I ORDINANCE NO. 2166 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING CHAPTER 4, ALCOHOLIC BEVERAGES, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER, FLORIDA, 1962, TO PROVIDE DEFINITIONS OF CLASSIFICATIONS; PROVIDING FOR INFORMATION THAT IS TO BE INCLUDED IN THE APPLICATION FOR ALCOHOLIC BEVERAGE ZONING; PROVIDING FOR THE SITE AND LOCATION REQUIREMENTS; PROVIDING GROUNDS FOR REVOCATION OF THE ALCOHOLIC BEVERAGE ZONE; PROVIDING A HEARING PROCEDURE; PRO - VIDING FOR PERIOD OF TIME BEFORE REAPPLICATION CAN BE MADE FOR NEW ALCOHOLIC BEVERAGE ZONING; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE, WHEREAS, the City has retained its power to zone for alcoholic beverages as is indicated in Section 562.45 (2), Florida Statutes; and WHEREAS, the City Commission wishes to provide regulations which are more complete in nature in determining the proper location for alcoholic beverage zones; NOW, THEREFORE, BE IT ORDAINED BY THE. CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That subparagraph (1) of Section 4-18, Zoning regulations-- Zones described, of Chapter 4, Alcoholic Beverages, of the City of Clearwater Code of Ordinances, 1962, be and the same is hereby amended to read as follows: (a) Definitions. The following words and terms are hereby defined as follows and shall be interpreted as such throughout this chapter [Sections 4-18.1 and 4-18.2]: (1) Alcoholic beverage establishment: Any establishment devoted primarily to the -retail sale of alcoholic :beverages for consumption on or off the premises. (2) Church: A place where persons regularly assembled for religious instruction. (51 Premises. That portion of the property where the licensed activity is to take place. ?4} L6J School: A place of instruction or education whether maintained at public or private expense whose primary purpose is the instruction or education of persons under the age of eighteen (18). Section 2. That Section 4-18. 1, Consumption of beer, wine or liquor on or off the premises, of Chapter 4, Alcoholic Beverages of the Code of Ordinances of the City of Clearwater, Florida, 1962, be and the same is hereby amended to read as follows: Sec. 4-18. 1. Consumption of beer, wine or liquor on or off the premises. (a) Zoning. \ (1) An alcoholic beverage establishment shall be permitted in areas already zoned CG, CTF, CSC, CP and CS. (2) An alcoholic beverage establishment may be established as a permitted use in conjunction with the final site plan approval in an area zoned CPD. The legal description of the lot, plot or tract to be zoned for alcoholic beverages, which legal descriptio: must describe only that portion of the_properLy to be utilized for the sale and/or consumption of alcoholic beverages. d. The street address of the lot, plot or tract to be so zoned. e. The alcoholic beverage zoning classification desired for the lot lot or tract. r (b.) Site and structure requirements. (1) All alcoholic beverage establishments must front on an expressway, thoroughfare, arterial, major or minor collector as identified on the thoroughfare plan of the City of Clearwater. (2) Premises where beer, wine or liquor is to be consumed thereon shall contain a minimum of fifty (50) seats within the enclosure. 3) The establishment located or to be located on the subtect property identified in the zoning petition or application shall h_ave_a minimum interior floor area of one thousand (1 000 square feet of space. (4) The subiect property identified in the zoning petition or application shall not be located within five hundred (500) feet of an ro er zoned for residential ur oses, which _measurement shall be made from any paint On the establishment where the alcoholic beverage business is to be located to the property line of the pro]erty zoned for residential2ur20ses- The distance limitation contained in this subparagraph shall not apply to a bona fide restaurant, motel, hotel or other retail business where the sale of alcoholic beverages is in- cidental to the primary function. (.1) _(& All alcoholic beverage establishments must comply with the off street parking requirements for areas zoned CG, CTF, CSC, CP and CS, or in the case of CPD, a permitted use in conjunction with a final site plan for an area zoned CPD, as such requirements are set out in Article XXXIII of the Zoning Code of the City of Clearwater or as provided by the provisions of Article XVIII of the Zoning Code of the City of Clearwater. No alcoholic beverage establishment shall be established within two hundred (200) feet of an established church, which distance shall be measured by following the shortest route of ordinary pedestrian travel along the public thoroughfare from the main entrance of said place of business to the main entrance of the church. -3- Ord. 02166 6/7180 L ? ,?y {s Y ? ?S <3 (4). Such prior existing z? .. business location shall be permitted to continue and renew its alcoholic beverage license and shall not be subject to nti?-? the distance limitations imposed by this section. Within;?. this paragraph, the term "alcoholic beverage establishment" ~,i • _.. shall mean a business licensed to sell alcoholic beverages _ °'` ,'•'; and shall include a successor business at the same location..: (4r)• .(2LNo alcoholic beverage establishment may be established in an area zoned predominatly for residential use. Section 3. That Chapter 4, Alcoholic Beverages, of the Code of Ordinances of the City of Clearwater, Florida, 1962, be and the same is hereby supplemented by the enactment of Section 4-18.3 to read as follows: Section 4-18. 3. Reversion of alcoholic beverage zoning. The City Commission, after conducting a public hearing as provided in Section 4-18.4 of this Chapter, and by majority vote is authorized to revert to an unzoned status any property which has been zoned for the sale of any type of alcoholic beverages or from which any type of alcoholic beverages may be lawfully sold or consumed within the corporate limits of the City of Clearwater, whenever it is determined that the owner of such property or the owner or holder of the alcoholic beverage license pertaining to such property, their agents or employees, have committed, or have been convicted of, or have allowed or caused or permitted to exist any one or more of the following: (a) Commission of an act amounting to a felony under the laws of the State of Florida or the United States of America, whether convicted or not. (b) The maintaining or allowing of a nuisance on such property as that term is defined in Section 13-7 (A) (1) of the Code of Ordinances of the City of Clearwater, Florida, 1962. (c) Engaged in or permitted disorderly conduct on or about such property. (d) Failed to comply with any of the provisions of the fire prevention code after having received reasonable notice to eliminate or correct any condition existing on such property that is in violation of such code. -4- ord. 12166 - . 8/7/80 (e) Conviction for selling, giving, serving or permitting to be served alcoholic beverages to persons under nineteeni (19) years of age except military personnel or permitting a person under nineteen (19) years of age except military personnel to consume alcoholic beverages on such property. In addition to the above reasons, and in accordance with the procedure set out in Section 4-18.4 of the Code of Ordinances of the City of Clearwater, Florida, 1962, any property initially zoned for the sale or consumption of alcoholic beverages, and in which after six (6) months of such zoning no alcoholic beverages have been sold or consumed thereon, shall revert to an unzoned dry status. Section 4. That Chapter 4, Alcoholic Beverages, of the Code of Ordinances of the City of Clearwater, Florida, 1962, be and the same is hereby supplemented by the enactment of new Section 4-18.4 to read as follows: Section 4-18.4. Notice of intent to unzone property; public hearing. Whenever the City Commission shall find that the owner of any property which has been zoned for the sale of any type of alcoholic beverages or from which any type of alcoholic beverages may be lawfully sold or consumed, or the holder of the alcoholic beverage license pertaining to such property, their agents or employees, have committed or have been convicted of, or have allowed or caused or permitted to exist any one or more of the enumerated items contained in Section 4-18.3 of the Code of Ordinances of the City of Clearwater, Florida, 1962, it shall notify the owner of such property or the holder of the alcoholic beverage license pertaining to such property of its intention to consider removing the alcoholic beverage zoning attaching to such property, and shall grant the affected party a public hearing at a time and place to be specified in such notice and at a time not less than fifteen (15) days from the date of such notice. Section 5. That Chapter 4, Alcoholic Beverages, of the Code of Ordinances of the City of Clearwater, Florida, 1962, be and the same is hereby supplemented by the enactment of new Section 4-18. 5 to read as follows: Section 4-18. 5. Reapplication for alcoholic beverage zoning. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed; specifically Section 4-26 .]I y of the Code of Ordinances of the City of Clearwater, Florida, 1962, is '. x repealed in its entirety. , Section 9. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 10. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 11. The provisions of this ordinance shall take effect immediately upon its passage.
