ORDINANCE NO. 2877-82
AN ORDINANCE OF THE CITY OF CLEARWATER,
VACATING A PORTION OF A DRAINAGE AND
UTILITY EASEMENT IN TIMBER RIDGE OF
COUNTRYSIDE, UNIT TWO, PINELLAS COUNTY,
FLORIDA; PROVIDING FOR PROPER NOTICE OF
PROPOSED ENACTMENT; AND PROVIDING FOR
THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, it has been requested by Frank C. Brunner, owner of
certain real property in Timber Ridge of Countryside, Unit Two, in the City
of Clearwater, Florida, that the City of Clearwater, Florida, vacate a portion
of a certain drainage and utility easement; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said portion of the easement is not necessary
nor required for municipal use and it is deemed to be to the best interest and
advantage of the City and the general public that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
The West 7 feet of the North 60 feet of the South 80 feet
of a twenty-foot easement on the rear of Lot 55, Timber
Ridge of Countryside, Unit Two, according to the map or
plat thereof as recorded in Plat Book 75, pages 67 and 68,
of the Public Records of Pinellas County, Florida, '
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and
interest thereto to the persons, firms or corporations entitled thereto
by law.
Section 2. That the City Clerk is hereby directed to record this
ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166. 041, Florida Statutes.
