' ? p e e , : increased; and WHEREAS, the public beaches of the City of Clearwater are one of its most valuable assets; and WHEREAS, the City Commission of the City of Clearwater wishes to curb such conduct; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Chapter 150, In General, of Title XII, Offenses, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended and supplemented by the enactment of new Section 150, 12, Sleeping on public beaches or in parks in the nighttime prohibited, to read as follows: "Section 150. 12. Sleeping on public beaches or in parks in the nighttime prohibited. (1) Intent. It is the intent of the City Commission of the City of Clearwater to preserve and protect the beauty of the City's beaches and parks for use by residents and tourists. In furtherance of such purpose, the City Commission makes the following findings of fact: (a) The City of Clearwater has a significant tourist population that utilizes its beaches and parks. (b) That being a largely recreational and tourist community, its beaches and parks are a very valuable asset. (c) That such beaches and parks are intended to be used solely for recreational purposes and not for sleeping during nighttime hours. (d) That permitting persons to sleep on the beaches and in the parks during nighttime hours will have a negative effect on the appearance of such areas and upon the City's tourism industry. It shall be unlawful for any person to sleep on any public beach or in any public park within the corporate limits of the City of Clearwater, Florida, between . the hours of 9:00 P.M. and 6:00 A. M. of the following day. (3) 'Penalty. Any person found guilty of violating this section ??,'`'s?,;?' nay •f''?isl';?}"' w'Y shall, upon conviction, be penalized as provided in Section ? t 1 08 (a) of this Code . . Section 2. All ordinances or parts of ordinances in conflict herewith 4 s, s are to the extent of such conflict hereby repaled. Section 3_ Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166. 041, Florida Statutes. Section 5. The provisions of this ordinance shall take effect immediately upon its passage.
