearwater, after proper public notice, held a public hearing on
certain proposed changes to the Zoning Ordinance of the City of Clearwater
in accordance with procedure as established; and
WHEREAS, the City Commission has fully considered the
recommendations and report of the Planning and Zoning Board relative to
the certain proposed changes to the Zoning Ordinance; and
WHEREAS, certain of the proposed changes and amendments to the
Zoning Ordinance were approved by the City Commission after its evaluation
of all evidence presented at the said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments thereto
related to an adopted comprehensive plan or element thereof be reviewed by
the Local Planning Agency (LPA) for conformance with plans adopted
pursuant to the LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the PCPC
has adopted guidelines with reference to such required referral process; and
WHEREAS, this Ordinance has been referred to and considered by
the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA-

Sec. 131. 104. General description,
(a) Purpose. The planned development districts are

? created to provide optional methods of land development

? which encourage more imaginative solutions to design

? enhanced land utilization and reduction of conflicts between
land uses.
(b) Categories, The following categories of planned
development districts are permitted:
(1) Residential Planned Development (RPD);
(Z) Recreational, Planned Development RecPD);
(3) Office Planned Development (OPD);
¢3 ? (LCommercial Planned Development (CPD);
(4)-- U.3Industrial Planned Development (IPD); and
f5)-Any combination of the above individual planned
development districts.
(c) Minimum area requirements.
(1) Residential planned developments shall require a
minimum of four (4) acres; however, if fifty (50)
per cent or more of an area to be zoned RPD is for
renewal or rehabilitation purposes, then the city
commission may approve such RPD with less than
four (4) acres in area.
(Z)Recreational planned developments shall require a
minimum of twenty-Ave-(2-r>) five 5 acres.
(3) Office planned developments shall require a minimum
of five (5) acres.
{&)- ?Cornmercial and industrial planned developments
shall require a minimum of €w?t?-04} £ive 5 acres.
(4} MAny combination of planned development districts shall
require a minimum acreage equal to the sum of their
individual requirements.
(d) Features.
(1) Residential areas thus established would be characterized
by a unified building and site development program
illustrating greater flexibility in design with provisions

for open space and recreation. Other complementary
land Se ,tures_uses, depending upon the size of the
development, may include areas for commercial,
religious, educational and cultural activities,
congregate living, nursing home, and like facilities:
all of which are integrated into the total project,
(2) Recreational planned developments may include public
and private recreation and open space uses, including
but not limited to golf courses, ball fields, tennis
courts, stadiums, club houses, commercial recreation
facilities and their support functions designed and
integrated with adjoining uses on a planned basis.
(3) Commercial, office and industrial planned districts
would permit such uses in a manner so as to allow for
improved arrangement of retail, professional and business
office or industrial use, or combination thereof. The
advantages of the commercial, office and/or industrial
development are very similar to the RPD in respect
to design flexibility, improved land utilization with
complementary functions and especially reduction of
traffic movement problems. The' manufacturing planned
development shall not include refining or manufacture
of petroleum products as prohibited in sections 131. 160
and 131.169.
(4) Combinations of the individual types of planned districts
feature the planned integration of the proposed individual
types of land use to be accommodated in a compatible
manner.
Section Z. That Section 131. 106, Combination residential,
recreational, commercial, industrial districts, of Division 15, Planned
Development Districts, of Article III, District Regulations, of Chapter 131,
Zoning, of Title XI, Building and Zoning Regulations, of the Code of Ordinances,
City of Clearwater, be and the same is hereby amended to read as follows:
Sec. 131. 106. Combination residential, recreational, office,
commercial, industrial districts.
A multistructure combination site development master:pla•ri-aHall
be submitted prior to building permit issuance when such
combination planned development district involves the con-
struction and/or use of a combination of the individual
categories of planned development, the acreage of which
exceeds the total of the individual acreage requirements
for each category. Such plan shall conform to the applicable
requirements set out in section 131. 107.

(6) Off-street parking requirements in accordance with usage

(7) acres shall provide a minimum of ten (10) per cent of
gross area for recreation, in excess of seven (7) acres,
fifteen (15) per cent of such total area shall be provided;
(8) In OPD/CPD/IPD a market analysis may be required for
supporting evidence of need for office, business and/or
industrial uses where such designation involves a Land_
Use Plan amendment; -
(9) Waterfront lots requirements in accordance with section
131.200;
(10) Community impact statement. See section 131, 223.

(a) The contents in section 131. 108 shall be submitted as
the plan for initial zoning. Upon receiving the planned.
development zoning, subplans, if considered as independent
units, may be approved separately for further processing r H,
by the planning and zoning board, city engineering depart- r't
ment, and any other agencies affected. Subplans,, if con- . 0t
si.dered as separate units, may have separate final approval r
by the planning and zoning board, city departments and the
city commission but shall, at the time of approval, be
committed to a time schedule. }
(b) The plan intent shall become effective and operative upon '
final approval by the city commission for planned unit r
development zoning. The city commission, upon granting
RPD, RecPD, OPD, CPD or IPD or combination type zoning, r,
shall at the same public hearing determine any further public
hearing or public meeting requirements involving the final
plan adoption, or subpian adoption, if considered as independent`
units, or shall assign in lieu thereof, responsibility for
administrative review of the final plan, or subplans, before w? ,<
official acceptance by the city commission at a public meeting. dd
Such assignment action by the city commission at the prezoning '
public hearing eliminates an advertised public hearing on the ,' r<
final plan and thus overrules such procedure sett out in section
131.110 (c). The above public hearing requirement determination

may be based upon the following criteria -(but not limited thereto):
(1) The completeness of the information and plan status at

the zoning public hearing;
(z) The size and proposed density of the project;
(3) The peripheral accesses and traffic patterns so created
or produced;
(4) The nature and effect of the development upon existing
and future utility extensions or city services; ,
(5) The extent or effect of the proposed development upon
and the concern of abutting property ownership (such as
architectural renderings, fences, buffering hedges,
recreational facilities, etc, ).

Section 6. The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in conformance with
the City$ s Comprehensive Plan and individual- elements thereof adopted pursuant
to the LGCPA and directs that same be forwarded to the LPA for their
receipt and appropriate action.
Section 7. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section B. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 9. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 10. The provisions of this ordinance shall take effect
immediately upon its passage.
