2769-82E. ?I ORDINANCE NO, 2769-82 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING CHAPTER 21, OFFICERS, OF TITLE II, ADMINISTRATION, BY ADDING A SECTION RELATING TO THE APPOINTMENT OF DEPUTY CITY CLERK AND A SECTION RELATING TO OATH OF OFFICE, AS PREVIOUSLY SET OUT IN SECTION 1 OF ORDINANCE NO. 2656-82; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEPARABILITY OF PROVISIONS v HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. Y3y C { I ,_ t WHEREAS, the City Commission on April 1, 1982. passed Ordinance No. Z656-82 adding certain new sections to Chapter 20 of the Code of Ordinances; and WHEREAS, the Code Corporation has requested that two of the new sections be placed in Chapter 21, Officers; and WHEREAS, it is necessary to pass an ordinance to accomplish such change; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEAIWATER, FLORIDA: Section 1. That Chapter 21, Officers, of Title II, Administration, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to add the following sections to read as follows: Section 21. 02. Appointment of Deputy City Clerk and Other Duties. In addition to the duties specifically imposed under the Charter, the City Clerk shall perform such other duties as may be required by ordinance or resolution of the City Commission, as well as such as may be required of city clerks by the general laws of the State, applicable to municipalities and not inconsistent with the Charter or with any ordinance or resolution parsed by the City Commission pursuant to its home rule power. The city clerk, by and with the consent and approval of the city manager, may appoint deputy clerks, who, when appointed, shall have the same powers and authority, and shall conform to all rules and regulations of the city and of law as the city clerk is subject to. -I- Ord'. 7/15/82 '?s IT 6 Section 21. 03. Oath of Office. 111f71 Every officer of the city shall, before entering upon the duties of the office, take and subscribe to an oath or affirmation to be filed and kept in the office of the city clerk, which oath shall be in the form prescribed for state officers by the Constitution of this State. All employees or members of boards having enforcement or regulatory powers shall take an oath of office. Section 2. That Section 20. 02 and Section 20.03 as set out in Section I. of Ordinance No, 2656-82 be and the same are hereby repealed. Section 3. That Section 1 of Ordinance No. 2656-82 be and the same is hereby amended to re-number the remaining sections as follows: Section 29r 94 20.02 Official Bonds. . The city commission or the city manager, in fixing the salary or compensation of any officer, clerk or employee, shall determine whether or not such officer, clerk or employee shall give bond, and if so, the' amount thereof; provided, that the city commission may prescribe which of such or whether all of such officers and ernpooyees shall give bond, where bond is required the same shall be procured from a regularly accredited surety company authorized to do business under the laws of Florida, the premium on such bonds to be paid by the city. All such bonds shall be payable to the City of Clearwater, and shall be filed in the office of the city finance director. Section 20rQ6 20.03 Investigations. The city commission, or any committee thereof, the city manager, or any advisory board appointed by the city commission for such purpose, shall have the power at any time to cause the affairs of any department or the conduct of any officer or employee of the city, to be investigated; and for such purpose shall have the power to compel the attendance of witnesses and the production of books; papers and other evidence; and for that purpose may issue subpoenas or attachments which shall be signed by the presiding officer of the body, or by the officer making the investigation, and shall be served by any officer authorized by law to serve such process. The authority making such investigation shall have the power to cause testimony to be given under oath, such oath to be administered by some officer having authority under the law of the state to administer oaths; and shall have the power to punish as for contempt any person failing or refusing to testify to any fact within his or her knowledge or to produce any book or paper under his or her care or control, relating to the matter under investigation. Section 24.-0(r 20.04. General Laws Application to City. All general laws of the state applicable to municipal corporations now existing or which may hereafter be enacted shall be applicable to the city in the manner provided by Section 166.021, Florida Statutes. rd.2769-82. - . ` . 735/82 Rol .
