G ORDINANCE NO. 2767-82 AN ORDINANCE OF THE CITY OF CLEARWATER, VACATING A CERTAIN ALLEY IN MANDALAY SUBDIVISION, PINELLAS COUNTY, FLORIDA; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, it has been requested by Robert A. Saltzstein and Margaret J. Saltzstein, his wife, owners of certain real property in Mandalay Subdivision, in the City of Clearwater, Florida, that the City of Clearwater, Florida, vacate a certain alley; and WHEREAS, after proper public notice and public hearing thereon, the City Commission finds that said alley is not necessary nor required for municipal use and it is deemed to be to the best interest and advantage of the City and the general public that the same be vacated; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEA.RWATER, FLORIDA: Section 1. That the following: The East-West Alley lying between Blocks 49 and 46A, Mandalay Subdivision, according to the map or plat thereof, as recorded in Plat Book 14, pages 32 thru 35, of the Public Records of Pinellas County, Florida, • sip;, ,' •.i-. z: - ter ?' ., ;?:::tl???"i?a.' be and the same is hereby vacated, closed and released, and the City of Clearwater hereby quit claims and releases all of its right, title and interest thereto to the persons, firms or corporations entitled thereto by law, excepting that the City of Clearwater hereby retains a drainage and utility easement over said described real property for the installation and maintenance of any and all public utilities thereon. Section 2, That the City Clerk is hereby directed to record this ordinance in the Public Records of Pinellas County, Florida. Section 3. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166. 041, Florida Statutes. 2767- 82 7/15/82 .40 Section 4. A 8.5382 vAu 1396 V, ?rq Ne ORDINANCE NO. 2 8-8 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING SECTION 1 OF ORDINANCE NO. 2710- 8Z TO CHANGE THE CHAPTER AND SECTION NUMBER OF THE NEW CODE SECTION SET OUT IN THE ORDINANCE; PRO- VIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS.OF ORDINANCES JN CONFLICT HEREWITH; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Commission on April 10, 1982, passed Ordinance No, 2710-82 creating a new Code section relating to prohibition of sleeping in motor vehicles; and WHEREAS, request has been made by the Code Corporation to move the section to a different chapter in the Code of Ordinances; and WHEREAS, it is necessary to amend Ordinance No. 2710-82 in order to accomplish this purpose; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Section 1 of Ordinance No. 2710-82 be and the same is hereby amended to read as follows: "Section 1. That Chapter 120 150, in General of T''itle-7q-T-+a-ffi-c and-Muter-Vekk-ie-s-Title XII Offenses of the Code of Ordinances, City of Clearwater, be and the same is hereby amended and supplemented by the enactment of new Section 1-3.4, 13. 150. 13 , Sleeping in motor vehicles prohiblted, to read as follows: Section 120rI8 150. 13. Sleeping in motor vehicles prohibited. It shall be unlawful for any person to lodge or sleep in, on or about any automobile, truck, trailer, camper, or similar vehicle in any public street, public park area, public way, right-of-way, parking lot or other public property, within the limits of Clearwater, Florida. 11 Section Z. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 3.
