AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING SECTION 20-3 DEFINITIONS, SECTION 20-9,
JURISDICTION, and Section 20-10 PROCEDURE FOR PLAT
APPROVAL, OF ORDINANCE NO. 1444 TO PROVIDE A
DEFINITION OF SUBDIVIDER AND CLARIFY THE DEFINITION
OF A SUBDIVISION; TO CLARIFY THE JURISDICTIONAL
STATEMENT AND REMOVE CONFLICT WITH DEFINITION
OF SUBDIVISION AND TO REMOVE CONFLICT IN PROCEDURE
WITH THE DEFINITION OF TERM SUBDIVISION; PROVIDING
FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF
SUCH CONFLICT; DECLARING THAT A PUBLIC EMERGENCY
EXISTS AFFECTING THE HEALTH AND WELFARE OF THE
CITIZENS OF THE CITY OF CLEARWATER; PROVIDING
FOR THE EFFECTIVE DATE OF THIS ORDINANCE; AND
PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT.
WHEREAS, our present subdivision regulations are contained in
Ordinance No. 1449; and
WHEREAS, confusion has persisted relating to the application of
such regulations; and
WHEREAS, it is necessary to amend such ordinance to better clarify
the time when such regulations shall apply; and
WHEREAS, an emergency exists within the City of Clearwater in

that it is immediately necessary to clarify with certainty the time or
situation under which the subdivision regulations will apply thereby providing
parties with a clear understanding of when such law will apply thereby
preserving the welfare of the citizens of the City of Clearwater,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION CE THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 20,3, Definitions, of Ordinance No, 1449 be
and the same is hereby amended to read as follows:
"Section 20.3. Definitions,
Subdivider. An person who 1 having an interest in land
causes it, directly or indirectly, to be divided into a sub-
division or who JZ) directly or indirectly, sells, leases, or
develops,oroffers to sell, lease. or develop, or advertises
for sale, lease or devela ment, an interest. lot, parcel site

Any land, vacant or improved, which_ is divided or_hroposed_ to
be divided into two (2) or more lots, parcels, sites, units, plots,
or interests for the purpose of offer, sale, lease, or development,
either on the installmentplan or upon any_ and all other plans,
terms, and conditions, including resubdivision. Subdivision
includes the division or development of residential and nonresidential
zoned land, whether by deed, metes and bounds description, devise,
intestacy, lease, map, plat,. or other recorded instrument.
The following three exceptions shall be exempt:
{
1. The public acquisition of strips-of land for the widening
of existing streets;
2. The combination or recombination of portions of pre-
viously platted lots where no new 2arcels or residual
parcels smaller than any of the original lots are created.
3. The transference of part of one lot or tract to an adiacent
lot or tract. provided, that such transference does not
reduce any lot or tract to an area or a width less than
the minimumspecified in this Ordinance or less than
that of the zone classification in which it lies.
Section 2. That Section 20-9 Jurisdiction of Ordinance No. 1449 be

These regulations shall govern apply to all subdivisions
of land, as defined herein, located within the corporate limits

Any owner of land within this area wishing to subdivide land
shall submit to the Planning Board and City Engineer, a plat
of the subdivision according to the procedures outlined in
Section 20-10, which plat shall conform to the minimum
requirements set forth in Section 20-11. Improvements shall
be installed as required by Section 20.12 of these standards. t'

subdivision of land is proposed, before any contract is made
for the sale of any part thereof, and before any permit for
the erection of a structure in such proposed subdivision -
shall be granted, the subdividing owner, or his authorized
agent, shall_apply for and secure approval of such proposed
subdivision. Such subdividing owner shall submit a plan of
such proposed subdivision to the Planning and Zoning Board,
City Engineer and Traffic Engineering Department for approval
and shall obtain such approval prior to the filing of his sub-
division plat for record. Any such plat of subdivision shall
conform to the minimum standards of design for the sub-
division of land set forth in Section 20-11 of these standards
and shall be presented in the manner specified in the follow-
ing sections of this Section. No plat of a subdivision of land
within the area of planning jurisdiction shall be filed or re-
corded by the County Clerk without the approval of the City
Commission as specified herein.

2. In order to secure review and approval by the Planning
and Zoning Board of a proposed subdivision plat, the prospective
subdivider shall, prior to the making of any street improvements
or installations of utilities, submit to the Planning Department,
City Engineer, and Traffic Engineering Department a preliminary
plat as provided in Section B of this Section. On approval of said
preliminary plat and final construction plans, he may proceed
with the preparation of the final plat and other documents
required in connection therewith as specified in Section C
of this Section and the improvements set forth in Section
20-12. Prior to the sale of any parcels of land, the
developer must have fulfilled the requirements as stated
in Section 20-12, Paragraphs A and B.
3. A basic administrative review fee shall be submitted with
all subdivision applications up to and including twenty-five
lots. Subdivisions in excess of twenty-five lots shall re-
quire additional fee per lot for each lot in excess of
twenty-five. Such fee shall be paid to the City of Clearwater
being submitted to the Planning Department.
4. Record Plat Filing fees shall be paid to the City of Clearwater
at an established rate per acre or any part thereof. County
Clerk Recording fees are to be paid by the developer to the
City Engineering Department at time of submittal of linen
original for signature of City Manager (Supervisor of Plats).

Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section S. This ordinance is adopted as an emergency ordinance
pursuant to Section 166. 041 Florida Statutes, and the Clearwater City Charter.
Section 6. It is hereby found, determined and declared that this
ordinance is necessary and urgently needed for the preservation of the welfare
of the citizens and inhabitants of the City of Clearwater, Florida, in that
passage of this ordinance is required in order to clear up a conflict in Ordinance
No. 1449.as it would apply to proposed and future development, thereby
providing certainty in its application; by reason of such fact an emergency
is hereby declared; and that this ordinance shall be in full force and effect
immediately upon its passage. This ordinance shall automatically expire
ninety (90) days from the date of its passage unless the ordinance is submitted
during such time for consideration as a non-emergency ordinance.
Section 7. Notice of the proposed enactment of this ordinance has been
properly advertised in a newspaper of general circulation in accordance with
Section 166. 041, Florida Statutes.

WHEREAS, confusion has persisted relating to the application of
such regulations; and
WHEREAS, it is necessary to amend such ordinance to better clarify
the time when such regulations shatl apply, and
WHEREAS, an emergency exists within the City of Clearwater in
that it is immediately necessary to clarify with certainty the time or
situation under which the subdivision regulations will apply thereby providing
parties with a clear understanding of when such law will apply thereby
preserving the welfare of the citizens of the City of Clearwater,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION CF THE CITY OF CLEARWATER, FLORIDA;
Section 1. That Section 20-3. Definitions, of Ordinance No. 1449 be
and the same is hereby amended to read as follows:
"Section ZO•-3. Definitions.
Subdivider. _An_y_peraon who(l)having an interest in land
causes it, directiv or indirectly, to be divided into a sub-
division or who (2) directly or indirectly, sells, leases, or
develops, or offers to sell, lease, or develop, or advertises
for sale,. lease or development, any interest, lot. parcel site
unit or ]21ot in a subdivision or who (3) engages directly throw
an agent in the business of selling, leasing. developing, or of
ferinK for sale, lease, or development a subdivision or any
interest,- lot, parcel site, unit. or plot in a subdivision, and
who {4) is directly or indirectly controlled by. or under
direct or indirect common control with anv. of the foregoing.

STATEMENT AND REMOVE CONFLICT WITH DEFINITION
OF SUBDIVISION AND TO REMOVE CONFLICT IN PROCEDURE
WITH THE DEFINITION OF TERM SUBDIVISION; PROVIDING
FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF

includes the division or development of residential, and nonresidents
zoned land, whether b deed, metes and bounds description, devise,
intestacy, lease, ma j2, plat, or other recorded instrument. "
The following three exceptions shall be exempt:
1. The ublic acquisition of stri s of land for the widening
of existing streets;
2. The combination or recombination of ortiona of pre-
viously_ platted lots where no new parcels or residual
arcels smaller than anrof the on final lots are created.
3. The transference of part of one lot or tract to an adjacent
lot or tract; provided, that such transference does not
reduce, apx lot or tract to aim area or a width less than
the minimum specified in this Ordinance, or less than
that of the zone classification in which it lies.
Section 2. That Section 20-9 Xurisdiction of Ordinance No. 1449 be

Any owner of land within this area wishing to subdivide laud
shall submit to"the Planning Board and City Engineer, a plat
of the subdivision according to the procedures outlined in
Section 20-10, which plat shalt conform to the minimum
requirements set forth in Section 20-11. Improvements shall
be installed as required by Section 20-12 of these standards. "

subdivision of land is proposed, before any contract is made
for the sale of My part thereof, and before any permit for^
the erection of a_-structure in such proposed subdivision
shall be-granted, the subdividing owner, or his authorized
agent, shall apply for and secure ,approva2„of such proposed
subdivision. Such subdividing owner shall submit a plan of
such proposed subdivision to the Planning and Zoning Board,
City Engineer and Traffic Engineering Department for approval
and shall obtain such approval prior to the filing of his sub-
division plat for record. Any such plat of subdivision. shall
conform to the minimum standards of design for the sub-
division, of land set forth in Section 20-11 of these standards
and shall be presented in the manner specified in the follow-
ing sections of this Section. No plat of a subdivision of land
within the area of planning jurisdiction shall be filed or re-
corded by the County Clerk without the approval of the City
Commission as specified herein.
2. In order to secure review and approval by the Planning
and Zoning Board of a proposed subdivision plat, the prospective
subdivider shall, prior to the making of any street improvements
or installations of utilities, submit to the Planning Department,
City Engineer, and Traffic Engineering Department a preliminary
plat as provided in Section B of this Section. On approval of said
preliminary plat and final construction plans, he may proceed
with the preparation of the final plat and other documents
required in connection therewith as specified in Section C
of this Section and the improvements set forth in Section
20-12. Prior to the sale of any parcels of land, the
developer must have fulfilled the requirements as stated
in Section 20-12, Paragraphs A and B.
3. A basic administrative review fee shall be submitted with
all subdivision applications up to and including twenty-five
lots. Subdivisions in excess of twenty-five lots shall re- .
quire additional fee per lot for each lot in excess of
twenty-five. Such fee shall, be paid to the City of Clearwater
being submitted to the Planning Departmeni.
4. Record Plat Filing fees shall be paid to the City of Clearwater
at an established rate per acre or any part,thereof. County
Clerk Recording fee s are to be paid by the developer to the-,
City Engineering Department at time of submittal of linen
original for signature of City Manager (Supervisor of Plats). "

Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section S. This ordinance is adopted as an emergency ordinance
pursuant .to Section 166. 041 Florida Statutes, and the Clearwater City Charter.
Section 6. It is hereby found, determined and declared that this
ordinance is necessary and urgently needed for the preservation of the welfare
of the citizens and inhabitants of the City of Clearwater, Florida, in that
passage of this ordinance is required in order to cleanup a conflict in Ordinance
No. 1449 as it would apply to proposed and future development, thereby
providing certainty in its application; by reason of such fact an emergency
is hereby declared; and that this ordinance shall be in full force and effect
immediately upon its passage. This ordinance shall automatically expire
ninety (90) days from the date of its passage unless the ordinance is submitted
during such time for consideration as a non-emergency ordinance.
Section 7. Notice of the proposed enactment of this ordinance has been
property advertised in a newspaper of general circulation in accordance with
Section 166. 041, Florida Statutes.
