2137-80 ORDINANCE NO. 2137 AN ORDINANCE AMENDING THE ZONING ATLAS OF THE CITY OF CLEARWATER FLORIDA 1980, AS AMENDED BY ZONING CERTAIN PROPERTY RECENTLY ANNEXED INTO THE CITY OF CLEARWATER, ;.., a,': •? AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PRO- i; VISIONS HEREOF; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS .i V•k5j .i ".5 ORDINANCE, WHEREAS, on May 15, 1980, the City Commission of the City of Clearwater, after proper public notice, held a public hearing for the ??• _• . t•-'i determination and establishment of zoning classifications for certain property annexed into the City of Clearwater in accordance with procedure as , established; and WHEREAS, certain of the amendments to the zoning atlas for establishing zoning for such newly annexed real property were approved by the City Commission after its evaluation of all evidence presented at the said public hearing; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following described property in Clearwater, Florida, is hereby classified and zoned as hereinafter indicated, and "The Zoning Atlas of the City of Clearwater, Florida of 198011, as amended, is amended to indicate that fact as hereinafter set out: Zoned as RS-60 - Single Family Residential District Lot 72, Clearwater Manor, according to the map or plat thereof as recorded in Plat Book 41, page 66 of the Public Records of Pinellas County, Florida. Section 2. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section on 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Any person, or persona, firm or corporation or association of persons, who shall violate or fail to comply with any of the terms or provisions of this ordinance shall, upon conviction, be fined not exceeding the sum of Five Hundred Dollars ($500.00). Each day that a violation is permitted to exist shall constitute a separate offense. Section 5. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 6. The Planning Director is directed to include and set out and show upon the official zoning atlas of the City of Clearwater the foregoing amendment as hereinabove set out. Section 7.
