FLORIDA, AMENDING ARTICLE II, APPENDIX A,
ZONING OF THE CODE OF ORDINANCES OF THE
CITY OF CLEARWATER, FLORIDA, 1962, RELATING
TO DEFINITIONS, TO PROVIDE A RE-DEFINITION
OF THE TERM LOT COVERAGE; PROVIDING FOR
THE REPEAL OF ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH TO THE
EXTENT OF SUCH CONFLICT; DECLARING THAT A _

THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the current definition of the term lot coverage has raised
questions of clarity relating to its use in current projects; and
WHEREAS, a need exists to re-examine the definition and the lot
coverage percentage authorized in the various districts; and
WHEREAS, an emergency exists within the City of Clearwater in
that it is immediately necessary to redefine the term "lot coverage" so as
to prevent confusion in ongoing projects and thereby preserving the health
and welfare of the citizens of the City of Clearwater;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Article II of Appendix A, Zoning of the Code of
Ordinances of the City of Clearwater, Florida, is hereby amended to
re'-define the term 'flot coverage", being paragraph (41), as follows:
(41) Lot coverage: The area of the lot, which when viewed
directly from above, would be covered by all principal and
accessory buildings and structure s,wipreas-e4-a? -a percte?ta+ge-
ef tke-toaJ??e,?s3?es. An portion of a rinci al or accessor
building. or anv terrace. balconv. breezewav. porch or
portions thereof, not included as floor area of _a building,
b definition shall not be included in computing lot coverage.
Section 2. All ordinances or parts of ordinances in conflict herewith
are to the extent of such conflict hereby repealed.
Section 3. This ordinance is adopted as an emergency ordinance
pursuant to Section 166. 041, Florida Statutes, and the Clearwater City
Charter.

Section 4. It is hereby found, determined and declared that this
ordinance is necessary and urgently needed for the preservation of the health
and welfare of the citizens and inhabitants of the City of Clearwater, Florida,
in that passage of this ordinance is required in order to prevent confusion
in ongoing developments until the definition and current lot coverage require-
ments in each district can be studied; thereby providing continuity in ongoing
developments; by reason of such fact an emergency is hereby declared;
and that this ordinance shall be in full force and effect immediately upon its
passage. This ordinance shall automatically expire ninety (90) days from
the date of its passage unless the ordinance is submitted during such time
for consideration as a non-emergency ordinance.
Section 5. Notice of the proposed enactment of this ordinance has
been properly advertised in a newspaper of general circulation in accordance
with Chapter 166. 041, Florida Statutes.
