AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 133, BUILDING CODE, AND CHAPTER
142, FLOOD PROTECTION, OF TITLE XI, BUILDING AND
ZONING REGULATIONS, OF THE CODE OF ORDINANCES,
CITY OF CLEARWATER, TO PROVIDE FLOOD PROOFING
CERTIFICATION AND A FLOOD PLANE ELEVATION

BE IT,ORDAINED BY THE CITY COMMISSION OF
THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 133. 035, Exception to coastal construction
zoning; requirements, of Chapter 133, Building Code, of Title XI, Building and
Zoning Regulations, of the Code of Ordinances, City of Clearwater, be and
the same is hereby amended to read as follows:
Sec. 133.035. Exception to coastal construction zone;
requirements; flood proofing certification.
Within the landward fifty (50) feet of Zone 2 and all of
Zone 3, as such zones are established under Chapter 39,
the Coastal Construction Code, the building code board of
adjustment and appeals shall have the power to grant an
exception for nonresidential commercial structures from
the requirements relating to elevation of the first floor of
the structure, where the structure because of its intended
use must be built on grade.
Structures included under the exception authorized by this
section shall be subject to the standards enumerated in Section
3906.4 of the Coastal Construction Code. i
In the event flood proofing is required, certification of the
flood proofing method used must be filed with the Building
Inspection Department prior to the issuance of a Certificate
of Occu anc Certification shall be b a professional enin eer a
professional architect or a professional land surveyor.
Section 2. That Section 142. 03, Building permit--Standards of
issuance, of Chapter 142, Flood Protection, of Title XI, Building and Zoning
Regulations, of the Code of Ordinances, City of Clearwater, is hereby amended
by the addition of a new subparagraph (10) to read as follows:

Sec. 142. 03. Building permit--Standards for issuance,
In determining whether or not to issue a building permit, the
building director or his authorized representative, shall examine ;;.' ; "' y<`'• ,'.'
the application and all supporting; materials submitted to determine
the following:
(1) That all necessary permits have been received from those
governmental agencies from which approval is required by
federal, state or local regulations, and that the building or

development is in substantial compliance with the coastal x^µ i` `' ?d '` °rx `• '
zone management and conservation elements of the updated
comprehensive plan for the city; (2) That plans and specifications conform to the criteria established ? hs
by the federal insurance administration for the applicable flood zoning district; -M '
(3) That existing elevations shown on plans are certified by a
registered land surveyor or registered professional engineer;
(4) That in the case of new construction or substantial improve-
menta of residential structures within zones A, AO or Al through
A30 on the flood hazard boundary map have the lowest floor
(including basement) elevated to or above the one hundred (100)
year flood level as designated by the federal insurance
administration;
(5) That in case of new construction or substantial improvements
of nonresidential structues within zones As AO or Al through
A30 on the flood hazard boundary map have the lowest floor
(including basement) elevated to or above one hundred (100)
year flood level as designated by the federal insurance
administration; or that the attendant utility and sanitary
facilities be designed so that below the one hundred (100) year
flood level, the structure is watertight with walls substantially
impermeable to the passage of water, and with structural
components having the capability of resisting hydrostatic and
hydrodynamic loads and effects of buoyancy;
(b) That all subdivision proposals and other proposed new
developments greater than fifty (50) lots or five (5) acres,
-whichever is lesser, include within such proposals the one
hundred (100) year flood elevation data;
(7) That all mobile homes to be placed within zones A, AO or Al
through A30 on the flood hazard boundary map shall be anchored
to resist flotation, collapse or lateral movement by providing
over the top and frame ties to ground anchors as specified by
the federal insurance administration;
(8) That within zones A, AO or Al through A30 on the flood hazard
boundary map, new mobile home parks and mobile home park
subdivisions; or existing mobile home parks and mobile home
park subdivision that request a permit to expand their facilities;
or to repair, reconstruct or improve their streets, utilities
and pads at a cost equal to or exceeding fifty (50) per cent of
the value of the streets, utilities and pads before the repair,
reconstruction or improvement has commenced:

a, Stands or lots are elevated on compacted fill or on pilings
so that the lowest floor of the mobile home will be at or above
the one hundred (100) year flood level as established by the
federal insurance administration.
b. Adequate surface drainage and access for a hauler are
provided.
ca In the instance of elevation on pilings, lots are large enough
to permit steps, piling foundations are placed in stable soil
no more than ten (10) feet apart, and reinforcement is
provided for pilings more than six (6) feet above the ground
level.
(9) That all new construction and substantial improvements with
zones V, VO or V1 through V30 on the flood hazard boundary
map are elevated on adequately anchored pilings or columns
and securely anchored to such piles or columns so that the
lowest portion of the structural members of the lowest floor
(excluding the pilings or columns) is elevated to or above the
one hundred (100) year flood level as established by the federal
insurance administration, and that a registered professional
engineer or architect has certified that the structure is
securely anchored to adequately anchored pilings or columns
in order to withstand velocity waters and hurricane wave wash.
Also that the space below the lowest floor is free of obstructions
or constructed with "break-away walls" intended to collapse
under stress without jeopardizing the structural support of
the structure so that the impact on the,atructure by adnormally
high tides or wind driven water be minimized. Such temporarily
enclosed space shall not be used for human habitation.
(10 For all construction in a designated. flood plane area, a nost-
construction elevation certificate must be submitted to the
_Building Inspection Department prior to the release of a
Certificate of Occupancy. Certification shall be by a
professional _engineer or a professional land survevor.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166. 041, Florida Statutes.
