2170-80 1 i r:N ORDINANCE NO. 2170 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ARTICLE 11, PURCHASE OF COMMODITIES OF CHAPTER 15A, PURCHASING OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, TO PROVIDE THAT THE PURCHASING AGENT AND DEPARTMENT DIRECTOR CONCUR ON SINGLE SOURCE PURCHASES; PROVIDING FOR APPROVAL OF PURCHASES BY THE CITY COM- MISSION; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; PROVIDING FOR NOTICE OF PROPER ENACTMENT AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, it is necessary to clarify the procedures under which purchases or acquisitions are made pursuant to that portion of the purchasing code relating to exceptions to the bidding process. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section L. That Section 15A-10 of Article II, Purchase of Commodities of Chapter 15A, Purchasing, of the Code of Ordinances of the City of Clearwater, Florida, 1962, be and the same is hereby amended to read as follows: Section 15A..10. Exceptions to bidding procedures. The bidding requirements set forth in this chapter may be dispensed with when one of the following conditions exists; (1) A department director certifies in writihi to the purchasing agent that an emergency exists in regard to the purchase of any commodity so that the delay incident to giving opportunity for competitive bidding would be detrimental to the interest of the city. The .ijavoWed responsible department director shall provide a detailed summary outlining the facts demonstrating the existence of an emergency. (2) Commodities are available only from a single source. After determination by the purchasing agent upon review of written summary of facts from the de artment director requesting the purchase. (3) The amount of the purchase involved is estimated to be five hundred dollars ($500.00) or less.. Section Z. Should any section, paragraph, sentence or wurd of this ordinance be declared for any reason to be invalid, the same shall not affect the validity of the ordinance as a whale, or any part thereof other than the part declared to be invalid. Section 3. All ordinances or parts of ordinances in, conflict herewith are to the extent of such conflict hereby repealed. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 5.
