THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That Chapter 19 of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended by enacting Article IV, Special Assessment Improvements, to read as follows: ARTICLE IV SPECIAL ASSESSMENT IMPROVEMENTS Section 19-44. Sewer, Water and Gas Connections. Before paving or otherwise surfacing or re-surfacing any street or alley of the city, the city manager shall determine the time within which sewer, water, gas or other connection shall be constructed, and shall give notice thereof to the person, persons, firm or corporation required to make the sarne, and if any person, persons, firm or corporation shall fail to make any such connection when so required, no permission to make same shall thereafter be granted after the completion of any street improvement, unless for special reasons approved by the city commission. Nothing herein shall be construed to prohibit the city commission from providing that such connection may be made by the city and the cost thereof assessed to the lots and lands benefited thereby, the cost to be collected as provided for the collection of liens herein. Section 19-45. Modification of contracts. When in the opinion of the city manager, it becomes necessary for the prosecution of any work or improvement under contract, to make alterations or modifications in such contract, such alteratione'ar modifications, if made, shall be of no effect until the price to be paid for the work or material, or both, under the altered or modified contract, has been agreed upon in writing signed by the contractor and by the city manager, and approved by the city commission. Ord. #2107 4/17/80 1 Section 19-46. Sidewalks. Whenever the city commission shall decide that it is necessary for the best interests of the city that sidewalks be constructed or repaired upon any of the streets, avenues, or alleys of the said city, it shall by resolution declare its intention to have said sidewalks constructed or repaired, and shall give notice by publication in some newspaper published in said city once a week for at least two weeks, the first publication of said notice to be not less than ten days prior to the hearing provided in said notice. Said notice shall require all persona interested to show cause why said sidewalks should not be constructed or repaired; and if at the time designated in said notice no objections are filed, or if objections are filed and the same shall be deemed insufficient by the commission, the said com- mission shall then by resolution order said sidewalks constructed or repaired by the owners thereof, within thirty days from the passage and adoption of said resolution, said constructing or repairing of said sidewalks to be done in accordance with plans and specifications therefor to be kept on file in the office of the city a.?u&ta?r,e-nd clerk, and city engineer. Said resolution sha11 be published in some newspaper published in the City of Clearwater, once a week for at least two weeks. If the owners of the property abutting the sidewalk to be repaired or constructed shall fail to construct or repair the same within thirty days from the passage of said resolution, the city shall have the power and authority to construct or repair said sidewalks, or any part thereof which may not have been constructed or repaired within said time, and shall assess the cost thereof against the property abutting said sidewalk. Said sidewalks shall be constructed under the direction and supervision of and upon grades to be given by the city manager, and no sidewalk shall be constructed by any person except under the direction and supervision of and upon the grades established and given by the said city manager. Section 19-47. Street Paving. Whenever the city commission shall deem it advisable, necessary or to the best interests of the said city to pave, re-pave, or repair the pavement of any of the streets, avenues, or alleys of said city, or to install or repair the curbing, gutters, drains, storm sewers or sewers upon any of the streets, avenues, or alleys of said city, it shall publish notice of intention to do such work or make such repairs. J a J. interested and shall direct all such person interested to show cause, if any there be, why said improvements or repairs should not be made, and all persons desiring to object shall file their objections on the day named in said notice, which notice shall be published once a week for two consecutive weeks, the first publication to be not less than ten days before the day named for said hearing, and upon said day the city commission shall hear all objections to said improvement or improvements, and if they shall deem the objections insufficient or if no objections be filed, the city commission shall by resolution determine that said streets, avenues or alleys be so improved, and shall forth- with proceed with such improvements, and when said improvements shall have been completed, the said commission shall assess the cost thereof against the property abutting said streets, avenues or alleys, so improved. In no event shall the amount or validity of the lien or certificates of indebtedness as provided for by this Aat- ?J Article be questioned in any direct or collateral proceeding instituted more than six months after the issuance of such certificate of indebtedness by the city. In any suit brought to enforce such lien or collection of the amount due upon any r such certificate of indebtedness, a copy of the certificates, as recorded in the public records of said county, duly certified W ? by the clerk, or the original certificate of indebtedness issued on account of such lien, shall be and constitute prima facie evidence of the amount and the existence of the lien upon the property described. ' Section 19-50. krprov-ement Certificates of Indebtedness; enforcement of liens ef,-4-?o e-nfereed. In all cases mentioned in this A-ot Article where the city has acquired, or may hereafter acquire, liens for improvements, such liens, or any of them, may be enforced by the said city, er-in-thr}ae-of-tha?i by-holder-tea, by a bill in equity. Said trill in equity shall set forth briefly and succinctly the issuance of the certificate of indebtedness issued on account of such lien, the amount thereof, and the description of the property on which such lien has been acquired and against which the certificate of indebtedness was issued, and shall contain a'pmyer- request that the owner shall be compelled to pay the amount of said lien, costs and attorneys' fees, or in default thereof, that the said property shall be sold to satisfy the same; but the judg- ment or decree which may be obtained in such suit shall not be enforced against or be a lien upon any other property than that against which the assessment was made. In the event the owner of the property against which such certificate is issued shall be unknown, the proceeding may be instituted against the property without naming any individual, firm or corporation as defendant. Section 19-51. ,A,"ee xenta*d-Issuance of bonds. The city commission may at any time without an election being held therefor borrow -maney money and issue bonds therefor in anticipation of the collection of unpaid special assessments levied or to be levied for the purpose of paying the cost of constructing or repairing sidewalks, curbing, gutters, drains or the paving of streets, and construction of sewers which are to be or have been constructed by the city, -4- Ord'. #2107 4/17/80 Section 2. Sections 120 through 127, inclusive, of Chapter 9710, Special Acts of Florida, 1923, which have become an ordinance pursuant to Section 10.01 of Ordinance No, 1830, be and the same are hereby repealed. Section 3. Should any part or provisinn of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 5.
