I 1 F ORDINANCE NO. 2863-82 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ARTICLE 11, PUBLIC SERVICE, TAX, OF CHAPTER 44, TAXATION, OF TITLE IV, FINANCE AND TAXATION, OF THE CODE OF ORDINANCES, CITY OF CLEARWATER, TO DELETE THE EXCLUSION OF FIRST FIFTY KILOWATT HOURS OF ELECTRICITY FROM PUBLIC SERVICE TAX LEVIED , PURSUANT TO SECTION 166. 231, FLORIDA STATUTES; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDI- NANCES IN CONFLICT HEREWITH; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, it is necessary to amend the code section set out below to conform with change contained in Section 166. 231, Florida Statutes; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEAR WATER, FLORIDA: Section 1. That Section 44. 20, Levy, of Article II, Public Service Tax, of Chapter 44, Taxation, of Title IV, Finance and Taxation, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: Sec. 44.20. Levy. (a) There is levied by the city on every purchase in the city of electricity, metered or bottled gas (natural, liquefied petroleum gas or manufactured), water service, and local telephone service, a tax of ten (10) per cent of the payments received by the seller of the item taxed by this section from the purchaser for the purchase of such service. The tax levied hereunder shall be collected by the seller of the item subject to this tax from the purchaser at the time of payment for such service. (b) There is hereby further levied by the city a tax on every purchase in the city of fuel oil at the rate of four cents ($0.04) per gallon which tax shall in every case be paid by the purchaser of fuel oil to the seller of fuel oil The tax levied herein on fuel oil shall be collected by the seller of fuel oil from the purchaser at the time of payment for such service. The term "fuel oil" as used herein shall include fuel oil grade Nos. 1, 2, 3, 4, 5 and 6, kerosene and coal oil.
