2761-82 is 11 AUTHORIZATION OF BRIDGE TOLLS ORDINANCE NO. 2761-82 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING TITLE X, CHAPTER 122, CLEARWATER PASS BRIDGE, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, TO PROVIDE A REVISED SCHEDULE OF TOLLS FOR THE USE OF CLEARWATER PASS BRIDGE; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING Fat PROPER NOTICE OF PROPOSED ENACTMENT. WHEREAS, the use of the Clearwater Pass Bridge is controlled by a toll booth; and WHEREAS, the construction, improvement and operation of the Clearwater Pass Bridge is financed from the collection of tolls for its use; and WHEREAS, Section 15B of Ordinance No. 1701 which refunded the Clearwater Pass Bridge Bonds requires the City to revise tolls so as to provide adequate revenues to pay all operating expenses and renewal and replacement costs; and WHEREAS, the City Engineer has recommended an increase in two-axle vehicle tolls from $0.25 to $0.35 to finance necessary bridge improvements; and WHEREAS, the construction of enact change lanes has jeopardized the safety of bicycle riders who have to cross the exact change lane to pay the current $0.15 toll, and the revenue generated from bicycle riders does not justify the above described safety concern; and WHEREAS, the City wishes to extend to public agency buses the economic advantage of the token rate; and WHEREAS, the City Engineer has certified that the Net Revenues to be generated after revising the tolls will be greater than the Net Revenues of the preceeding year; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Title X, Clearwater Pass Bridge, of the Code of Ordinances of the City of Clearwater, Florida, is hereby amended by enacting a new Section 122.01 to read as follows: Sec. 122.01. Toll Schedule. (c) The city manager or the chief of police, or their designee, are hereby authorized to waive the tolls established in this section when in the exercise of their discretion it is determined that such waiver is necessary to complete any emergency evacuation of Clearwater Beach or Sand Key. Section 2. All ordinances or parts of ordinances in conflice herewith are to the extent of such conflict hereby repealed. Section 3. Should any section, paragraph, sentence or word of this ordinance be declared for any reason to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Chapter 166.041, Florida Statutes. Section 5. This ordinance shall become effective on July 1, 1982.
