WHEREAS, it is found and determined that consumption of ,;'? •``?`?n " ?.. n_T?? fit, intoxicating beverages or liquors, beers or wines in places other than the licensed premises or other enclosed buildings as set out below is detrimental to the public health and welfare because such consumption results in crime, fighting, unsightly and unsanitary conditions due to persons eliminating in public or exposing themselves and debris. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COM- MISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Article I of Chapter 4, Alcoholic Beverages of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby supplemented by the enactment of Section 4-12 to read as follows; Section 4-12 Unlawful consumption on the premises. (a) It shall be unlawful for anyone who sells or causes to be sold any intoxicating liquors, wines or beer to permit such intoxicating liquors, wines or beer to be consumed on the premises where the intoxicating liquors, wines or beer are sold or on any other premises under the control, whether directly or indirectly, of the licensee, except within the area which is licensed for such sales; however, a licensee who also sells food for consumption on the premises may designate an outside area for the consumption of food and alcoholic beverages, . (b) It shall be unlawful for anyone to consurne any intoxicating liquors, wines or beer on the premises where intoxicating liquors, wines or beer are sold or on any other premises under the control, either directly or indirectly, of the licensee, except within the area which is licensed for such sales or in an area designated for outside consumption of food and beverages by a licensee who also sells food for consumption on the premises. (c) It' shall be unlawful for anyone to consume any intoxicating liquors, wines or beer off a licensed premises but within five hundred (500) feet thereof, except within enclosed buildings or on premises occupied solely by SEE ORDINANCE 15^z"' ....................,..,,s? The distance not forth herein shall be measured by following a straight line from that portion of any structure licensed for dealing in intoxicating beverages or liquors, beer or wine, nearest to the violation of this subparagraph to the location of the violation of this subparagraph. Section 2. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 3. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166. 041, Florida Statutes. Section 5. The provisions of this ordinance shall take effect im- mediately upon its passage.
