ORDINANCE NO. 2737-82
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 134, ELECTRICAL CODE, OF TITLE
XI, BUILDING AND ZONING REGULATIONS, OF THE CODE
OF ORDINANCES, CITY OF CLEARWATER, TO PROVIDE
FOR ADOPTING THE 1981 EDITION OF THE NATIONAL
ELECTRICAL CODE; PROVIDING FOR THE SEPARABILITY
OF THE PROVISIONS HEREOF; PROVIDING FOR THE
EFFECTIVE DATE OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Section 134. 01, National Electrical Code--Adopted,
of Chapter 134, Electrical Code, of Title XI, Building and Zoning Regulations,
of the Code of Ordinances, City of Clearwater, be and the same is hereby
amended to read as follows:
Sec. 134.01. National Electrical Code--Adopted.
There is hereby adopted by the city for the purpose of
prescribing regulations governing all electrical con-
struction and all material and appliances used in
connection with the installation, maintenance and
operation of electrical wiring, apparatus or equipment
for light, heat or power, inside of or attached to
buildings within the city, that certain code known as
the National Electrical Code recommended by the National
Fire Protection Association, and adopted by the Pinellas
Count Construction Licensing Board, being particularly
the 4979- 1981 edition, except for any penalties contained
therein, of which code three (3) copies thereof are now
and have been for the last preceding ten (10) days on file
in the office of the city clerk, and the same is hereby adopted
and incorporated by reference as fully as if set out at length
herein, and from the effective date of this section shall take
effect, the provisions thereof shall be controlling within the
limits of the city.

Section Z. That subparagraph (a) of Section 134. 02, National
Electrical Code Application; violations, of Chapter 134, Electrical Code,
of 'T'itle XI, Building and Zoning Regulations, of the Code of Ordinances,
City of Clearwater, be and the same is hereby amended to read as follows:
Sec. 134.02. National Electrical Code--Application;
violations.
(a) All electrical construction and all material and
appliances used in connection with the installation,
maintenance and operation of electrical wiring,
apparatus or equipment for light, heat or power,
inside of or attached to buildings within the city,
shall conform to such especial rules and regulations

as may be embodied in the National Electrical Code,
1978. 1981 edition, except for any penalties contained
herein, as adopted by the city commission, save and
except such provisions therein which are in conflict
with this Code of Ordinances, and save and except such
provisions therein which are amended, modified, super-
seded or deleted by this Code of Ordinances; provided,
however, in the alterations, repair or rewiring of existing
structures, the electrical inspector shall have the authority
to permit such work to be done, whether in accord with
such code or not, in a manner deemed by him to be
sufficient to insure the safe operation of the facilities
involved and to eliminate hazards to property and persons.
Section 3. Should any part or provision of this ordinance be declared
by a court of competent jurisdiction to be invalid, the same shall not affect the
validity of the ordinance as a whole, or any part thereof other than the part
declared to be invalid.
Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 5. Notice of the pzo posed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166. 041, Florida Statutes.
Section 66. The provisions of this ordinance shall take effect
immediately upon its passage.
