ORDINANCE NO. 2121
AN ORDINANCE OF THE CITY OF CLEARWATER,
VACATING A CERTAIN PORTION OF A DRAINAGE
AND [UTILITY EASEMENT IN UNIT 3B, MORNINGSIDE
ESTATES, PINELLAS COUNTY, FLORIDA; PROVIDING
FOR PROPER NOTICE OF PROPOSED ENACTMENT;
AND PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS, it has been requested by Jules P. Goudeau and Marilyn
D. Goudeau, owners of certain real property in Unit 3B, Morningside Estates,
in the City of Clearwater, Florida, that the City of Clearwater, Florida,
vacate a certain portion of a drainage and utility easement; and
WHEREAS, after proper public notice and public hearing thereon
the City Commission finds that said portion of the drainage and utility
easement is not necessary nor required for municipal use and it is deemed
to be to the best interest and advantage of the City and the general public
that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
The West 10 feet of a 90 foot drainage and utility
easement lying on the East side of Lots 326 through
331, Unit 313, Morningside Estates, according to the
map or plat thereof as recorded in Plat Book 61,
page 41 of the Public Records of Pinellas County,
Florida, Less S. 7-1/2 feet of Lot 329 and Less N. 7- 1/2
feet of Lot 330,
be and the same is hereby vacated, closed and released, and the City of
Clearwater hereby quit claims and releases all of its right, title and
interest thereto to the persons, firms or corporations entitled thereto
by lave.
Section 2. That the City Clerk is hereby directed to record this
ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Section 166.041, Florida Statutes,
