AN ORDINANCE OF THE CITY OF CLEARWATER ' FLORIDA, AMENDING CHAPTER 3, AIRCRAFT, OF THE CODE OF ORDINANCES OF THE CITY OF CLEARWATER FLORIDA 1962, RELATING TO THE TAKEOFF PATTERN ON RUNWAY 15 AT CLEAR- WATER EXECUTIVE AIRPORT; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE F EX'T'ENT OF SUCH CONFLICT, PROVIDING FOR THE . SEPARABILITY OF THE PROVISIONS HEREOF; DECLARING THAT A PUBLIC EMERGENCY EXISTS AFFECTING THE HEALTH AND WELFARE OF THE CITIZENS OF THE CITY OF CLEARWATER; AND .'? PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. t_ ._........ ,•_t__ ..? :• WHEREAS, the City Commission of the City of Clearwater, acting as airport proprietor of the Clearwater Executive Airport, has through the passage of Ordinance No. 2064 adopted a landing and takeoff pattern for such airport; and WHEREAS, Florida Department of Transportation, Bureau of Aviation, has indicated that it would like to have the language of subparagraph 3 of Section 3-3 of the Code of Ordinances amended to modify the terminology contained therein; and WHEREAS, an emergency exists within the City of Clearwater in that it is immediately necessary to amend such code section to provide the modified terminology relating to the takeoff pattern, thus preventing any delay in implementing the pattern and thereby preserving the health, safety and welfare of the citizens of the City of Clearwater; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That subparagraph 3 of Section 3-3 of Chapter 3, Aircraft, of the Code of Ordinances of the City of Clearwater, Florida, 1962, is hereby amended to read as follows: Section 3-3. Aircraft traffic pattern for takeoffs and landings at Clearwater Executive Airport. 3. Takeoff Runway 15 - To depart area a climbing left turn as soon as altitude and airspeed permits prior to reaching State Road 590-A and continue climbing on a heading of 045• until reaching 2000 feet or three (3) miles ? before turning on course. Ord. #2063 -1» 1/17/80 1 Florida, in that passage of this ordinance is required in order to provide more expanded terminology applicable to the takeoff pattern for Runway 15 at the Clearwater Executive Airport, thereby avoiding delays in implementing the landing and takeoff patterns; by reason of such fact an emergency is hereby declared; and that this ordinance shall be in full force and effect immediately upon its passage. This ordinance shall automatically expire ninety (90) days from the date of its passage unless the ordinance is submitted during such time for consideration as a non-emergency ordinance. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 3. Should any section, paragraph, sentence or word of this ordinance be declared for any reason to ba invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof, other than ai the part declared to be invalid. Section 4. This ordinance is adopted as an emergency ordinance pursuant to Section 166.041, Florida Statutes, and the Clearwater City Charter. `rI Section 5.
