I i a? ! 1 j i ORDINANCE NO, 2705-82 mot, .'.r: .•???. _??;t. :a 5?"i';v )` AN ORDINANCE AMENDING THE ZONING ATLAS OF THE CITY OF CLIEARWATER FLORIDA 1982, AS AMENDED BY RECLASSIFYING AND ZONING CERTAIN PROPERTY AS i DESCRIBED HEREIN; PROVIDING FOR REPEAL OF ORDh?;;:?'?'? NANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO- VIDING FOR THE SEPARABILITY OF THE PROVISIONS ;. <.?'_;.'?!•.w'.;' HEREOF; PROVIDING FOR PROPER NOTICE OF PRO- POSED ENACTMENT; AND PROVIDING FOR THE EFFECTLVE DATE OF THIS ORDINANCE. WHEREAS, on July 16, 1981, the City Commission of the City of Clearwater, after proper public notice, held a public hearing on certain proposed changes to the zoning atlas of the City of Clearwater in accordance . with procedure as established; and t fi! WHEREAS, certain of the proposed changes and amendments to the zoning atlas were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; and WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to the LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to each required referral process; and WHEREAS, this Ordinance has been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following described property in Clearwater, Florida, is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas of the City of Clearwater, Florida of 198210, as amended, is amended to indicate that fact as hereinafter set out: ', ' •4rd .-27fl5-82 :. 8/19/82 ¦a' Zoned CTF-24 - Commercial/ Tourist Facilities Use District From the NE corner of the SE 1/4 of Section 9, Township 29 South, Range 15 East; thence West 1226.61 feet; thence South 81.27 feet; thence S 14°4513211 W, 65 feet; thence N 89°0310911 W, 143.94 feet; thence N 00°37'3611 W, 63. 11 feet; thence N 89`1011211 W, 1x0.19 feet to a point on the original shore line as shown on the plat of J. A. Corral s Subdivision as recorded in Plat Book 1, page 44, of the Public Records of Pinellas County, Florida, and the point of beginning; thence along a seawall N 89°26'3411 W, 658.99 feet; thence along the Easterly right-of-way of the infra- coastal waterway S 10'3315711 W, 199.26 feet MOL; thence along a seawall northeasterly 118. 5 feet MOL; thence along a seawall southwesterly 45. 5 feet MOL; thence S 62.3.910911 E, 574.45 feet MOL; thence N 72° 5411311 E, 176. 24 feet; thence S 77°00'3911 E to a point on the original shore line as shown on the plat of Sue Barco Subdivision as recorded in Plat Book 1, page 26, of the Public Records of Pinellas County, Florida; thence run Northerly along said original shore line to its intersection with a seawall at Clearwater Bay Marine; thence run East, North and West along said seawall to an intersection with the original shore line as shown on said plat of J. A. Corrals Subdivision; thence run Northerly along said original shore line to the P. O. B.; LESS AND EXCEPT all submerged lands. Section 2. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part there of other than the part declared to be invalid. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166. 041, Florida Statutes. Section 6.
