AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 7B, COMMUNITY RELATIONS, OF
THE CODE OF ORDINANCES OF THE CITY OF CLEAR-
WATER, FLORIDA, 1962, TO PROVIDE FOR PRACTICES
THAT WOULD BE CONSIDERED DISCRIMINATORY IN
THE SALE OR RENTAL OF VACANT LAND; TO CLARIFY
EXCEPTION FROM THIS CHAPTER AS TO ROOMS OR
UNITS IN DWELLINGS FOR NO MORE THAN FOUR (4)
FAMILIES WHERE OWNER OCCUPIES ONE OF SUCH UNITS;
TO DELETE AS AN UNLAWFUL DISCRIMINATORY PRACTICE
THE INITIATION OF ANY CHARGE FOR THE PURPOSES
OF HARASSMENT; PROVIDING FOR REPEAL OF ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT;
PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED
ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, the United States Department of Housing and Urban
Development has reviewed our Community Relations Code as was passed
and adopted pursuant to Ordinance No. 1843; and
WHEREAS, as a result of such review, the United States Department
of Housing and Urban Development has requested that we make several
amendments in order to make our code more consistent in several respects
with Title VIII of the Civil Rights Act of 1968;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: -
Section 11 Chapter 7B, Community Relations, of the Code of
Ordinances of the City of Clearwater, Florida, 1962, is amended to enact
a new Section 7B-16. 1 to read as follows:
Section 7B-16. 1 Sale and Rental of Vacant Lands.
It shall be an unlawful, discriminatory practice for any
person being the owner or the agent of the owner to
refuse to sell or rent vacant land, or to refuse to
negotiate for the sale or rental of vacant land with
any other person because of race, color, religion,
national origin, sex, handicap or marital status.
Section 2. Subparagraph (2) of Section 7B-17, Exceptions, of
Chapter 7B, Community Relations, of the Code of Ordinances of the City
of Clearwater, Florida, 1962, is amended to read as follows:

(2) Rooms or units in dwellings containing living quarters
occupied or intended to be occupied by no more than four
(4) families living independently of each other if the
owner actually maintains and occupies one of such living
quarters as his residence. The exce tion rovided in this
subparagraph shall only apply where the dwellings describes
in this subparagraph are sold or rented without the use in
any manner of the sales or rental facilities or sales or

rental services or the use of any agent or property manage
or an real estate broker or real estate sales person or
person in the business of selling-or renting or managing_
dwellin s or without the publication, posting or mailing
of an advertisement or written document in contra-
vention of Section 7B-14.
Section 3. Section 7B-10, Unlawful Discriminatory Practices—
General, of Chapter 713, Community Relations, of the Code of Ordinances
of the City of Clearwater, Florida, 1962, is amended to read as follows:
Section 7B-10. Unlawful Discriminatory Practices - General.
It shall be an unlawful discriminatory practice for any entity:
(1) To retaliate or discriminate in any manner against a person
because such person has opposed a practice declared to be an
unlawful discriminatory practice by this chapter or because
such person has filed a charge, testified, assisted or
participated in any manner in an investigation, proceeding,
hearing or conference under this chapter; or
(2) To aid, abet, incite, compel or coerce any entity to engage
in any of the practices prohibited by this chapter or any
order issued thereunder;-G2& .

Section 4. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 5. Should any section, paragraph, sentence or word of
this ordinance be declared for any reason to be invalid, the same shall not
affect the validity of the ordinance as a whole, or any part thereof other
than the part declared to be invalid.
Section 6. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.

Section 7. The provisions of this ordinance shall take effect
immediately upon its passage.
