DATE FOR THIS ORDINANCE.
WHEREAS, the flooding conditions experienced last year and the
heavy rains which have already occurred early this spring, have underscored
the need for a procedure for restoring electrical service to structures that
have been flooded; and
WHEREAS, the City Commission is desirous of establishing such
a procedure to deal with any potentially dangerous situation which occurs
when high water enters a building;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS%
Section 1. Division 2, Electrical Code, of Article III, Electricity,
of Chapter 7, Buildings, of the Code of Ordinances of the City of Clearwater,
Florida, 1962, is hereby amended by enacting two new sections, namely,
Section 7-69 and Section 7-70, to read as follows:
Section 7-69. Purpose and scope of Application
Within the boundaries of the City of Clearwater, Florida,
the following code section shall apply to all structures that
receive electrical service from a licensed public utility or
any other source in order to prevent the creation of unsafe
or hazardous conditions through the continuation or restoration
of electrical service to a structure that has sustained flooding
or high water intrusion.
Section 7-70. Restoration of electrical service.
Any structure located within the boundaries of the City of
Clearwater, Florida, that has sustained water intrusion with
the result that such water intrusion has covered electrical
appliances, outlets, connections, and similar devices shall
have the power service to such structure terminated, and such
power shall not be re-supplied to the structure until such time
as the electrical system within the structure is certified as
being safe for operation and use. SE13 ORDINANCE

The certification required by this section shall be by a
master electrician who shall provide a report to the
Building Department of the City of Clearwater, Florida.
The certification described in this section shall be obtained
by the owner of the structure, the owner's agent or tenant
engaging the services of a licensed, master, electrician
to inspect the electrical outlets, connections, appliances
and the electrical system of the structure to determine that
the system and its improvements and appliances are in
proper operating condition and safe to receive electricity.
Such certificate shall be in writing and executed by the
innpecting master electrician.
Upon receipt and verification of the certificate, the Building
Department shall notify the public utility that the structure
has been certified as safe to receive electricity.
Section 2. Should any section, paragraph, sentence or word of this
ordinance be declared for any reason to be invalid, the same shall not affect
the validity of the ordinance as a whole, or any part thereof other than the
part declared to be invalid.
Section 3. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 4. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes.
Section 5. This ordinance shall become effective immediately upon
its pas sage.
