REPLAT OF BLOCKS 1«19 OF MARYMONT SUB- DIVISION, PINELLAS COUNTY, FLORIDA; PROS " - :.:•.., VIDING FOR PROPER NOTICE OF PROPOSED ' ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, it has been requested by Metal Industries, Inc., owner a rt f? of certain real property in Replat of Blocks 1-19 of Marymont Subdivision, r1 4 #? r yrfii: in the City of Clearwater, Florida, that the City of Clearwater, Florida, iz vacate a certain portion of Overlea Street; and WHEREAS, after proper public notice and public hearing thereon, the City Commission finds that said portion of Overlea Street is not necessary nor required for municipal use and it is deemed to be to the best interest and advantage of the City and the general public that the same be vacated; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That the following: That portion of Overlea Street lying within the SE 1/4 of the NW 1 /4 of Section I Z, Township 29 South, Range 15 East, as shown on the Plat of Replat of Blocks 1-19 of Marymont Subdivision as recorded in Plat Book 39, page 31 of the Public Records of Pinellas County, Florida, LESS the West 30 feet and the East 550 feet, be and the same is hereby vacated, closed and released, and the City of Clearwater hereby quit claims and releases all of its right, title and interest thereto to the persons, firms or corporations entitled thereto by law, excepting that the City of Clearwater hereby retains a drainage and utility easement over said described real property for the installation and maintenance of any and all public utilities thereon. Section Z. That the City Clerk is hereby directed to record this ordinance in the Public Records of Pinellas County, Florida. -I- Ord. #2076 2/23./80'- L f Section 3._ Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes.
